An Ordinance to preserve the peace and good order of the Town of Newberry and to establish police regulations for the same. Be it ordained by the Town Council, and by authority of the same that after the pass aga of this Ordinance, it shall be the duty of the Marshall to arrest all persons guilty of misdemeanors or lighter crimes, within the corporate limits of the Town of Newberry, by violation of the laws of the State of South Carolina, or by violation of any Ordi uance of the Town of Newberry, and bring them before the Intendent or a wardeu act ing in his stead, "hom the lntendent may appoint for that purpose, at such hour as may be designated from time to time, for a daily police Court and that the Intendent, or Warden acting in his stead shall have power to pass such order in the preni:- as in his opinion justice may req+tire consist ently with the authority of Council, in such case provided. Be it further ordained, that it shall be the duty of the Marshall, after the arrest of any person, whose violation of law interferes with the peace and good order of the Town of Newberry, or the conduct of the person arse+ted. after the arrest is mode, is such as to impair the peace and good order of the Town to closely confine such person, and to p-oduce him rs herein before directed for examination, or proper adu.inistration of crininal justice may require. Be it ordainea, that any person riding upon the side-walk, or leading hurses there on except to cross the same, be held guilty of a misdemeanor, and be punished at the discretion o: the Council, within the limits of its authority. Be 'it further ordained, that any person found drunk in the streets of the Town of Newberry, whereby the peace and good nr der of the Town is impaited or the conve nience of other persons is interfered with, he I eld guilty of a misdemeanor and pun ishable at the discretion of the Council nith in the limits of their authority. Be it ordained, that the discharge of 5re arms in the streets or roads, within the corporate limits of the Town of Newberry, be held a mi6demeanor, and punished at the discretion of the Council within the limits of its authority. Be it ordained, that smoking in the Rail Road Depot, or t pon any of its plat-forms, be held a misdemeanor and punishable at the discretion of the Council, within the timitsof its authority, and be it further or dained, that the smokidg in private ware housest and stores after notice forbidding sueeh smoking, be held a naisdemcanor, and punishable accordingly, as above provided Be it further ordained, that the use of false weights and measures, suhjects the, parties using them, to punishmPut at the discretion on the Council, M ithin the limits of its authority, besides their liability to be pioceeded against otherwise according to law, and it shall be lawful for the Mar sha!l, from time to time, to examine and test the correctness of all weights and meas ures used in trade within the corporate lim its of Newberry, and to report all violatfons of law in this particular. i)ote and ratified in Council assembled, and given under mny hand and the seal of the Corporationa, this fifteenth day of May, A. Be it ordained by she Town Conneil and by the atuthiority of the same, That all the streams within the corporate limits of the Town of Newberry, shall h'e kept open, sod free from all obstructions in any way im peding thte fresh flow of water, atd that the land owners and tenants be required to drain their lanads adjacent to thte asreams, of all stagnant water, anil remove any other causes impairing tI.e sanitary condition of the Town. That the Marshall shall take immediate steps to opena the streams at the expense of the Town Council, and to notify the latnd owners and tenants to drain their lands adj trent to the streams; and upon the fail urceof any one herein req-aire.] to drain land.s adj'acent to the streams, that the Marshall i.hall have the right, and is hereby instructed to enter upon~ suc:h lands re quiring drainting, and drain the saute, keep ing an exact s.ccount of the cost of such drainage, and charge the cost to the p arty whose duty it is to drain the land under this Ordinance and report the same to the Council. That the person or persons liable to drain lands under this Ordinance, and npoa notice failitng to rnder obed ence to this 0-di nance within a reas.onable time, shall be held guilty o1 a misdemeanor, .and punish a'-le with line at the discretion of the Coun cil within the limits of its authority, be sides being otheruise proceeded against according to Law. De it lurthuar ordained that all causes of sickness within snte corporate limits of New berry, or other nuisatnce, be removed or abated as far as mtay be by the ownters or occupants of the lots upon which such causes of sickness or naisance wray exist, upon notice to that effect, and thnat such personts fatling so to remove or abate such causes of sickness or nuisance, shall be held guilty of a maisdemeanor and punishable by fine at the dis, retion of the council, within te limits of its authority, besides being liable to be othterwise proceeded against accorditng to law. That it shall be the duty of the Marshall upon the failure of the ownters and ocen pns of lots to remtove or abate any cause of sickness or other nuisance as herein provided, to enter upon such lots, and re ove cr abate such causes of sickness or oter tnuisiace, and ke.ep atn exact account o such removal or abatement and report the sa..e to the Council. That it shall be the duty of the Mat shall to look closely and vigilantly to the irm provement of the sanitary conidition of the Town, and that he promptly report every thing at all impairinag the same.
