T HE HOAID LAWS. Bill Proposed by Chamber of Com merce Committee and Present Law. The Chamber of Commerce Bill. A BILL To provide for the improvement of the public roads in Newberry county; to levy .a property aid cornnutatidn tax for working the same; to provide for a good roads commission for New berry county. and to regulate the worlk of the chaingang. - Be it enacted by the generalassem bly of the State of South Carolina: Section 1. That the governor, in recom'men.dation of the senator and representatives, is hereby authorized and directed to appoint two' discreet electors, whose term of. office shall be four years from the date of their ap pontment, .and, wjo, with the county supervisor, shall be known as the County Good Roads Commissioners of Newber.ry Cbunty, who shall be au thorized and tampowered to perforir the duties hereinafter required. Pro vided, That if either one of the twc commissioners to be'appointed by thE governor shaU become a candidate foi or accept any other offic under thE State or Federal government his po sition on thi board shall be declared vacant and a successor appointed. Sec. 2. For the purpose of main tainijg and improving the public high' ways. of Newberry county, there i, hereby levied an annual tax of twc mills on all the'real and personal property in the said county, which shall be levied and coTlected in thz same manner and 'at the same time-as al other taxes, and that said highway tax when collected shall he set apart and appropriated-to each of the eleven townships in the cointy pro rata ac cording to the public road mileage of each township, b the County Good Roads Commissiqners, -on the fdrst day of January of each year, or as soon thereafter as practicable. Tht said Board of Good Roads Commissioners shaH file th(ir apportionmflent of spid tax witlh the conty treasprer- who shal4 thereupon -credit each township with its apportionment and keep an accodnt with each of said townships: Provided, That before the apportion ment herein provided 'for is made, the said Board of Good Roads Commis sionert shall set apart a sufficient sum- for the maiptenance of the county - cehai'ngang, not exceeding $5,000k and a separate .account of .this fund shall be kept 'by the 'eQunty treasurer, and * ,only warrants foi~ the maintenance of the chainlang' shal' be paid there from: Provided, Further, That before * the apportionment herein provided for is 'made, a sufficient sum shall be set aside t pay the. salary of a civil en gineer,.and exper,t road builger~ here -iriafter provided for: And, Provided further, That before the apportion ment herein provided for is made, the /salary of the two members of the BoaT~d of Good Roads Comnjissioners hereinafter provided for shal-l .e paid Sec. 3. That all,mple citizens in the county outside of -incorporated cities and .towns between the ages of 1,8 and 50 years, except such as may be, 'upon the cortitlcat'e of two reputabTe prac ticing physicians,. declared unable to ' perform labor,' shall be required to pay to the county treasurer of said county between the 15th day of Octob er and. the 31st day of December in each and every year, an,a.nnual com mutation or road 4tax of $3.00 each, in lieu of' performing, or causing to be performed, labor upon the public high * ways of s,aid county, which commuta tion tax shall be held as part of the fun& provided in Section 2, of this act, and apportioned in the same~ manner; and any failure to pay said road tax shall be a misdemeanor, and the de fendant upon conviction shall be pun 'ished by a fine of not less than $3.00, and not more than $20.00.. o'T impri,s on-ed for not:'less 'than thirty days Sec. 4. The Board of Good Roads dommisdiondrs herjein -provided for shall employ, 'in their -discretion, a competenut man for each towns!hip, and place at his dispo.sal a force of not less than ten laborers for each . township, who shall be inown as the work-gangs for the respective town ships, and who shall work L'he roads in the respective townshiifs under the direction of the Board of Good Roads Commissioners and the civil engineer hereinafter provided for and shall be paid out of the fund provided for in Section 2 of this act; said work to be done at such times as the Board of Good Roads Commissioners and the civil engineer shall deem best, and for 'such length of time as may be ne.ces sary to keep the roads in go.od condi tion, or as the .noney herein provided for shall warrant. Sec. 5. The Board of Good Roads Commissioners herein provided for shall employ a civil engineer who-shall he an .expert road builder, who, under t:he dire.ction of the Board of Good Roads Commissioners. shall h-ve con trol and direction of the nmaintenance of the roads in the several townships, and also of the work hereinafter pro .cided for to be done by 9Be chaiigang. cretion of the Board of Goods Road Commissioners, and under t e direc tion of the civil engineer, to relocat( widen and grade the public roads c the county. provided that no road sha] be less in width than 20 feet. Sec. 6. The county chaingang, unde the direction of the Board of the Goo Roads Commissioners and the civi engineer herein provided for, shall b kept on permanent road work. That 1 to say the chaingang shall start at th court house and build each roa leading to the court house for fou miles out from the city limits of New berry and when that work is complet ed shall carry the work four mile farther on each of these roads, and s on, until each -road is built to th county line. By permanent roads ar meant sand and clay or gravel an when necessary macadam; no wor to be done unless the plans are firE approved by the civil engineer, an< if in his judgment advisable, thk road before being so built shall be relc cated and graded. Sec. 7. The two members of th Board of Good Roads Commissionew herein- provided for shall be paid a Iannual salary of $400 each, as abov provided, and each shall enter into good and sufficient bond to be approi ed by the clerk of court ia the sum < $5,000, each, the necessary expense incurred thereby s'hall be paid out ( the fund raised by this act in the sam manner as their salaries. Sec.. 8. That the county treasure in a ledger kept for that purpese, sha keep a separate account of each towi ship -road' fund, and of the count chaingang fund, in which he sha credit each township and the count chaingang with the amount apportior ed in this act, and pay from said towi ship funds, and county chaingang fun the warrants and claims drawnlby th Board of Good Roads Commissioner as hereinbefore provided, and the sai county treasurer shall make monthl settlements and monthly reports t the Board of Good Roads Commi4sior ers of he separate and respectiv funds herein provided. Pe it ena'cted by the gener al assemnbly of the State of South Caro lina, That from and after the approva of this act all persons residi,ng in New berri county who are liable to roat duty 'shall perform six days' service on the public highways of said coun ty each year under the direction o the -supervisor and -county commris' sion ers, or,an overseer appointed b: 'the supervisOr, or in lieu thereof shal pay a tax of two dollars, payable a the same time and in the' sam< manner as is now provide< for the payment of State and counta tes; and all moneys receiyed fron tthis source shall be used by the super 'visor and county commissioners fo' 1the improvement of the roads in th' Idisticts where,the money is derived. -Sec. 2.
