COUNTY SUPERINTENDENTS. Attorney General Gunter Holds That Coun ties are Liable For Their Travelling Expenses. Columbia Cor. News and Courier. Attorney General Guntc r has given an opinion of interest to school au thorities and taxpayers. He says that the counties have to pay trav elling expenses of the county super intendents of education. The opin ion reads as follows: Columbia, S C., April 20, 1903 Hon. 0. B. Martin, State Super intendent of Education, Columbia, S. C.--Sir: Yin request to be ad vised whether the county superin tendents of education are entitled to travelling expenses, and if so to what exten't and out of whit funds must they be paid. Section 1,198 of t he Code of Lawvs of 1902, and appoaring on page 11 of the school law of 1903,.as prepared by your office, provides: "In Ches ter, Lexington, Union an'd York counties they shaill receive annually, in addition to t he salaries mentioned ini the last siiI.oni, onel hundiilred( dol Slars, and iiin ronres Cou nt y fifty dollars for t ravelling exp.noses, and in every o,their eount.y of the State they shall receiv~e annal ly, itn ad di - tion to their salariesn., sneh sum as imaiy be necessary to paty thle actual eMiRes ineirrtid liy th0e ill attend iain metIigs enlled for thle pupoe ofi ad va'ncing th,' ' Ialioon-ii niter estsa, andle for ths- puirpos'.elof visiting,. schooels ini othle'r count b1 -s in order to becomie famili'ir wvith the'ir imanage m -nt no in m le of' I cheiiig: Pro app)rovedl ins fori of alny (coni'ty su 11 pi'rinitendes~. of ednen'i'i'iin unli sneh suptlerinitirtendet of sIdienti ma shll hiave uicationr wViith atn iiemnnized sita.iintnt, unditer oaith,i of thlei cx ieinsis Iinc rre-I. The terms of this section are so I plain that it is hardly necessary to attempt to add anything further by way of comment or construction. However, it is well to note that in the live counties mentioned by name the amount therein set aside is "for travelling expenses," and in the other counties the sum is to pay the actual expenses incurred in at tending meetings called for the pur pose of advancing educational in terests and for the purpose of vis iting schools in other counties. This, of course, must appear by way of a certified, itemized statement of the expenses. As stated in the section these expenses are to be paid out of the funds appropriated to the several school districts in proprotion. to the number of children attending the free public schools in each district. There was some confusion prior to 1901, as to the force and effect of this section providing for travelling expenses to county superintendents of education, but since the adoption of the Code of Laws of 1902 there is no further room for doubt, as that is the only statute law on the subject of force today The case was deided by the Su preme Court that of Houser vs Orangeburg County, in 1901, t.o be found at page 26~6, 59) S. C. The Supreme Court dlecidled that the county su perintendents were entitled to tratveliing expenses, and that the travelling expenses were no part of the salary. That d#'cision is of force today under 'inir present law. R spoet fully, U. X. Guniter, Jr., A t torney Gnera'. l)r.
