No person, firm, association or corporation shall manufacture for i&le, or keep for sale, exchange, barter, or dispenses any liquors containing alcohol for purpose whatsoever, otherwise than is provided in this act. Any person, firm, association or corporation de*iringor intendiug to mnoulaeturo or distill anv liquors containalcohol within this State shall first obtain from the State board of control a permit or license so to do : and it ?hall be uulaafnl for any such person, firm, association or corporation to manufacture or distill any liquors containing alcohol withiu this State without having such permit or license. Any violations of the tonus of the permit or liceuse shall authorize and warrant the seizure of the product on hand at any distillery or place where liquor* containing alcohol uro manufactured : Provided, The United States has no ben or claim upon the sauie. And in too application for it permit or license to manufacture liquors containing alSdbol, tho applicant shall give the State. power upon any violation of this) ad to seize and take possession of any fcjrodnct on hand ut the distillery or place wjuxe such applicant shall maniilacture such liquors, uud shall authorize the State to pay the United States j government the tax upon the same il lipoid. and to dispose thereof as provide \ herein for eontrulmud goods. Skc. 27, That the proceedings against liquor so illicitly kept, stored, sold, delivered, elsewhere than at his or her rosidcnce, transported or being transported, shall be considered a proceeding in rein, unless otherwise herein provided. Skc. 28. That tho carriage, trans- j portation, removal, sale, delivery or \ acceptance of auy of tho said liquors in any package, cask, jug, box or other puckage, under any other than the proper name or brand known to the trade as designating the kind and I quality of the contents of the casks, | I packages or boxes containing tho sutne, j or tho causing of such carriage, transportation, possession, removal, sale, delivery or acceptance, shall work the i forfeiture of said liquors or liquids I and casks or packages, and the person or persons so offending, knowingly, bo subject to pay a fine of not less thuu I ono hundred dollars nor more than ; five hundred dollars, or imprisonment | for the term of not less than six I mouths nor more than one year,and the wrongful name, address, mark, stamp | or style on such liquor wheu seized hail be cousidered evidence prima facie of guilt. | The books and way bills of tho common carrier may be examined to trace said liquor to the shipper, who shall be liable, upon conviction, iu a like penalty. .Sicc. That all constables, deputy constables, sheriffs, magistrates or municipal policemen shall have the right, power and authority, aud it shall be their duty, whenever they are informed or suspect tli.it any such suspicious package in possession of a common carrier contains alcoholic liquors or liquids, to detain the same for examination for the term of tivtuty-lour hours without auy warrantor process whatever. Auy con-table, deputy constable, sheriff or magistrate who shall neglect or refuse to perforin the duties required by this Act shall he subject t?? susp ut: ion by the governor. Any shetiti' or uiugis- , trate seizing any alcoholic liquors <>r liquids as required by this Section shall be paid one-half the valu" ol said liquor or liquids so soon as the same shall have been received at the State dispensary, approved and disposed of according to law. Sec. 30. That any interference by auy person with, obstruction or resistance of, or abusive language to, any ollieer or person in the discharge <>: the duties herein enjoyed, or the use I of abusive language by auy such olU-er or person to any p.-rsou or persons, shall be deemed a misdemeanor, ami the person or persons so offending !dl, upon conviction, bo punished by iue of not less than one hundred liars, nor more than live hundred liars, or imprisoned for a term of I le?s than three months lior more in twelve mouth*. , Sec. :JI. That all fermeuted, distilled lor other liquors, or liquids containing (alcohol, transported iuto this State, or iremainimr herein for use. mile, eon sumption, storage, or other disposition, shall, upon introduction and arrival in this State, l>o subject to the operation and effect of this law to the same extent and in the same manner as though such liquors or liquids had been produced iu this State. Sec. 33. That 110 person, except 11s provided iu this act, shall briug into this State, or transport from place to place within this State, by wagou, cart ; or other vehicle, or by any other means j or mode ol carriage, any liquor or | liquids containing alcohol, under a , penalty of one hundred dollars or imprisonment for thirty days for each of- j fense, upon conviction thereof, as for 1 a misdemeanor. Any servant, agent | or employee of any persons, corporations or associations doing business in this State as a common carrier, or any person whatever (except an ollieer seizing or examining the saino) who shall remove any intoxioating liquors from any railroad car, vessel or other vehicle of transportation at any place other than the usual and established stations, wharves, depots or other places | of business of such common carriers | withiu some incorporated city or town j where there is a dispensary, or who shall aid in or consent to such removal, j or attempt to remove, shall upon con- ! viction bo sentenced to pay a line of > n< t less than $lo<), nor more than $.">00, j or imprisonment lor a term of not less than three months nor 111010 than 12 | mouths : Provided, That said penalty ] shall not apply to any liquor in transit 1 when changed from car to car to faeili tate transportation across the State : i Provided, That this section does not ( apply to liquor purchased from a dis- j peusary and bearing tlio proper label or certificate. All liquors in this State, except dispensary liquors and those passing through this State, consigned to points beyond this State shall be deemed contraband, and may be seized in transit without warrant. And any | steamboat, sailing vessel, railroad, ex- j preescotnpany or other common carries transporting or bringing iuto this State, for sale or us therein, except by the dispensary, shall suffer a penalty of SoOO and costs for each offense, to be recovered by the solicitor of the circuit or the attorney general by an aetiou brought therefor in any court of competent jurisdiction. Sec. 3D. Every dispenser when he sells a package containing liquor shall put a cross mark in ink ou the label or certificate thereon extendiug from the top to the bottom or from side to side. "When uuy liquor is seized because it has not the necessary certificates and labels reqnirod by this act. the burden of proof shall bo upon tho claimant ol said spirits to show that no fraud has been committed and that the whiskey is not contraband. Sec. -40. That any railroad, steam* boat, expross company or other cohj moil carrier snail incur a penalty ol troble the invoice price of any alcoholic liquors lost or stolen in transit to or from tho disponsary, whether shipped as released or not, such penalty to be recovered by action in any court of competent jurisdiction. Sec. 41. That it shall be unlawful for any person to take or to solicit orders, or to receive money from other persons for tho purchase or shipment of any alcoholic liquors for or to sucfi other persous in this State, except for liquors to be purchrsed aud shipped from the dispensary, and any person violating this section, upon conviction, shall be deemed guilty of u misdemeanor, and shall be punished by imprisonment for a terru of not less than threo months nor more than twelv* months, or by a fine of not loss than 8100 nor more than $500. Sec. 42. It shall bo tho duty ol slier ill's, deputy slier ill's and coustablol having notice of the violation of any provisions of this act to notify tho circuit solicitor of tho fact of such violation, and to furnish him the name ol any witness within their knowledge by whom such violation can be proved.
