It appears that David (Soiger had been tried bo* fore Magistrate Lucius in this county for assault and battery with an axe on Dave Martin. The magistrate hold that ho had jurisdiction to hear tho CA3o and lined tho defendant. Ihcu Mr. Bnuskott appealed from tho decision cu the ground that the magistrate had no jurisdiction under section four of tho act relating to the jurisdiction of magistrates, page 17:5 of theaetsof which says: "They shall havoexclusive jurisdiction in all criminal cases in which tho punishment does not exceed a lino of $!U<) or imprisonment for thirty days, except in cases of riot, assault and battery and larceny and tho carrying of concealed weapons, coupled with uu dlonse in which such weapon is used. In criminal matters beyoiind their jurisdiction to try they shall sit as examining courts and commit, discharge and (except in capital eases) recognize persons charged with such offenses. Magistrates shall have concurrent jurisdiction only with the court of sessions in cases of riot, assault and battery and lacony." Mr. Bnuskett claims that under this act the magistrates have no jurisdiction whatever to try any of tho olletises enumerated in tho lirst clause. .Judge Klugh heard him at some length in regard to the puzzling wording of tlio act. and then simply sustained tiio action of the magistrate.
