At tpe last coivening of the moot court Hon. no. P. Thomas presided as chief justice, assisted by Mr. Jno. G. Galbraith as asso ciatejustice. The case . for determination was that of Enhily New, by Chas. O. Barre, guardian ad litem vs. Delia Brabant. This action arose on an agreed statement of facts .to obtain the proper distribution of the estate of Portia Brabant, who was killed by her husband on January 4, 1911.. It appeared that . a few hours after murdering his wife, the husband, Othello New, com mitted suicide. - Portia Brabant had no children; her sister, Delia Brabant, being her nearest blood relative. Othello New left one child by his- first -wife, by the name of Emhily New, in whose favor this action is brought, and in which action she contends that she is entitled to inherit the es tate of Portia Brabant through her father, Othello New, who in herited the estate of his wife at her death. The defendant was represented bp Messrs. Mullins and Edens, while Messrs. DuBose and Purdy appeared for the plaintiff. The attorneys handled the case in a capable and efficient manner, showing much. ability in distin guishing cases. The defendant's contention was that a mu di er'ssould not be allowed to inherit the estate of his victim' and by his wilful act is thereby deprived of his share of the estate allotted to him under the law. The defend ant's attorneys laid much stress on the old common law maxim that "no one should profit by his own wrong." The plaintiff's at torneys based their claim upon the- descent and devolution of property as regulated by statute, sec. 855 of the civil code of South Carolina, 1912, which provides: "On the death of a married wo man, intestate, who shall leave no children or other -lineal de scendants, but shall leave .a hus band and sister, the husband shall be entitled to a, moiety of the estate, real and personal. In a very thorough analysis of the case, Associate Justice Gal braith handed down his opinion in favor of the plaintiff. STATEMENT OF FACTS James Darnell, Plaintiff, vs. William Weed, Defendant.
