'Third. It in package form and the contents are stated ir terms of weight or measure, they are not plainly and correctly stated on the outside of the package. Fourth. If the package containing it or its label shall beai any statement, design or device regarding the ingredients or the substances contained therein, winch statement, design or device %Ml he false or misleading in any particular: Provide 1, that an article of food which does not contain any added poisonous 01 deleterious ingredients shall not be deemed to be adulterated 01 or tnisbran led in the following cases : First. In the case of mixtures or compounds, which may he now or from time to time hereafter known a9 articles of food, under their own distinctive names, and not an imitation of or offered lor sale under the distinctive name of another article, if the name be accompanied on the same la bel or brand with a statement o! the place where said article hai been manufactured or produced. Second. In the case of arti cles labelled, branded or tagged so as to plaiuly indicate thai they are compounds, imitations or blends, and the word "compound," "imitation" or "blend" as the Qase may be, is plainh stated ou the package in whicl it is offered for sale: Provided that the term blend, as used herein, shall be construed to mean f mixture of like substances not excluding harmless coloring 01 flavoring ingredients used lor the purpose ot coloring and flavoring only: And provided, further, that nothing in tbi9 Acl shall be construed as requiring or compelling proprietors 01 manufacturers o! propr.etary foods which contain no unwholesome added ingredient to disclose their trade formulas, except in so fai as the provisions of this Act maj require to secure freedom frotr adulteration or misbranding. Section 5. That no dealei shall be prosecuted under the provisions of this Act when he can establish a guaranty, signed by the wholesaler, jobber, maim faeturer or other party residing in the United States, from whom Ire purchases such articles to the effect that the same is not adul terated or misbranded or within the meanintr of this Act. design. ? It shall prepare rules and regula , lions with regard to the proper i method of collecting and exam' ining drugs, articles of food. Section 7. The sum ot one thousand dollars is hereby appropriated for the purpose of de fraying the expenses, it any, of analysis or examination ot any > article ot too I or drug as provid1 ed for in this Act; said 'sums to , to be expended under the superi vision and direction ot the State hoard of health. Section S. This Act shall go i into effect six months after its ' approval by the Governor. Seciion 9. All Acts and parts ' ot Acts inconsistent with this ; *ct be, and they are hereby, repealed.
