RHETT, SH.-We are pained to learn that this gentleman.was foul ly assassinated on yesterday afternoon, just after entering his farm near the.'lace Course. So far as we can learn it appears that Mr. Rhett was riding along a causeway, ou the si !e of which the murderer had concealed himself, under cover of an undergrowth of brush~and that after passing a distauce of ten feet, he was shot from the rear with a double-barrelled gun loaded with duck shot. Mr. Rhett was struck in the left arm and side, the shot apparently penetrating the lung. He rode but a short distance before falling from his horse, and died where he had fallen, in about three quarters of an hour. He gave no clue to the murderer. Drs. Mitchell and Geddiugs, who were in the immediate vicini ty, could discover no trace of him. An inquest will be held by Coroner Whil ing to-day.-Charleston Courier. 4th. WHEREAS Mnjor-Genoral Sicklos, com manding Department of tho Carolina?, en tko 26th inst., by Special orders No. 19, has di rected that white persons in military custody, charged with felonies or misdemeanors on the persons and property of colored persons, should be turned over to the* civil authorities for trial, and that like cases arising hereafter will be dis posed of in the samo manner; And whereas this' order-so gratifying to the feelings and sentiments of the people of this State-is based upon the logal opinion of Chief Justice Dunkin, given upon the urgpnt request of this Department,. and communicated to Gen. Sickles: 1st. That persons of color, under the 2?th and 30th sections of the "Act to Organize District Courts, are competent witnesses in tho Court of Sessions in all cases of felony committed by whites on the person or property of a person of color. 2d. That they aro competent to make affidavits and sue out warrants.against whites in felonies and misdemeanors, and'also to testify be fore Grand Juries in such cases, as woll as on the trial before the Petit Jury.' And 3d. That until the District Judges- aro commissioned, the Court of General Sessions retains jurisdiction of cases of misdemeanor committed by whites on the person or property of colored persons. Chief Justice Dunkin says: "The Court of General Sessions had always cognizance of offences com mitted by white persons against the person or property of a person of color. In the case of 'State vs. Hill,' 2d Speer, 150, which was an in dictment against a white person for assault and battery on a free person of color, it was ]m only so ruled, but recognized as well-settled law for moro .than half a century. The District Courts of December, 1SC5, not having been putin opera tion, I suppose the general jurisdiction of the Court of Sessions remain ; and I understand that such bas been the ruling of the Circuit Judges in rcferenco to cases of bastardy and vagrancy which have como before them. The 30th section, Act lSt>5, provides, 'That in-every ?ase, civil and criminal, in which-a person of color is a party, or which affects tho person or property of a per son of color, persons of color shall bc competent witnesses.' It is a remedial statute and mast be construed in reference to its object My opinion is, that porsons of color aro competent to testify before Grand Juries and Magistrates in criminal cases touching the porson or property Of persons of color." And whereas thc security of the liberty of the citizen arising from hi;: right to be be tried by a jury of his peers, can only be retained, in the present anomalous condition of the country, by the civil officers of the State executing the prin ciples contained in tho opinion of the justly dis tinguished Chief Justice, in good faith and with m earnest desiro to give security and protection to thc persons and property of the colored popu lation * And to tho end that this high privilege may be retained by tho good people of this State, I, JAMES L. ORR, Governor of the said State, do proclaim and declare, that it is tho duty of every civil Magistrate to give careful consideration to avery complaint inado to him by a person of eu lor against a white man for .my felony or mis demeanor alleged to have been committed against | the person or property of a person of color; and if ho, upon such consideration, concludes that lhere aro -reasonable grounds for such complaint, ?aid Magistrate sbi.ll take the affidavit of such person ol' color, and issue his warrant against :ho offender, requiring his arrest and recognizance :o appear at tho next torm of the Court of Gcn sral Sessions, just ns ho would do if the party halting the complaint were a whito man; and he .viii also recognize all witnesses hy whom the romplnir.ant may desire to prove the charge, as s now provided by - law, for securing tho atten iance of State witnesses. All Sheriffs and Con itables will promptly, faithfully and fearlessly izeente all such warrants as may be placed in ;heir hands. The refusal or neglect of any civil officer to perform an official act, properly required of ] bim by au aggrieved party seeking redress in the .-?vii tribunals, whereby a failure of justice en sues in tho prosecution of the class of offenders remitted to tho civil jurisdiction by this order, will be promptly reported by any officer cognizant af tho samo. V. In publishing tho subjoined correspondence for the information and guidance bf all concern ed, the Major-General commanding desires to impress the troops with tho sentiments of respect and deference for the ci vii authority that influ ence his own action in co-operati?n with the Ex ecutive of the State, so that tranquility may be secured by the mean-- and agencies luoct conge nial to tho peoplo.
