Points in Petit I m rocnv. Solicitor \V. St. .Iwlion Jervey was interviewed 1?\ a Reporter yesterday as to his circular letter to the trial justices relative to eases ol petit larceny. Solicitor Jersey said that I aware of the oreat expenses to the oountv entailed l>y the decision of the Supreme Court in regard to the jurisdiction of trial justices, lie had addressed a letter to Attorney (Jenera 1 liarle, of which the following is an extract; ''The recent decision of j tin* Supreme Court declaring t'nc Courts of trial justices to lie without jurisdiction in eases of petit larceny is frauoht with serious consequences to tin* counties as well as to the accused. Perhaps in this county, where the oreat volume of the population is crowded into a city, the consequences are most serious and the earliest felt. Cases of this character are of dady occurrence here. A week since a trial justice applied to me for advice in the following case; A little neoro was caught stealing a pair of piereons valued at Mventy cents. lie could not tfive hail, and it was too late to oive out a bill at this time, or the little fellow had to he locked up, and will he kept in durance vile until the end of June awaitino trial. This is unjust to the culprit and ruinous to the county, and a plan has suoto'sted itself to me which, while it devolves a oreat deal of trouble and additional work on the solicitor is the onlv scheme I can devise to meet the emergency." The plan suggested was approved hy Attorney General Karle, and Solicitor Jervoy has uecordingly sent out a eiroulnr letter to the trial justices of the Kirsteireuit calling attention to the decision of the Supreme < 'ourt, at d instructing them that in all cases of petty larceny, should there he prolmhlo cause, the defendant should he committed or hounr over to apjear for trial at the ne.V term of General Sessions. In mtik ing such preliminary examination! they sire urgently rcouested to reduet all testimony to writing, have tin same signed hy the witnesses, givt the defendant an opportunity to mak( liis stsiteinent, and immediately for ward to him, the solicitor, sill the pa pers, with such remarks as they nun deem proper. The solicitor then examines th< testimony and the suggestions of tin justiees, and when lie thinks the cul prit has received suflicient punish mont for the crime, orders his releasi from jail on his own recognizanci for appeorance at the next term o < .'ourt. when he will ho discharged Any habitual thief, who steals agaii after the expiration of a short term will he summarily taken up and heh in jail until Court moots. .Nee out <'(wrier.
