Sec. 335. If any person shall wilful ly destroy, injure or in any manner hurt, damage, impair or obstruct any Df the public highways, or any part thereof, or any bridge, culvert, drain, iitch, causeway, embankment, wall, toll-gate, toll-house or other erection belonging thereto, or any part thereof, Lbe person so offending sball upon con viction thereof be imprisoned not more than six months or pay a fine not ex ceeding five hundred dollars, or both, at the discretion of the Court, and shall be further liable to pay all the ex ? U n nnrnA peusetl Ui It:flail lug vuc same, Whoever shall obstruct, or cause to bo obstructed, any ditch or drain od the side of any road which has beeu, or may hereafter be, constructed under the authority and at the expense of the State, or any ditch or drain made as aforesaid, to drain water from any part of the said roads, or any of them, by throwing into the said ditches or drains any earth, logs, trees, brushes or other things whatsoever, and shall not immediately remove the eame when required, shall be deemed guilty of a cuisance, and on conviction thereof shall be fined in a sum not exceeding ten dollars nor less than two dollars, and shall be further liable for the ex pense of removing the same. Sec. 454. If any person shall cause any obstruction to be placed in aay part of the said highways or on any bridge or causeway thereof so as to ob struct or render dangerous or difficult the passage of carriages, or other trav eling thereon, and shall not imme Jiately remove the same when re quired, he shall he deemed guilty of a nuisance, and on convictiou thereof before a Magistrate shall be fined in a sum not exceeding ten dollars nor less fhan tron Hollars and shall be further liable for the expense of removing the said nuisance. Sec. 462. The drains and ditchee nade by any road overseer under the provisions of Section 1367 of the Civil iJode, shall be kept open by such over leer, and shall not be obstructed by the >wner or occupant of such lands, or iny other person or persons having ;he same in charge, under the penalty af forfeiting a sum not exceeding ten jollars or imprisonment for not more Lban thirty days for each aud every of fense.
