Washington. Dec. 28.-^-Justice Lamar of the United States supreme court today granted an appeal from tlie refusal of the federal district court for northern Georgia to release on habeas corpus proceedings Leo M. Frank, under death sentence for the murder of Mary Phagan at Atlanta. Frank has been sentenced to be hanged January 22, but Justice Lamar's action causes a stay of execution. Thirty days are given for the record of the proceedings in the lower court to be filed in the supreme court here. The State of Georgia then may ask that the hearing of the case be advanced. Such suggestions generally are granted. As a result of Justice Lamar's action today the entire court now will iss upon Frank's right to seek release from custody on a writ of habeas corpus on the ground that the trial court in Fulton county, Georgia, lost jurisdiction over him by its failure to have him present when the jury returned its verdict. Should the supreme court decide Frank was not entitled to the benefit of the habeas corpus writ, the State of Georgia would no longer be barred from carrying out the death sentence. If the court decides he was entitled to ask for the writ, the case probably would be remanded to the federal district court for the taking of evidence on the writ, and in opposition thereto. Should the supreme court eventually decide that Frank must be released, it was said, a further question would arise a to the power of the State to indict and try him a secor J time. Authorities are said to differ as to whether the first trial would b regarded as having placed Frank in "jeopardy." Sees the Turning. Atlanta, Dec. 28.?"It's a long lane that has no turning," said Frank in his cell. Some Health Epigrams. (Published by the Buffalo Department of Health.) Prevention saves many lives, but will eventually put many good doctors out of business. Drinking good water neither makes a man sick nor in debt nor his wife a widow. Money is the most envied and the least enjoyed; health is the most enjoyed and the least envied. Joy, temperance and repose slam the door on the doctor's nose. Give sanitation the first place in your selection of a picnic place. iiu summer ouungs uecome me cause for your winter illness. Every dav in the year should be kclean-up day. A once-a-year clean up is about as ouce-a-ycar bath, i Germs of tuberculosis have 'good shelter in a decayed tooth. Repair the teeth and remove that shelter. A decline in infant mortality is the result of proper education. A properly muzzled dog can't bite. Hydrophobia and stray dogs are a bad combination.. Keep you ears open and your mouth shut. The layman of today who is ignoI rant in the theories of prevention must be a clam. Many serious lung troubles follow neglected colds. When in doubt boil your drinking water. Avoid public drinking cups. Dirty hands are preferable to the public roller towel. Wash your hands before handling r i J uuu. Don't put your fingers, money or pencil in your mouth. Treat your body to an occasional bath; it may not be entitled to it, but it will repay you with better service. Hot weather is as safe as cold weather if you use good sense. A few cents worth of ice dai'y is the best hot weather investment. Your sense of small and taste are the greatest aids in prevention. Disinfect our home at frequent intervals by cleaning, washing and ventilation. Eat wholesome food and drink pure water. Go to bed early and get up early. Keep bedroom windows open all seasons. Cleanliness of person is the visible index of prevention. Nothing has yet been found to supercede soap and water. The cheapest food may be the most expensive. It costs less to get the doctor than the undertaker. Breathe through your nose and keep your mouth closed. 'I'U? 1.. i. i 1.: I i iic miter prerauuuii may I1KCwise keep you out of trouble. Insuflicient sleep and late hours are some of the causes which retard growth and health of children. The above has good advice and i would be well to read it to the children in the home as well as the parents. Much of the advice can be taken in by the little folks and in the fight for health one cannot begin too early. _ For Men and Women. Backache? Feel tired?
