Such a rule would prevent recoveries in many instances where, If the truth could be reached, the Plaintiff ought not to recover, but whereas the rule now stands a recovery will invariably be had. Ernette respectfully informs the ladies and gentlemen that his stay will be limited; during the short time that he will remain here, he will be happy to give lessonB in his beautiful art of Painting?by which a pupil will be able to take sketches from nature in a very few lessons, without having had any previous instructions in Drawing and Painting?on either paper, wood, velvet or suk, etc., ?c., ana warrants uio jjiugress of the pupils in each lesson. This is a plan that the best artists are invariably anxious to become ac^ qnainted with. He begs you to call at his room and see what pupils have effected. Taste, so called, is not required ; good common sense, and a desire to be acquainted with the art, is all that he asks on the part of the pupiL With most people Drawing and Painting is considered one of the most difficult sciences; at his room they will see that it is truly the most easy, and to convince them of the superiority of his system, known by himself only, Mons. Ernette will give one lesson free of charge. Mons E. is aware, that it is the custom of the country for teachers to call and solicit patronage, in declining to pursue this practice he trusts he may not be considered as deficient in respect and he most cordially invites you to call at his room. Prof. Macon Institute, Ga. To the Hon. Charles Dougherty " AN ORDINANCE, f To Regulate Licenses for Taverns, Retailing Spirituous Liquors, Billiard Tables, and for other purposes therein mentioned. Sec. 1. Be it ordained by the Intendant and Wardens of the Town of Camden, and by the authority of the same, that from and after the passing of this Oniinance, there shall be in the Town of Camden two classes of Licenses for the retailing of spirituous liquors, us follows: Number one, shall be the Tavern License, and may be granted to any person who shall keep a public house for the entertainment of travellers, boarders and other persons, in good faith, and who does actually entertain such (>er sons. Each person applying for this Liceuse shall be required before taking out the same, to swear that during its term he or she will permit no gambling in their house or ou their premises, and will use all lawful endeavors to prevent the same: and at the expiration of said License shall, before a renewal of it be grafted, make oath that for the last 12 months previous, there has been no gambling in their house or on their premises with their knowledge or consent. For I this License there shall be paid to the Town \ Treasurer the sum of seventy-five dollars annualI ly, and five dollars fee to the Recorder. Sec. 2. That Liceuse number two shall authorize the person to whom the same may be granted, to vend spirituous liquors in any quantity not less than one quart, not to be drank on the premises where sold nor any adjoining yard t or building. For this License there shall be , paid to the Town Treasurer the sum of fifty dollars anuually, and five dollars to the Recorder. Sec. 3. That any person desiring either of said Licenses, shall apply by petition to the l Town Council, setting forth such desire, which class of License he desires, and where he shall I vend, naming his sureties, who shall be freeholders of the town, and shall accompany his petition with the recommendation to Council to grant the prayer thereof of three neighboring freeholders, who shall not be his sureties, and shall deposite the price of his license with the Recorder before the same shall be granted. Sec. 4. That no License shall be granted without a full and perfect compliance with all rthe requisites contained in the third section, nor until notice of such application has been published one w<ek in the newspaper of the place, nor until the second reading of the application before Council. , Sec. 5. That all Licenses shall be void the grantees of which do not comply fully with the law of the State of South Carolina respecting be oath to be taken bv vendors and retailers. Sec. 6. That all Licenses shall expire on the 31st day of December next following their being granted. Sec. T. That the same persons shall not be sureties on more than two bonds for Licenses. Sec. 8. That no License granted by Council shall be transferred to another person or authorize selling in any other house than the one stated in the petition, without the consent and regulation by Council, to be had by petition to that effect. Sec. 9. That a License to keep a Billiard Table may be had by petitition to Council, setting forth such desire and stating the building in j? which the table is to be kept, accompanied with | the recommendation of at least three freehold| ers or housekeepers in the immediate neighborly hood; which License, when granted, shall auW thorize the keeping a Billiard Table in the house f designated; but it shall be unlawful to permit any person under eighteeen years of age to play thereat, and any such act upon being proved before Council and the party being heard in defence, shall forfeit said License, and upon proof i being had of any gaming or betting at such table, the license shall be forfeited.?Each person applying for this License shall be required, before taking out the same, to swear, that during its r term he or she will permit no gambling in their house or on their premises and will use all law tul endeavors to prevent the same; and at the < expiration of said license shall, before a renewal of it be granted, make oath that for the last 12 months previous, there has been no gambling in i their house or on their premises with their knowledge or conseut. Sec. 10. That all honses and buildings wherein such Lie#*s are granted, shall be open and subject to the inspection of the Town Recorder and any member of the Council at all times. Sec. 13. And be it further ordained by the authority aforesaid, that from aud after the 1st January next, if any person or persons shall sell or retail any spirituous liquors within the corporate limits of Camden in any quantity less than three gallons, without having first obtained a license so to do from the Town Council of said Town, such person or persons, upon couviction, shall forfeit and pay for each and every such offence, not less than ten, and not more than fifty dollars. Sec. 14. And be it further ordained that all t ! persons violating the true intent and meaning | of this Ordinance, shall, together with their 1 sureties, be severally fined in the sum of not less than five, nor more than fifty dollare, for each i J and every offence. And if any person or per sons shall, after the passing of this Ordinance, i give, sell, or deliver any spirituous 'iquors to a slave or free person of color, without the express permission in writing of the owner, guardian, or person having charge of such slave or free person of color, such person or persons shall be fined in 1 the sum of not less than five, nor more than fifty dollars, for each and every such offence. Sec. 15. Be it further or lained by the authority aforesaid that all ordinances or parts of ordinance's for regulating Licenses for Taverns, i retailing spirituous liquors, Billiard Tables, and for other purposes therein mentioned, otherwise ! than the foregoing be and the same are hereby repealed.
