MUNICIPAL NOTICE Office of City Clerk and Treasurer, Orangeburg, 8. C, April 1, 1911. In pursuance of the provisions of an ordinance of the City of Orange burg, entitled "an ordinance to re? mlate Licenses in the City of Orange burg,"- passed and ratified by City Council March 10, 1911. * Notice is hereby g?ven that tht. City Treasurer's office will be open lor the purpose of receiving such Li censes and the compound tax anu ?log tax imposed by the ordinance of the city, from the 1st to the 15th of April, 1911, inclusive, from 9 o'clock a. m., to 2 p. m., Sunday ex cepted. All parties interested will take due notice and govern themselves ac cordingly. Application blanks under Sec. 2 of license ordinance may be obtained from the city clerk and treasurer. L. H. Be it ordained by the Mayor and Aldermen of cae City of Orangeburg in City Council assem bled, that every person, firm, compa ny or corporation engaged in or In tending to engage in any trade, busi ness or profession hereinafter men tioned, or keeping an office or place of business open for the sam??shall obtain on or before the 15th day ot April in each and every year license therefor in the manner hereinafter prescribed. "Every person, firm, com pany or corporation commencing bus iness after the said first day of April, 3n each and every year, shall obtain ?a license therefor before entering upon such trade, business or profes sion. Sec. 2. Every person, firm, compa ny or corporation required by this ordinance to obtain a licence to en gage in any trade, business or profes sion for which a license is required, shall make application therefor to the City Clerk and Treasurer and shall give: First, his or her name or style, and in case of a firm or com pany the names of the several per sons constituting such firm or com pany; Second, the trade, business or profession for which a license is re quired; Third, the place where such trade, business or profession Is to be carried on; and in csse of dealers In goods, wares and merchandise, drug gists, dealers in carriages, buggies and wagons, other than their own manufacture, dealers in pianos, cab inet organs and other musical instru iments, the application shall be*In ?writing and sworn to which shall state also the amount, extent and value of business carried on and their gross sales or receipts for the preceding fiscal year. All of which, and answers to questions relative to which, shall be given under oath. Nothing herein contained shall in any manner affect any other requirements of trade, business or professions. Sec. 3. If any person or persons shall exercise, or carry on any trade, business or profession or shall keep an office ;r place for ssuch business? for the exercising, carrying on or do ing of which a license Is required by this ordinance without first taking out such license as in that behalf is; required, he, she or they shall for every offense be subject to a penalty not exceeding one hundred dollars, cr to imprisonment with or withou?. hard labor, not exceeding thirty days, as may be adjudged by the Mayor or acting Mayor trying the case. Sec. 4. The license granted under this ordinance shall not authorize the person or persons (except lawyers, physicians, dentists and auctioneers) or firm, company or corporation men tioned t herein to exercise or carry on any trade, business or profession specified in such license in any other 'place than that mentioned therein, and every person, firm or corporation exercising or carrying on any trade, "business? or profession or doing any act for which a license Is iequired shall keep said license at all times of business in a conspicuous part of the business place, and on demand of any authorized official of the city government shall produce such li cense, and unless he shall do so shall be deemed to have no license. Sec. .'>. It shall be the duty of the Chief of Police to detect and report all parlies falling to take out a li cense as; herein required. He shall visit ea:h and every place of business from tine to time after the 15th day of April, in every year, and ascertain and report immediately to the Mayor the navi es and places of business of all persons failing to take out a li cense and especially transients and parties recently arrived in the city who may be engaged in any business for whJch a license is .equired. Sec. R. Upon the removal of any person or persons from the house or premises at which the trade, busi ness or profession mentioned in such license was authorized, it shall be lawful ;or the city clerk and treas urer, a id he is hereby required to au thorize by endorsement on such li cense the person removing as afore said to any other place to carry on the tr.'.de, business or profession specified in such license at the place to which such persons may have re moved. Sec. 7. All licenses for the year granted under this ordinance shall contlu .9 In force until tu 31st day of March next succeeding the date of issue; and no license, except as pro vided for by limitation, per diem or month, shall be issued for less time or rate than one year. The city clerk and treasurer shall prepare a proner form t3 be issued in each case. Sec. 8. Applications for license of all kind shall be made to the City Clerk ind Treasurer and all fees for same shall be paid to him in ad vance; and in any case where license fees may be paid to the chief of po lice, he- shall report the same to the city treasurer at once and license shall be issued. Sec 9. Applications for the trans fer of license shall be made in writ ing to the city treasurer, referred by him to the Committee o\ Finance and if favorably reported on by them, to be authorized by the mayor. Sec. 10. On the business of the ! following, viz: Upon each and ev ery retail merchant, druggist, dealer in carriages, bug-ies and wagons (other than their own manufacture) and dealers in pianos, cabinet or gans and other musical instruments; and upon the business of any and every other person, firm or corpora tion doinj business of any kind in the city of Orangeburg for the car rying on of which license is re quired, and for each and every store or place of business within the cor porate limits of the City other than those hereinbefore specially named, designated and taxed in this chap ter: The sum of $10.00 when his, her or their gross sales or receipts for the preceding year do not exceed $5,000.00. The sum of $15.00 when such gross sales, or receipts are ov-er $5,000.00 and do not exceed $10, oeo.oo. The sura of $20.00 when such gross sales or receipts are over $10, 000.00 and do not exceed 15,000.00. The sum of $25.00 when such gross sales or receipts are over $15, 000.00 and do not exceed $20,000.00 and five dollars on each additional $5,000.00 or fractional part thereof, in excess of $20,000.00. The gross sales and receipts here in referred to shall be estimated upon the business ? of the previous year, provided that in case of any person beginning a business covered by this section and who was not en gaged in said business in this city during the previous year, such per son shall pay to the City Clerk and Treasurer as license the sum of twen ty-five dollars at the time of begin ning business, and in case it shall ap pear at the end of the year that such license so paid is more than his gross receipts would require him to pay, the City Council shall refund to him the amount so paid in excess of the amount required by this Section, or give such person credit for same on his license for the next year. Sec. 12. The amount to t>e charged for license for any other bus iness, trade, profession or occupa tion, not .herein specially enumerat ed, shall be fixed by the committee on finance*-.but said committee shall have no.jawthority to change or re duce th??'license fees herein fixed: Provided- tJiat in case of short term licenser-?taken *out in the latter part of the' fiscal ygar, the Committee on Finance-may in their discretion ve duce.the license fe*. But no reduc tiqncshall be made .before November 15" of each year. ""'" Sec. 13. - For th.e purpose ..of this ordinance; eaeh business, or occupa tion, herein seperately and specifically mentioned and-enumerated, shall be deemed to be a separate and distinct business or occupation and the pay ment of license for any business or occupation herein ? mentioned and enumerated shall not be held to in clude or embrace the license for any other business or occupation herein mentioned and enumerated, unless so. specified in this ordinance. Sec. 14. The City. Council re serves the right to revoke any license for any cause which may seem to. be just. Sec. 15. It shall be the duty of the City Clerk to make and keep posted in a conspicuous place in his office an alphabetical list of persons pay ing license under this ordinance ex piring with the current fiscal year, which shall contain name of the per-j son or firm, the business or occupa> tion and amount paid for such li cense. Sec. 16. That all Ordinances or parts of Ordinances inconsistent herewith, be and the same are hereoy repealed. ?
