Tbe State Democratic executive com mittee meets io this city to-night to tab slate the terms and declare the resol ts Coi. Wilie Jones , tbe chairman, left ( yesterday with bis regiwent. Heavy Battery, 63 ll : Totals, 37,618 33,043 j Tm Voto Tabulated. Columbia, Sept. 16 -The execu tive committee to-night tabulated and declared the result of the recent pri? mary as foilowa : For Governor : Eilerber 37,723 Featherstone, 33,271 For Secretary of State : Tompkins, 30,492 Cooper, 38,957 Superintendent of Education : McMahan, 38,259 Brown, 31,849 Adfutant and Inspector Genei Floyd, 4 Blythe, 2 Railroad Commissioner : Garris, 4 Thomas. 1 After the tabulation was cou,p and the result declared the coi ! pending on appeal from several i ties and the Eilerbe-Norlon Coe sional contest were in order. After some discussion as to v case should be taken np it was d j ed expedient to take up the Sc senatorial contest in preferem the Sixth congressional contest Before beginning the case th* spective attorneys agreed ar themselves to restrict the argu on each side to one hour, excli ? of reading papers. Mr. Barnwell moved that speakers be given the *>ne hot agreed among themselves, and some discussion the matter was ried. Mr. Stuckey was the first spes and read thc grounds of contes presented by the attorneys of Altamont Moses, contestant. Moses was represented by Mei A. B Stuckey of Sumter and B Abney of Colombia. The contest?e, Mr. R I. Mann was represented by Messrs. Reyn of Sumter and Shand and Westo Columbia. Mr. Stnckey read the papen contest, which were quito volut ons. Mr. Moses Sled a quest with the county ch man that the vote of the en county be counted, and thus preel the probability of a clerical error, the committee refused to grant s request. Mr. Moses then gave not that be would appeal to the State ecutive committee and served pap on Mr. Manning that effect. Mr. Stuckey also read extra from the minutes of the Sumter co ty executive committee meeting, this session affidavits were produ< stating that one of the managers election was under the influence whiskey, and a voter was not a re dent cf Sumter county, but lived n< in Lee The contestant's attorney also re an affidavit from Mr Commander, o of the managers of election at t Sumter precinct. Col. R. W. Shand said that he h affidavits which won?d show tl there were irregularities in the vo? cast for Mt. Moses These affidav were not read at the meeting of t county executive committee, b were obtained afterwards. Just'at this juncture Mr Blea moved that nothing be beard exce what came up at the county meetin Mr. Lee thought that it should 1 allowed, as it was merely a matter justice, and he urged that such ev dence should be admitted Mr. Barnwell objected to Mr Lee remarks and spoke in favor of M Biease's motion. Unless there was limit, numberless extraneous fae would be injected and many hou would be consumed in hearing tr case If there were irregularitiei he thought the best thing to do wi to remand the case to the count committee The Biease motion was placed b< fore the committee, and -vas unan mously passed Col Shand began by paying lin the allegations and affidavits weie nc sworn to, and, according to the rule of evidence, such testimony was ir admissible In order lo expedite mailers, Mi Barnwell moved that the counsel fo each side be heard oa the qucstio whether the county committee wa justifiable in re/using to recount th vote in accordance with Mr Moses request Air Abney opened the case for tin contest?e. He said that the affidavi and allegation of Mr Commander, a state dabove. was sworn to, and tha the boxes cf the Sumter precinct came up properly sealed to the com rnit???e The discussion of the ques Hon whether the committee shouk open the Mate box is the bone o contention. The fundamental law is that ever} rfiori should be given the citizen lc have his vote counted, and it is the duty of the committee to count, and riot to accept the statement of re?u Uri ty If there is no proof of tam pering, the votes must be counted h? the eight box law it iu expressly t-tated that the votes shouid not be counted if thev were in the wrong b')j. In the Sumter box and in the Ta}' K.r store box there are irregularities, and these are the ones which content ant desires recounted Coi <Shand thought that there was one matter before this committee more important than tue election either bf ?Mr Moses or Mr. Manning When the ?tate put it in its statute that a vote placed in the wrong box should not be counted the legislature knew what it was doing1. He con? tended that the tickets for Senator s.iouid uot be counted if placed in the wrong box. As tc the scratched tickets there ie no evidence of such There is no law to make a fact true because one man swears to it Was it the duty of the county committee to recount the votes 'i No, unless it believed there was fraud, if the executive commit iee had thought it was not doing jus ; tice to the candidates, it was its duty ! not to have a recount The count of j managers at the home box is the best count you can have of an election. The couimittoe was under no ob tiou to order a recount and did e ly right in refusing to do so. Mr. Weston said that if the p of elections were to be impeache in this case, it would have a baneful effect The managers ol election of Sumter county were of integrity, and there was no dence to show that the election either illegal or irregular After days deliberation the committee cided that Mr. Manning was nominee for senator, and it is ut to remand this case to that com tee Mr. Abney, in reply, said only 384 votes were cast for sen and there were 412 men on the list Mr. Commander shows there were only 384 votes cast in election. Mr. Dabbs moved in county meeting to receive the n agers' report, despite the fact the chairman ruled otherwise others protested against Mr. Da efforts to thwart ali probability possibility of a recount The bo: brought into the presence of chairman and there opened and result taken therefrom Cousequ< ly, there was no possibility of frs Mr N B. Dial of Laurens in duned the following resolutions I Resolved, That it is the sense ; this committee, First. That it is the duty of county executive committee to quire into and pass upon each ; every challenged ballot Second. That county ballots State boxes and vice versa should be counted. Third. That all bal ?cits should counted when properly cast for t one office, although upon same bal with other votes improperly ca Therefore, Resolved, That this contest be, a the same is hereby recommitted the excutive committee of Sum county to vote in accordance w the views hereinbefore announced Mr. Winkler offered the foilowi amendment : Resolved by this committee in t matter of the contest of Altame Moses and R. I Manning, contesti the election for State senator frc Sumter county, that said contest sustained in the following partie lars : First, That the Democratic exec tive committee of Sumter county 1 directed to recount the votes in ai box upon request of either the co testant or contest?e, Baid recount be had in the presence of contesta and contest?e and their counsel Secoud, That all votes for oouni officers cast in a State box be n< counted ; that all votes imperfect scratched or not aerated at all f< certain county officers, but properl 8ratched for State senator be counte for State senator Mr Appelt said that in the pr mary election there is no rule pr< scribing into what box or boxes th votes shall be cast The Democrati rules have no specifications < such a nature ann hence there ws no reason why the votes should b rejected In the absence of any rul it is not right io say that the commi tee should not recount the vote again. Mr. Ciro es said that the object <: the primary election was *o insure fai; Dc.^. :.::d it was certainly a step back ward to attempt io pass ,-uch a r?solu trou -i- jost propound Mr Williams of Edgtfield urged tb abandonment of technicalities whe i: prevents toe booest expression of tb people at the bailor. If it is eviden that the people iuteod to put their bal lots io tne right, box but their icteiii gence is not .sufficient to ?'nable them ti voto as they desire, tbejc vote? shouh be counted Mr Williams tbco offered the fo! lowing amendment, which was to bo added to the hst clause ot tbe Dial res olutiou : Except the totals agree will the poll hst, and without that the State or CJUOTJ ballots were ignorantly or bj mistake deposited in the wrong box. lu speaking ot Mr Williams' amend mei,r Mr L?e said ihzz it would even? tually return to plague the inventor, if the people put bc-'-: State and county nc-kets in tfat: same box there is no Dossible tray to ascertain the true ex? pression of the people rle thought ii such amendment was adopted it would be the bephjiog of tho ca i'of thc white D?muoratic primary io Sumter county. After considerable discussion the tmjeudment of Mr. Williams was tabled ;.nd the first sec?on of the Dial resolu? tion was adopted When the question ot adoption of the second section was taken up Mr. W. P. Evans said that ballots cast tor the re? spective candidates were jos'ly theirs and should Oe counted Tue 12 votes ca>: at Samter but held by tho county committee should bo counted, and he moved that thc committee bc instructed (u open thc ballots and couni tne votes. Mr. Blease moved ibm the amend? ment be ia;a on the table, and it was carried. The second section of tue Dial reso? lution, was then put before the com? mittee and unaLtmimoosly carried. Section three was also favorably acted I upon. When the fourth section came up j Mr. Abney waotcd soa:e instructions sent with thc resolutions. If nothing is said about the Atkins box, which ; was sent by mail, tho action of thc I country committee will be affirmed by j the State committee Mr Shand said that thc only reason why tbere was only one box was ali ! due to the negligence of the officets. ? Mr. Barnwell offered an amendment ' stating that ail boxes where there were j irregularities be included in tbe in ; structions scot to thc Sum'er county executive oommitfee. Mr Appelt offended the following amendment to the amendment pro poped by Mr. Barnwell: Resolved, That it is the sense of this committee that the box known as the Atkins box, containing both State and county tickets, is illegal and void and shall be t'urown out and the votes therein be not counted, as the some is in violation of rules Four. Five aijd Eleven Mr. Appelt was opposed to throwing out the votes of white Democrars, and io common with many of the other members wanted fairness and justice, but under tbe peculiar circumstsnoes of the case he would urge the adoption of bis amendment Mr. Stuckey spoke in behalf of the amendment He said that the trans missions of thc Atkins box through the mail was a manifest violation of the Democratic rules, and (tie same was one of the specific grounds of contest submitted by tbe contestant. Upon motion of Mr Bleaee to table the amendment Mr. Carnes caiied for ao aye ar d may vote. The motion was carried by a vote of 20 to ll. Aye-A W Jones, W. W.
