The following is the bill passe( by the recent Legislature to providt a system of coop ty govern men for the several counties of the State Be it enacted by the Senate an< House of Representatives of th? State of Sooth Carolina, now met and sitting in Gene ral Assembly and by the authority o: the same: Section 1. That from and after thc 1st of January, 1395, all Acts, parti of Acts or Sections of the Genera Statute relating to the election duties, powers and rights of county commis? sioners be, and the same are hereby, repealed, except such special Acts, parts of Acts or Sections of the General Statutes as have heretofore conferred special powers and privi? leges upon the county commissi onere of any county, which said duties arc devolved upon the county superviso! . and county board of road commis? sioners as hereinafter provided. Section 2. There shall be an election held at next general election for State officers in the several coun? ties of the State for one county supervisor, and at every general election thereafter, whose term o? of office shall be two years, and until bis successor shall have been elected and qualified. Section 3. The county supervisor so elected shall, bet?re entering upon the duties of his office, execute a bond for the use of the county, with three or more sufficient sureties, for the faithful performance of his duties, ia the penal sum of five thousand dollars said bond to be approved in manner the same as now provided for bonds of county auditors and treasurers. Section 4. The county supervisor shall have general jurisdiction over all public highways, roads, K~idges and ferries, and over the paupers, and in all matters relating to taxes and dis? bursement of public funds for county purposes in their respective counties, and iu any other case that may be necessary for the internal improve? ment and local concerns of their respective counties ; said supervisor shall have power and authority to administer oaths to any person in reference to matters appertaining to his office. Section 5. That the Governor shall appoint, upon the recommendation of the Senator and members of the House of Representatives from the respective counties three discreet - free holders in each township in the several counties of the State, who shall be known as the township road commissioners, whose term of office shall be cotenninal with that of the Governor by whom such commission? er shall have been appointed, and until their successors are appointed and qualified. In cane of a vacancy or in case of the refusal of any person so appointed to serve as such commissioner, the Governor shall fill the same as hereinbefore provided : Provided that no person shall be re? quired to serve more than once in eveiy four years, and said commis? sioner shall, during the term of his office, be exempt from al! road and jury duty. Section 6. That all duties, powers and privileges now devolved upon the township board of assessors be, and the same are hereby, devolved upon the township board of commis? sioners, and township boards of assessors are hereby abolished. Section 7. That all the duties, pow? ers and . privileges now devolved upon county board of equalization be, and the same are hereby, devolved upon the county board of commis? sioners, and -said county board of equalization is hereby abolished. And the members of said board, while performing the duties now devolved upon the county boards' of equalization, shall receive the same compensation as such boards now receive. Section 8. That the county super? visor, together with the chairman of the township boards of commissioners j in the 6sveral township appointed by j the Governor shall constitute the j county board of commissioners, of which said board the county super- j visor shall be chairman. Section 9. That immediately after j the appointment of the several boards I of township commissioners, aud the i erection and qualification of ti county supervisors, or as soon ther after as may be practicable, the sa: supervisor shall call-a meeting of tl county board of commissioners f< the purpose of organization Ar the skid board shall meet thereaft? on the first Monday in Jannar April, July and October of each yei at the county court house for th transaction of business, and a majo ity of said board shall constitu? a quorum : Provided, that the chai man of said board may call an e: tra meeting at any time, and shall t required to do so upon the writte request of three members of th board. That at the iirst meeting < said board they shall elect one ( their number who shall be a membe of the State board of equaljzatio and who shall perform all the furn tions of said office as now provide by law. Section 10. That it shall be th duty of the county supervisor, t? gether with the chairmen of th boards of township commissioners township road commissioner, to la; off into convenient sections th roads, bridges aud ferries in th several townships in their respec tive counties, which said section shall be numbered for the purpose c letting out the same to be worker and maintained under contract. Section II. That if the count? board of commissioners conclude ti adopt the contract system for work ing, maintaining constructing an< operating the several sections o highways, roads, bridges and feme in the several townships of thei respective counties, the county supervisor, as soon as practicaba thereafter shall advertise in a news paper published in the county once ; week for three weeks and by notices posted in two or more conspicuous places in the several townships, foi bic from responsible persons foi doing the work as above set forth Aby and all bids made shall be ir writing, sealed and addressed to the county supervisor, and by him open ed and submitted to the county board of commissioners, and it shall be the duty of said board to accept the lowest bid made by a responsible person or party; Provided, that said board may iu its discretion reject any and all bids. Section 12. AVhen any bid shall have been accepted by the couuty board of commissioners they shall require the person or party whose bid, with good and sufficient sureties, shall have been accepted to enter into bond double the amount of said bid, payable to said board and their successors in office, for the usc ol county, which bond shall specify the nature of the work required, con? ditioned for the faithful performance of the same. Section 13 In case of the failure of any contractor to perform th? condi? tions of his bond the couuty board of commissioners shall declare the same forfeited, and the circuit solicitor shall enter suit in the name of said board npou said bond for the penalty thereof, and any sum of money recovered in such action shall be paid into the coun? ty treasury and become a part of the county road fund Section 14. The county board of com? missioners shall have power to remove any and all defaulting contractors and to relet the section or sections of highways, roads, bridges, or ferries so let to him to some other responsible person or party. Section 15. The county treasurers of the several counties are hereby authorized aud empowed to receive from any and all persons liable to road duty in the several counties the sum of two dollars as a commutation tax in lieu of all road duty required by law, and all money so paid shall be set apart and known as the county road fund : Provided, that said com? mutation tax be paid between the first day of November and the first day of March in each year for that fiscal year, or when State and county taxes are paid, and that the couuty treasurer shall furnish a receipt to the person so paying the same. Section 16. The county treasurer shall furnish the county supervisor a list containing the names of all per? sons who have paid their commuta tation tax, and the chairman of the township board of commissioners shall also prepare and furnish to the supervisor a list of all persons liable to road duty in their respective town? ships, and the said supervisor shall check off the names of all persons reported on the list of the county treasurer as having paid their commu? tation tax, and all persons whose names shall remain on the list so checked shall be required to perform road duty, not exceeding in the aggregate six days ; said persons shall not be required to work more than three days in any one week, and shall be assigned to such duty by the connty supervisor under one of the contractors in the township having under control the section or sections nearest the residence of such person or persons: Provided, that in those counties where the contract system ie not adopted said persons shall per-1 form the work under road overseers, to be appointed by the board of town? ship commissioners for each township, under the provisions of existing laws. Section 17. It shall be the duty ol the contractor of any section to receive such person or persons assign? ed to him under Section 16 by the county supervisor, and he shall allow to the county board of commissioners a sum of not less than fifty cents per diem for the labor of any such person or persons, and said sum shall be credited upon the amount due or to become due said contractor by the said board. Section 18. In case of the refusal of any person or persons to pay his or their commutation tax as herein pro? vided, within the time prescribed by this Act, and upon refusal to perform the road duty required by Section 1 of this Act, he shall be deemed guilty of a misdemeanor, and upon convic? tion thereof shall be fined ten dollars and costs, or imprisoned-in the county jail for "the period of twenty days : Provided, that if any person liable to road duty neglects to pay his commu? tation tax within the time prescribed by this Act, the county treasurer is hereby authorized to receive the same, with a penalty of 50 per cent, of said amount added : Provided, the same be tendered within fifteen days after the expiration of said time. Section 19. All accounts, claims an?! demands of whatever nature existing against the county for opening, constructing, maintaining and operating any public highway, road, bridge or ferry, shall be pre? sented to the county board of com? missioners duly attested, and if ap? proved by said board the county supervisor shall draw his warrant upon the county treasurer, under the seal of the county board of com? missioners for the amount of any such claim or claims, which warrant shall be countersigned by the secretary of the board, and the same shall be paid by said treasurer of the county road fund. Section 20. Any wilful neglect of duty on the part of any member of the county board of commissioners shall be deemed a misdemeanor, punishable by a fine not exceeding one hundred dollars or imprisonment not exceeding one year. Section 2i. The county board of commissioners shall, at the last term of the Court of General Sessions in each year, make a report to the presiding Judge, tobe by him sub? mitted to the grand jury, of all their actings and doings, containing an itemized statement of all amounts ordered to be paid by them, the condition of the public highways, bridges and ferries in their respective counties for the fiscal year and all matters appertaining to the same. Section 22. The members of the county board of commissioners shall have power to administer oaths to all persons appearing before them, and to punish by fine not exceeding ten dol? lars, or imprisonment in the county jail not exceeding twenty-four hours, any and all persons guilty of disorder? ly conduct amounting to an open or direct contempt or wilful interruption of their proceedings Section 23. That from and after the passage ol this Act all the courts ot this State and municipal authorities, which under existing laws have power to sentence convicts to confinement in prison with hard labor, shall sentence all able bodied male con? victs to hard labor upon the public works of the county in which said person shall have been convicted, and in the alternative to imprisonment in the county jail or State penitentiary at hard labor : Provided, That municipal authorities may sentence convicts to work upon the streets and public work of the municipality in which they have been convicted, and such couvicts when so sentenced shall work under the ^direction aud control of the municipal authority imposing sentence. Provided, That no convict whose sentence shall be for a period longer than two years shall be so sentenced Section 24. That all couvicts so sentenced shall be under the super? vision and control of the county supervisor and by him formed into a county chain-gang and required to perform hard labor upon the public highways, roads, bridges and ferries or public buildings in the county ; he shall direct the time, place and manner of labor to be performed by said chain-gang : Provided, that said chain-gang shall not be worked in connection with or near any road con? tractor or overseer. Section 25. That the county board of commissioners ahall diet and pro? vide suitable and efficient guards and appliances for the safe keeping of said convicts They shall likewise provide all necessary tools, imple? ments and road machines for perform? ing the work required of said convicts, all costs and expenses of which shall be paid out of the couuty road fund in the same manner as other charges j against said fund are paid. Section 26. That in case any con- ? viet or convicts so employed by the j county supervisor shall become ? ungovernable or unfit for the lab required of such convict or convict the said supervisor may commit sue convict or convicts to the Sta penitentiary or county jail. And shall be the duty of the superinten ent of the penitentiary, or the sheri of the county, as the case may be, I receive any such convict or convie so committed. When said chai gang is not employed, or whe convenient and practicable, they sha be confined in the county jail tor sa: Keeping under direction of said supe visor. Section 27. That the county boar of commissioners shall be authorize and required to employ a physicia or physicians whenever necessary t render medical aid to sick convict and to preserve the health of the chai gang. The fees and expenses of th same as well as for medicines pr< scribed, to be paid out of the roa fund as other claims are paid againt said funds. Section 28 The couuty board c commissioners shall have genera supervision over the paupers and th poor house and farm of the countj and the said board shall provide a nece8sarv buildings for the accommc dation of the poor of the county, wit a sufficient tillable land to giv employment to all paupers able t work, and said buildings and land shall be designated as the poor bous and farm of the county. Section 29. That said board shal be empowered to make all necessar; rules and regulations for the govern ment of the county poor house an< farm, to appoint a superintendent with such assistants as may be needed to provide means for the eraploymen as may be best suited to the inmate of the poor house, to see that ever pauper able to work is employed, an( to appoint one or more physicians t< the poor house, who shall furnisl medical aid to the indigent sick. Section 30. The county board o commissioners shall have power t< demand, sue for and receive all suet gifts, legacies, fines, forfeitures ant all other moneys or things which ma] be given or coming to the use of th< poor. Section 31. In case any poo: child or children shall be, or become chargeable to the county the county board of commissioners may bind ou any such child or children 'as ai apprentice to some person of gooc moral character until such child, if he be a male, shall arrive at the age o 16 years, and if it be a female unti she arrives at the agc of 14, or shal marry. The said board shall have power to bind out to service, undei some person of good moral character, any illegitimate child or children likely to become chargeable to the county or liable to be demoralized by the immoral conduct or evil example of their mother or other persons hav? ing them in charge, in the mannet and for the time prescribed for pauper children, and they shall have power to issue all necessary writs to enforce the provisions of this section. Section 33. Any money becoming due on any recognizances given for the maintenance of any illegitimate child or children, if such child or children shall be bound out to service, shall be paid to and received by the supervisor, to be invested and expended by him under the order of the Probate Court for the benefit of such illegitimate child. Section 34. The county board of commissioners shall have power to make all contracts in reference to supplying the poor house and inmates thereof, repairing buildings and other necessary expenses incident to the care and maintenance of said poor house and farm Where auy contract shall exceeded the sum of twenty dollars they shall advertise and receive bids for same, and shall accept the lowest bid from a respon? sible person. Section 35. All accounts,-claims demands of whatever nature against the county in reference to the poor house or farm for the maintenance and support of paupers shall be presented, duly attested, to the board of county commissioners and be by them audited, allowed or rejected, and for the amount of any claims so audited and allowed the county supervisor shall draw his warrant, under the seal of the board, upon the county treasurer, countersigned by the secretary of the board, who shall pay the same out of the pauper fund of the county. Section 36. The county board of commissioners sh all, at the last term of the Court of General Sessions in each year, make a report to the presiding judge, to be by him submitted to the grand jury, of all their actings and doings for the fiscal year, containing an itemized statement of all amounts ordered to be paid by them, with a list of inmates and the condition of the poor house, farm and inmates. Section 37. The county supervisor shall procure and adopt a seal, and when so adopted shall cause ade scription thereof, with an impression therefrom, to be filed in the office of the clerk of court and of the sheriff, treasurer and secretary of State, and the same shall thereupon be the seal of the supervisor, and all orders o other papers signed by said commis 8?oner shall be authenticated by the official seal. Section 38. Each county shall pay : 1. The fees of the grand and petit jurors while in attendance upon the Circuit Court. 2. Witnesses' fees in the State cases for actual attend? ance upon the Circuit Courts as pro? vided by law. 3. Fees of physicians and surgeons testifying as experts before the Circuit Court. 4 Fees of sheriffs and clerk of court as provided by Jaw. 5. Fees of county coroners as allowed by law. 6. Fees or salaries of trial justices and consta? bles. 7. The salaries of auditor, treasurer and couuty supervisor as provided by law. Section 39. Thal the fees allowed jurors, constables and witnesses shall be paid by the treasurers of the coun? ties, on the presentation to them pf certificates signed by the presiding judge and countersigned by the clerk of the court, or be received by him in payment of all county taxes, when duly approved by the county supervisor. Section 40. That the accounts of the corner and sheriff and supervisor and physicians' or surgeons" fees for post mortem, shall be approved by county board of commissioners, and the supervisor, on their approval, shall draw an order upon the county treasurer for the payment of the same, countersigned by the secretary of the board. Section 41. Sheriffs, deputy sheriffs, coroners and constables shall execute all legal orders to them directed by the boards herein pro? vided for or the chairman thereof and shall receive therefor the same fees and costs allowed in other cases. Section 42. That the reports of the county treasurer and other offi? cers now required by law to be made to the board of county com? missioners shall, after the passage of this Act, be made to the county supervisor, and all settlements by any of the county officers now required to be made with the board of county commissioners, or its chairman shall be made with the county supervisor. Section 43. The county board of commissioners shall prepare an estimate of the amount of money necessary to pay the expenses incurred by said boards and for ordi? nary county expenses and report the same to the Comptroller General of the State, on or before the 15th day of November of each year, to be by him submitted to the General Assem? bly in order to provide the neces? sary taxation for county purposes. Section 44. In case of the failure of the county supervisor to faithfully per? form the duties of his office or the con? ditions of his bond, it shall be the duty ot the solictor of the circuit in which such supervisor shall reside to bring an action upon the bond of said supervisor in the name of the county, and any amount realized from said suit shall be deposited in the treasury to the credit of the road fund, aud shall receive therefor such fees as the court shall designate. Section 45. That the salaries of the supervisors in the several counties shall be paid quarterly by the county treasurers but of the county funds, in the same manner as other claims against said county are paid. Section 46. That it shall be the duty of the county supervisor to cause a record to be kept of all the proceedings of the board in which he is herein made chairman, as well as a record of all contracts entered into with said boards, as provided in this Act, which said records shall be open to public inspection, and all neces? sary books and material for keeping same shall be paid for out of the ] funds herein provided for the respec- ' ti ve boaids in the same manner as other charges are paid. " Section 47. That so much of this Act as applies to the working of the public highways by the contract system and by convicts in chain gangs shall not be obligatory on such county boards of commissioners as i conclude that the present system of working the highways in their re- ! spective counties is more conducive to the welfare thereof; and in such cases overseers, as now provided by j law shall be appointed in each town-1 ship by the township board of commis-1 sioners for such townships, who shall j execute the laws now of force in reference to the working of public highways, Sections 48. That, the salary of the supervisor in the respective counties shall be as follows : In the county of Abbeville, $900 ; in the county of Aiken, $800 ; in the county of Anderson $600; in the county of Barnwell, $800 ; in the county of Beaufort, $800; in the county of Berkeley, $500 ; in the county of Charleston, $1,000 ; in the county of Chester, $800 ; in the county of Chesterfield, $400 ; in the county of Clarendon, $800; in the county of Colleton, $800 ; in the county of Darlington, $600 ; in the county of Edgefield, ?800 ; in the county of Fairfield, $650 ; in the county of Florence, $500 ; in the county of Georgetown, $750 ; in the couuty of Greenville, $6u0 ; in the county of Hampton, $600 ; in the coun? ty of Horry, $500 ; in the county of Kershaw, $600 ; in the county of Lancaster, $300 ; in the county of Laurens, $600 ; in the county of Lexington, $600 ; in the county of Marion, $800 ; in the county of Marlboro, $700 ; in the county of Newberry, $750 ; in the county of Oconee, $500 ; in the county of Orangeburg, $800; in the county of Pickens, $400 ; in the county of Richland, $800 ; in the county of of Spartanburg, $1,000 ; in the county of Sumter, $1,000 ; in the county of Union, $600 ; in the county of Williamsburg, $600 ; in the county of York, $500. Section 50. That all Acts and parts of Acts inconsistent with this Act be, and the same is hereby, re? pealed. The Laurens Sheriff in a Hole. LAURENS, S. C., Feb. 7.-It has very recently been unearthed that Sheriff McCravy of this county, is in a rather precarious status with some of the railroad authorities. In the famous Tillman railroad lock-up of a year ago Sheriff McCravy carried out to the very letter Governor Till? man's instructions in regard to the serious breach which then existed be? tween the State and the railroads. . Governor Tillman, it will be remem? bered, prided himself on the novelty and severity of his measures, and commanded all his sheriffs to lend a close ear to his instructions. The loyalty of the sheriffs now seems to be remunerated by abandon? ment. The Sheriff of Laurens County > has been sued by the Port Royal and Western Carolina Road for the recov? ery of the damage sustained in the lock up. Upon this unpleasant de? velopment the sheriff wrote the Gov? ernor to give him the support of his strong arm in this time of need, but the Governor replied that he would gladly "grant him bis moral support, but was not in a position to aid him financially. " Now, as the Governor's morals are of no commen?ai value the sheriff finds himself in an unfor tunate position. Boyal Arch Masons.
