TEXT OF THE NEW DISPENSARY ACT. AU May See What Changes are, Made in the Law. Arnon?; the 168 measures resulting from the session of the general as p~mbly j ust ended there are none in which so much interest is taken as the new dispensary act Many in? quiries have been made as to the text of this act, and in this issue we print it as it will appear in the volume of the acts for the session of 1900. Here is the full text, omitting only the enacting words : Section 1. That section 2 of au act entitled "AD act to provide for the election of a State board of control, and to further regulate the sale, use, consumption, transportation and dis position of intoxicating and alcoholic liquors and liquids in the State ; and prescribe penalties for violation of dispensary law, to police the same, approved March 6th, 1896/' and an act entitled "An act to amend an act entitled an act io provide for tbe election of a State board of control, ^nd to further regulate the sale. use. consumption, transportation and dis? position of intoxicating and alcoholic liquors or liquids in the State, and prescribe penalties for violation of the dispensary laws, and to police the same, approved March 6, 1896." so as to regulate the importation of liquors for personal use, approved March 5, 1897, be amended as here? inafter set forth. Section 2 That the State board of control is hereby abolished Section S A board, consisting of three members, to be known as the board of directors of the State dis pensary, is hereby established, whose duties and powers shail be hereinaf ter defined The members of said board shall bo men of good moral character, not addicted to the use of intoxicating liquor as a beverage, and shall be elected by the general assembly in joint session, as follows : The chairman of the board shall be first elected and then shall be eiected , the two remaining members. The term of office of the members of said board shall be for two yeais, unless sooner removed by the governor ; they shall qualify and be commission ed in the same manner as other ; State officers. In the event of a vacancy on said board, by death, resgnatioD or otherwise, such vacan? cy shall be filled by appointment by the governor, until the next session of the general assembly, when an election shall be held to fill said vacancy for the unexpired term. Section 7 All constables appointed' under the prohibions of the "Aot to t provide for the ?lection of a State board of control, and to farther regu? late tbe sale, ase, consumption, trans? portation and disposition of intoxtcat iog and alcoholic liquors or liquid? in the State, aod prescribe penalties for violation of dispensary laws, and to police the same, approved March 6. 1896," and aots amendatory thereof, shall, before eDtering upon the dunes of their office, and io case sach con? stables shall have been already appoint? ed, then within 30 days from tbe passage of this act, each give bond to the State ic the sum of $500 wi b surety or eureties, to be approved by tbe attorney general, conditioned for the faithful performance of tbe duties of bis office ; and in oase of the breach cf said bood, sait may be brought thereon by aoy person aggrieved there? by, either io ibo county where any of the obligors reside or io aoy county where said breach may have occurred : Provided, That the governor shall report all snob appointments to the general assembly at tbe oext ensuing session, giving the date aod term of service thereof. Section 8. It shall be uniawful for tbe State commissioner, or aoy officer or employe of the State dispensary, or any couoty dispenser or bis clerk to pat any false or misleadiog label on any package'of liquor to be sold ander the provisions of this act, or to recei?e aoy samples for persooai use, or to drink, or to give away any liquors in stock ; and any person fout-d guilty of violating soy provision of this section shall, upon conviction io any court of competent jurisdiction, be punished by a fioe of not less than ?100 or by im? prisonment for not less thao three months, and such conviction shall work a forfeiture of the office or position held by such person. Section 9. The State board cf control j shall, within 10 days after the approval of this act, on demand, deliver to said j directors of the dispensary all book?, accounts and property of every nature aod kiod whatsoever. Section 10. All aots or parts of acts incocsisteot with the provisions of this act be, and the same are hereby, re? pealed. Section 12. This act shall go into effect immediately upon its approval by tho governor.
