The trial fthis interesting case came off at Chain ers-Cotton Exchange-on Thursday vening before Judge J- S-, late 7 elevated to the Bench. The State ras ably represented by P. Sampson nd A. Burr, Esqs., ard the defence by B. Jeenies, Esq. His Honor, on be ig escorted to his seat and the jurors uly sworn, opened the case by saying, int we as a people "sit on the ragged dge" of things generally, and that par cularly was the case in hand one of ie raggedest, and for pure cussedness ad no precedent in any books in his brari. This court, said his Honor, was ifferent from all other courts-even iat round the corner over the grocery tore-that it was not a cow case, but ne which related to a turkey, and that ny one in court who said turkey except i accordance with his ruling-which ould all be against the prisoners ould be served with rules which rork any way he minded, and more to ie same effect, when permission was iven to the State to.open. Mr. Sanip n, who had been standing on his left Mg with his back against the door jam, nickly let down his right leg and con onted the prisoner Sultan, who shook rith fear or suppressed laughter we uld not tell which. for one of the an ience intercepted the view by rising to a estion of privilege and requesting that is pipe be filled from the box near by. Ve omitted to state that Abram turned tate's evidence against Sultan, and that f the other offenders-one had taken le cars for Augusta to avoid prosecu on, and the other had intrenched him lf on the northwest side of Scott's reek in defiance of the law. The evi ence elicited by the State from the itness Abrams was mixed, by reason iat His Honor and the Solicitor both [arged him to hold his horses well i hand and say nothing but that which rould tend to criminate the prisoner. 'he witness, during the examination, semed to be suffering under some motional inwardness, and frequently oubled up till his head almost touched is knees, while his hands clutched ner ously at his diaphragm. Want of space prevents us from giv ig the evidence of this witness, which, affice it to say, bore against the priso er all the time. During the exatmina on by Mr. Jeemes, the witnesses' at tks of inwardness were more marked nd his face was much distorted, appa mntly from spasms, all of which seemed affect His Honor, as well as counsel, ny and the court generally. It was fecting-particularly when Mr. Jeemes sked him if as a hunter he had ever agged anything-the point being that s a grocery dealer he was much more icesful in beging rice, coffee. &c.,, ian as a hunter in the bagging of birds. Examination closed-Mr. Sampson rent for the jury in his usual impetuous ut forcible manner-the points of his eech being that Sultan was a fer igner, and had no right to come to this ntry and shoot turkeys, wild or tame; t this was a 'white man's country; iat our right to turkeys was estab shed when George Washington fiashed is sword over the head of the Ameri n Eagle. That it was a tame turkey, setting hen turkey at that, with twenty ye eggs; that the killing of that turkey eprived us of twenty-six turkeys, and iat next Christmas there would be veral dinners without the usual roast ird. He drew a gloomy picture of the istress on that usually festive occasion, ad it was observed that the jury had 1eir hands up to their eyes vainly en eavoring to shut it out from their sight. :vidntly the jury were overcome, the d men Uncle Burt and Col. Lip were nable to suppress their emotion, even e witness Abrams had another attack f inwardness, which got down into his ags. And the Judge was observed to te out his bandanna. There was no hiance for Sultan. L. B. Jeemes, Esq., 'then took the .oor feeling that his task was a forlorn pe, but nothing daunted, he hitched p his breeches-and made an able argu ient, claiming that his client was not a >reigner, though born in Georgia; that His father had font at Banker Hill Twelve Injans his mother had slain; .ud his brothers, William and .John and Jim, Had sailed over the raging main;" nd therefore he had a perfect right to [boot turkeys whether wild or tame; iat- it was not clearly establbshed by 2e witness that the prisoner killed the .arkey; that he was no shot on the ring; that it was the fault of the dog rho set the setting turkey; and much lse that was indisputable, but all to o purpose. At the conclusion of this rument, lie again hitched up his cousers-having unfortunately left his apenders at home-and reclined on a ibe. The State closed with a clincher, rhen His Honor pulled down his vest -having the idea that he is growing orpulent-and charged the jury that bis was a peculiar case, pecviliarly bad, peculiar court, and he a peculiar uge; and that the accused was an .npecunious foreigner, in proof of which e would bet his bottom dollar, and if :iev did not render a verdict of guilty Liey would catch something peculiarly gly. He was not a man to be fooled rith,,had been there himself, knewv all bout it, had seen Josh Billings, had no ear of higher courts or of being im leached, intended gomng to the Centen ll, was down on any man who said bis was not a court in which justice ould be had, &c. It would have been trange if under these circumstances casant witness, equally as criminal as the. other, plead guilty and asked for mercv. His sentence was segars for the audience. Farim and garden operations will commence now with renewed activity. As this is the light of the moon all seeds of vegetables which yield their fruit out of the ground may now be sown. A Mollohon farmer reports his sec tion looking up and building hopes on the Japan and Chufa peas. The loss of the blackberry crop does not disturb them much now. An invitation to go up and try the Chufa after a week's boiling is accepted, provided our fami ly physician is included in the invita tion. Wednesday last was a gala day. There were two weddings, both in the orning, the happy couples in the first flush of their new relation taking the train for the mountains, not of Hepsi (lam where the lion roareth, but to the pleasanter region where the turtle dove singeth its love song. The number of bachelors out on the occasions alluded to above wvas refresh ing, giving evidence that they apprecia ted the situation. Pelham & Wardlaw have been im proving the appearance of their drug store by the application of fresh paint. t looks vastly better in its new and eat colored dress. Our whistling friend has pulled up his city stakes and removed to the coun try, where he will engage in the pleas ant pastime of digging. He will continue to cultivate the noble art of whistling. A Concert is on the tapis, proposed to be given by the young ]adies of the Feiale Academy. Tuesday last was the dullest day ever experienced in the HERALD office-no body wanted anything. Do not overlook the opportunity of fered by Mr. DuPre, of Abbeville, of getting rare and beautiful flowers. His prices are very low. Any order sent to this. office will be forwarded with pleasure. If you want anything done in the way of repairing furniturn or any fancy work done neatly and expeditiously, go to Mr. 0. M. Harris' shop. He can do anything that any other man can do, besides many things other men cannot That choice lot of mackerel in barrels lately opened by Mr. M. Foot is out the bottom was reached a few days ago much to everybody's regret. If any >ther dealer has good mackerel let hita make the fact known or forever after hold his peace. Every copy of the HERALD is printed a a cost, and yet there are people who sil1 persist in asking for a copy just for nothing. It is common too to ask for a bundle of exchange papers as if they were not worth a price also. The un kindest cut of all, however, is the prac tice of borrowing the County paper from a paymng subscriber. It not only injures the subscriber but cheats the printer. Fift-two large, well filled, hand somafy printed papers are furnished for only $2.50 a year. Think of it and sub scribe. The bcst time to advertise is when times are dull, this is given up by the shrewdest business men. Now is the time too to have your job printing done, when prices are down. These are facts. As' money is sc arce we recommend the plan adopted in Howell Co., Mo., of making cows ia circulating medium and using calves as small change. If this is adopted we inight have a little beef occasionally. Mr. Tryon, the fire extinguisher agent from the house of P. P. Toale, of Chrleston, spent several days here last week, and we indulge the hope that he has made arrangements with the town for a large and wholesome apparatus. Housekeepers are to be pitied now, for they are at their wits ends in trying to get inateriatl to make dinners. They are making the best of the situation, however, and it is gratifying to say that they generally get up something. Three months of Leap year are gone, and no report yet of a single lady hav ing taken advantage of the privilege. In the absence of news items the im agination is forced into active play to make up this department. Why don't our friends- send in what they know.
