THE PROHBITION BILL HAS PASSED PROVISION OF MEASURE IN OLUDING AMENDMENTS. Election to be Held August 17 to De termine Whether Wet Counties Retain Dispensaries. The pohibition bill, as passed, iu cluding Christensen and Williams amendments, provides a. follows: "Section 1. That all alcoholie i quors and beverages, whether manu factured within this State or else where, or any mixture by whatsoever name called, which, if drunk to excess will produce intoxication, axe hereby deelated to be detrimental, and their use and eonsumption to be against the morals, good dhealth and safety of the State, and contraband. That it shall be unlawful for any person, firm, cor poration or association within this State to manufacture, sell, barter, ex change, receive, accept, give away to induce trade, deliver, store, keep in possession in this State, furnish at publie places or otherwise dispose of any spirituous, malt, vinous, ferment ed, brewed or other liquor and bev erages, or any compound or mixture thereof whieh contains alcohol and is used as a beverage and which if drink to exeeess will produce intoxication, except as hereinafter provided. "Sec. 2. That wholesale druggists may lawfully sell in wholesale quanti-) ties to retail drLggists and to public or charitable hospitals or to medical or pharmaceutical colleges and in no other way, pure alcohol for medical p,uposes only, or grain alcohol to be used by ohemisits or bacteriologists wetually engaged in scientific work and for auth purposes only, and such wholesale durggist shall at the end of eawh month in which any such- sales have been made, file 'with the clerk of the court of the county in which they do business, a statement in writ ing under oath, giving the name of the purchaser, ithe price paid, ithe date of sale, and the quantity and charaeter of the sleohol sold. That / if said wholesale druggist making such sale is not a resident of the State of South Carolina then su&; statement shall be filed in the office of the tlerk of the cou-irt of the county in which the pur 4ehaser aesides. "See. 3. That any retail druggist vAhose place of business is located in any of the incorporated towns or .ci ties of this State, whio is himself a regstered or :li.eensed ph1armacist, or w:ho regularly employs a registered or licensed pharmacist, may sell, in the manner herein set out, upon filing a bond in 'the sum of $5,000, to be ap proved by the clerk of court, in whieh such druggist does business, condi tioned for a faithful observance of the provisions of this -act, such bond to be approved by 'the clerk of the court, pure alcohol for medieal purposes onily, grain alcohol to chemists a.nd bacteriologists aetally engaged in seientific work, and for such purpos es only, and wine 'to be used for sacra mental or religious purposes only: Provided, That nothing herein con taimed shall prevent such druggists from using alcohol in the compound ing of prescriptions or other medi eines, the sale of which would not sub-. ject him to tihe payment of a special tax requiired of 'liquor dealers by the' governument of the United States: Provided, further, That nothing here in cont.ained- shall prevent such drug gists fr.om c ompounding or selling medi&n.al preparations .manufactter ed in accordance with formulas pre seribed liy the 'United States Phar macopoea' and 'National Form lary,' which contain n~o more alcohol 4hia~n is niecessairy to extract the medi danal properties of the drugs contain ed in such preparatic ns, and no more alcohol than is negessary. to hold the medicinal agents in .sohition, and. which are manufacture and sold as medicine, and niot as beverage. "Sec. 4. That no sale of pure al ohol, for medicinal purposes, shall be made by any :retail druggist, except upon the .preser.i.ption of a regular practicing physican of this State, who, before wri'tinig such prescriptions, shall make an 'ac.ual examination of the person for whom the p)reseription is issued, .and the said prescription shall be substantially in the follow ing form: 'State of South Carolina, ....... county. T.o........ drug gist. I.......*a regular lieensed and practicing physican under the 'laws of this State do her'eby certify, that I 'have examined......., a pa tient in ay cha.rge, and I 'do hereby pre sribe for the use of said patient .... alcoho1, and I further certify. that the .use of such alcohol is, in my judg me.t, absoluitely necessary to alle'viate r -eure the illnes~s or disease from which said patient is now suffering. and that I am not interested in the drug store 'to whieih this prescription is directed, nor in the profits on t.he drugs herein preseribed. "Sec 5 .4 npescription shall be filled herein except uuvn the day upon which it is issued or the follow ing day, and no -more than one-half pint of alcohol shall be sold and de livered on any one prescription, and when such prescription is filled, it shall not be refilled, but shall be de livered to the druggist filling same, and at the end of the month in which the samwe is filled, it shall be filed by such druggist in the office of the clerk of court of the county in which said druggist is engaged in business: Pro vided, No druggist, who is also a prac tieing physician, shall fill his own pra scription hereunder, nor shall -they be filled at any drug store in which the said physician is financially interest ed: Provided, furtlher, That the de livery of suoh alcohol sold under such preseription shall be made only di rectly to the person for whom such prescription is issued or to tire physi cian, or to some one authorized by the physician, or in case of a minor to his parent or guardian or physician or some one authorized by said phy slican. "See. 6. That any retail druggist whose place of business is located in any of the incorporated towns or ci ties of the State may 'lawfully sell all cohol in quantities not greater than five (5) gallons to be used in the arts or for seientific or mechanical pur poses, and such druggist may sell, in like quantities, to chemists and bac teriologists .engaged in scientific work and for such purposes only, and such druggists may sell in quantities, not graater than ove-half gallon, wine used for sacramental or religious pur poses only. That any person desiring to purch-ase alcohol for the purpose set out in this seetion, shall sign a written or .printed statement, giving his name, Tresidence, occupation and the purpose for which he intends to use said alcohol, and he shall certify that said alcohol is purchased in good faith for such purpose -ad no other, and that said druggist shall, at the end of each month, file, with the clerk of court of the county in which he is engaged in business, all such statements, wilth a certifi ate under oath, that said statements contain a true statement of all such sales. ".See. 7. That it shall be unlawful to sell wine for sacramental pur poses except to a minister, pastor, priest, or regularly constituted offi eer of a mgularly organized religious congregiatikn or church. Any person, desirng to make such purchase, shall sign a waitten or printed statement, giving his name and residence and the namne and location 'of the chureh for which such rwine is purchased, and be shall eerbtify that said wine is pur hased in good. faith, to be used for saciramental or -religious purposes, and no other. That such statement shall be filed as provided for in the next preceding section, i~ 'the office of the cerk of the court. "See. 8. Th:at all statements or prescriptions -required by this act to be filed in the office of the clerk of the court shall be recorded and pro perly indexed by him in a book kept for that purpose, which shall at all times be open for public inspection, and a ertified copy of such reoord, or .the original statement or prescrip tion', with thie certificate of the clerk of 'the court indorsed thereon, show ing that it has been recorded, shall be prima facie evidence of the facts re ited therein. For making such re cord the clerk of the court shall be entiled to charge and coldect fosr each prescription a fee of 5 cents and for each statement, other than prescrip tion, a flee of 15 cents, which shall be paid by the party filing the same. "See. 9. That in additionr to the equDmemjenitys heireinbefore prescrib ed, all liiensed and registered drug gists selling alcohol by prescription shall -keep a record thereof, whieh shall bear the 'true dates of the sal es, 'the naJ of the spersons to whom sales were made, names of physicians or surgeons uipon whose preseription3 eah were made; such records shall be subject eat all 'times to the inspection of thbe solicitor of. th.e distriet, the sleniff and other peace offieers of the coanty, 'the mayor and police officers of the city or town in which sal li er.ted 'and registered pha'rmuaist's business is located, and all other per sons, and each druggist making any *such sales shall be required to re pont under oath, to the circuit judge presiding .at each term of court of te cou-nty in which said druggist is enaged in business, a true statement of sudhi fa.ets, a.nd also file on Monday morning of each week ai list of the al eohl sold by 'him, to whom sold and by what physician pre;c'ribed, with the c'hiief of peliee and the mayor or intendant of the municipadity, and post one copy in some public place in *ac na~i unicip:.lity. "Sec. 10. Tihat nothing~ in this act shall prevent the sale of wood or de natured alcohol. ''Sec. 11. That any person who violates any of the pro)visonls of this aet shall be guilty of a misdeamneanor and upon conviction thereof be fined in a sum not .le.s than $100 or more ,than $300, or imprisoned at hard la bor for a priod of not less than three montihs .nor for more than on-e year, and for the second or any subsequent offense, upon conviction thereof shall be imprisoned at hard labor for not less than one year nor more than five years. ''Sec. 12. That any druggist or physi-cian who violates in any way the provisions of >this act shall, in addi tion to the punishment iherein provid ed, have their license revoked for a period for not more than one year for each offense. "See. 13. "Sec. 14. This act shaitl take e!f( o the first Tuesday in A.ui 1%9; Piovided, That in the o Iun ia Laving dispensaries an elez h1 be held -on 0he tdird Tuesday in Au gust, 1909, for the purpose of deter mining whether the dispensaries lo catied therein shall be reopened, and such election in each of said counties shall be held and conducited by the' same officers and under the rules and regulations provided by law for gen eralI O.ections. "See. 15. At sudh election the elec tion commissioners for such county shall at each voting precinct therein provide one ballot box in which the ballots must be cast. Any person who i's .a qualified elector of such county may vote in said election. Every vot er who may be in favor of the sale of liquors and beverages in such coun ties sha3l east a bal,lot in the box pro vided therefor, on which shall be prited the words 'For sale and Manufature of Alcoholic Liquors and Beverages,' and every voter op posed shall east a ballot upon which shall be pri'ited the words 'Against Sale and Manufacture of Alcoholie Liquors;' if a majority of the ballots cast in such eleetion be 'For Sale and Manufacture of AlcoholieLiqixors and Beverages,' it s'hall be lawful for such .iuors and beveages to be sold ia said county as hereinafter provided: Provided, That expense of these eleetions shall be borne by the State. '"See 16. In case an election as herein provided shall result in favor of the sae of liquors and beverages, the dispensaries in eadh county so vot ing shall be reopened and conducted unde~r 'the provisions of an act en titled 'An act to declare the law in ref ersnee to, and to regulate the man afacture, sale, use, consumption, pos sesion, transportation and disposition of, alopholie liquors and beverages within the State, and to police the sarae,' 'approved the 16th day of Feb raary, 1907, and acts a.mendatory thereof: Provided, That all of the provisions of 'te said act not incon-g sistent evith this act shall remain in full force and effect in 'all of the coun ties of this State: Provided, further, That in countiies which shall reopen dipensaries therein, the county dis pensary board 'and dispensers in office on August 2, 1909, shall continue to discharge itheir several duties as if steh dispensary or dispensaries 'had not been closed: Provided, That in the eOunTties which have heretofore voted upon the question of dispensary or no dispensairy under existing or pre viouis laws and have no dispensiary at this time shall hiave the right at any time after the expiration of four years fnom 'the last election on the liquor question to hold an election upon the question of dispensary or no dispen-I say, as provided in an act entitled 'An act .to declare the law .in refer ence to, iand to regulate 'the manufac 'tre, sal'e use, consumption, posses sion, transportation and disposition o, aleobolie liquors and beverages, withn this State, and to polie the , SOME OF OUJ To be conservative. Gen. Butler is now at an infirmarv in the city of Columbia, where he has been for some time. He is improv ing and feels quite well. When he was United States senator he served on a special commiittee which visited the various homes in Washington, and .he was much im pressed with the work that was done by the Sisters of the Poor.
