a/ / wai not burning. Engineer Aiebtr stated that he had told the sheriff that he was running through streaks of moonlight and shadow, and that tha conditions were such as to make it difficult to see objects on the track. Messrs. Wilson ft Wilson represented the plaintiff and Mr. C. P. Sanders appeared for the defendant. Mr. W. B. Wilson, Jr., opened the argument > yesterday afternoon. He was followed by Mr. Sanders this morning, ^ and Mr. W. B. Wilson, Sr., followed Mr. Sanders In reply. The case Is now in the hands of the Jury. The next case on the docket Is that of Mr. W. F. Jackson, who is suing the Southern railroad for damages for injuries sustained while helping to move a car during a fire at Tlrxah some time ago. This case will probably be concluded tble afternoon. The case of Dorothy C. Brlckman against the Southern railroad, will be taken up tomorrow. This case grows out of the Pishing Creek wreck, the plaintiff asking for damages on ac4 count of the death of her husband, who was running the engine of the Ill-fated train. The defendant company has already admitted actual damages in this case, and It remains for the Jury to assess the same, and also to determine whether or not the defendant li liable for punitive damages In addition, and if so how much. Messrs. Lege re & Holman and W. B. McCaw represent the plaintiff, and B. L. Abney, Esq.. assisted by Messrs. C. P. Sanders, ^C. E. Spencer and Geo. W. S. Hart the defendant. The probability Is that the trial of the case will consume at least two days and very probably a longer time. * LOCAL LACONICS. Chester's Last Mexiean War Survivor. Chester special to Columbia State: Captain J. A. Captain Thomas lost an arm at the battle of Cherubusco. In spite of his disability be raised a company for service In the war between the statea Arrested for Breach of Trust. R. P. Haney, white, of Bethel township. Is in jail on warrants sworn out by Mr. Louis Roth, charging him with breach of trust with fraudulent intent, and with disposing of property under lien. Mr. Haiiey's house was destroyed by Are recently, and the understanding at the time was that everything was saved except some kitchen rurniiure ana uiensiw. owed Mr. Roth about $350, and he represented that he had the money with which to pay: but It was lost In the Are. There were various circumstances that led Mr. Roth to doubt the story, and he had Haney arrested. There was a preliminary examination before Magistrate Comer a few days ago, and as the result Mr. Haney was committed for trial. He has not yet been abie to give bond. York's Tax Collections. "I think you might afford to brag on York county a little," remarked Treasurer Neely to the reporter on Monday, as he was leaving for Rock Hill tp open his books at that place. He spoke half Jokingly and half seriously: but he gaVe a very good reason for his suggestion. "I noticed In one of the dally papers the other day, that Richland county got a little, over $4,000 during the first month of tax collections, and Abbeville. I believe It was, had a little over $5,000. From October 15 to November 15 I collected a little over $6,400, and that beats anything I have seen." In answer to further Inquiries Mr. Keely said that tax collections are proceeding about as usual; but there is not nearly enough money In to pay the pending claims. It Is a rule to try f to pay court expenses cash, if possible, and while the expenses are being paid, the money is not coming from the tax receipts. The treasrer is holding the bag himself. "But we wlH be all right by the first of January," Mr. Neely said, hopefully. "The people of York county don't, as a rule,' wait until penalties begin to attach and the probability Is that the great bulk of the taxes will be In by January." AT THE CHURCHES.
