I’erty Ussery nnd Marvin Holland weie aunding talking t the closing show of carnival week a charge of shot fired from the darkness Struck and instantly killed Mr U*sery. Two negro men. Quitman Johnson and Ferdinand Grubn* were Pled for the crime and convicted Johnson made a confession claiming that Mr. f’liester Kennedy had hired him to kill Mr. Marvin Holland, and that he. Johnson, had shot the wrong man. A new trial was granted Johnson and Grubb* to enable them to testify at the trial of Mr Kennedy. Upon thelf evi deuce nnd other t«*liinory gathered by a Pinkerton detective Mr. Kennedy was found guilty as an accessory before the fact, and sentenced to life imprison ment In the Penitentiary An appeal wa* taken to the Supreme Court which on Saturday gave Its decision sustain ing the finding and sentence of the cir cuit court. So Kennedy must spend the remainder ol hi* life in the Peni tentiary. Johnson and Grubb# will be tried again nt the approaching term of Court.
