A r tentative date for the hearing before [ the court has been set for December 6. The new county proposition was A writ of certiorari in mm both the Clarendon and WilliamsI burg cases was issued today, ordering the State hoard of canvassers to trausmit to the court all of the records in the contests and protests heard by it upon app-als from the county boards of canvassers in reference to the recent flection on . the new county proposition. There are two complaints, <uie by W D McFadien, of Clarendon county, and J H Black well, of Williamsburg. K II Welsh of Columbia appears for the relators. In the petition from Clarendon county, it is stated that the relator, | W I) McFaddeD, is a taxpayer, a qualified elector and is a resident of the township of Sandy Grove, in; Clarendon county. The part pro-1 poeed to be cut off from Clarendon | county to form the new county was the entire township of Sandy Grove. An election was held in the I township on the new county proportion. There was but one votiug I1 ace in the township, and the Kectiou was held at this. | The complaints state that there were two kinds of ballots cast by the voters at the election, one was in favor of the new county and the other was agaiust it; the former was of plain white paper and contained ^-..the word "Yes," in answer to the question whether or not the new county should be formed, and the ^-'j*l|er was a different shade of color and contained the word "No," in answer to the said question. "That there was cast,*' continues the complaint, "45 in favor of the formation of the new county, and of the latter, 25 against the same.'* It is stated iu the petition that the election was held out in the open, the ballot box and the place of voting not being enclosed or railed off; that during the holding of the ^ election the voters were standing around or near the ballot l>ox and it is charged that they could and did see others vote, and on account of the difference in color of the ballots, they could and did know how each other was vpting upon the question of formation of the new county. It continues: "That by reason of the said difference in the said color, nf caul liallots for .md airainst the [ formation of said new county the secrecy of the ballot at said election in said township was wholly pT *?nd entirely violated and destroyed, and on account thereof the said election was rendered null, void and of no effect; that the relator ' contested and protested said election on said ground before the county board of canvassers for Clarendon county, that said board overruled this said protest and cou' Vi test, and declared the result of said election to be against the formation of the new county.'' It is pointed out that the number of votes cast at these boxes was so I large a number as would change the general result.
