Brcwn, son of Mr. Leonard Brown, of Bethel neighborhood, died of brain fever on the 17th inst. at 9 o'clock. He leaves a wife and four yoang children. He was buried at Bethel Church, Swimming Pens Township on Monday afternoon at4f o'clock. -??'^mm~ ? ? a? - Death by Lightning. During the heavy thunder storm on last Friday, a house situated a few miles from Sumter was struck by lightning, and two colored boys who were in the house at the time were completely prostrated from the ef fects of the same. So much so that Warren Harvin, one of the two, who was struck by the lightning, died on that afternoon. Cor oner Rhame held an inquest on the following morning and a verdict was rendered in ac cordance with the facts in the case of his death. Four other persons were in the bouse at the same time, but strange to say, not one of them was even stunned by the shock. Religions. Rev. Mr. Judd of Columbia and Rev. John Kershaw exchanged pulpits on last Sunday. Mr. Judd preached able sermons to good con gregations in tbe morning and at night. On account-of tbe indisposition of the pas tor there was no service in the Presbyterian Church last Sunday night. Railroad, near Mayesville, was burned on lastSuuday morning. The machinery was very much damaged but it is likely that tbe most of it can be overhauled and used again. The damage done by the fire will amount to several thousand dollars, and there was no insurance. At least fifty thousand feet of lumber were destroyed. Tbe origin of the fire is unknown. Early Closing. Tbe first of May is anxiously awaited by the clerks, and it is to be hoped that the stores will then be closed at ? o'clock in the evening, excepting on Saturdays. There is scarcely any business done in Sumter after tbat hour during tbe Summer months, and conse quently no loss in trade is sostai ned by our merchants by closing tbeir places of business at that hour during the Summer. Tbe cus tom has become general in every town in the State, and the recreation thus afforded to both employers and employees is of immense beoe St to them. Let this custom prevail after the first of May. What Was It? Oa one day of last week a bird fell dead in a field on the plantation of Mr. W. J. DuR&nt. This bird was about the size and shape of a goose with a bill four inches in length. It was most peculiarly marked. Its blcck head was set off by tbe two white bands which en circled its neck. Tbe back of this bird was striped with white and black feathers which were covered with small white* spots. Its breast was pore white, with wings like those of a duck. I c had short legs with large web feet which were situated very near to its tail. The tail feathers of this bird were about two inches in length. me ? * ? ? . Smithvilic Items. Sii Ithtille, S. I had nothing to do with the seating of'the audience at the play on Monday the 11th. The regular ushers wbo are young men (and not children) thoroughly understand their business, but were not engaged on that occa sion. For the last two seasons I have always been on the floor of the Hali (wbenew any performance was given) assisting in seating the audience and tbe only confusion, as well as I can remember, ever occasioned during tbat time, was by the celling of more than one ticket for the same seat, which the le served seat seller sometimes did. "Regular Attendant" has certainly borne his grievances \r. secret and wirb tbe spirit of a martyr, as no such complaint has ever been made to me by any one, and wby he should be induced to blow his born so suddenly and so .loudly through tbe press is somewhat of a mystery as he has bad ample opportuni y to have made his complaint to me personally, and did not do so. TITLE OF THE PROPOSED OR DINANCE Providing for the supply of water to the Town of Sumter, County of Suinter and State of South Carolina, and its inhabitants, au thorizing Rufus C. Barkley, of Charleston, South Carolina, and his associates, their successors or assigns who will hereafter be named in application forcharter, to con struct, operate and maintain water works ; defining their rights, privileges and powers, and giviDg said Town, of Sumter an op tion to purchase said works. Be it ordained, by the Town Council of the Toten of Sumter, of Sumter County, South Car olina : Section I.?Rufus C. Barkley and associ ates, their legal representatives or assigus be, and they are, under the conditions, obliga tions, covenants and agreements hereinafter contained, but subject to the rights of pur chase hereinafter provided for, hereby author ized and empowered to build, construct, ope rate and maintain and own water works in the town of Sumter, County of Sumter, to supply said town.and inhabitants with water for domestic and fire purposes, to jay down pipes and water mains for the purpose of con veying water, through the streets, avenues and alleys of said town, to acquire and to hold as by law authorized any and all real estate, leasements and water rights necessary to that end and purpose, to use within the present and future limits of said town, and all streets, avenues, alleys and public grounds asare now and may.hereafter be laid out while laying or repairing s&cb water works, to receive, store, conduct, purify and dis tribute water through said town, to erect and maintain settling basins, reservoirs, water towers, pump bouses and all other necessary buildings, machinery and other appliances and attachments necessary or expedient for the conducting and carrying on of such works ; to cross any stream, within the pres ent or future limits of said town, for the pur pose of laying or extending their pipes, con duits or aqueducts -as may be necessary for the proper distribution of water throughout the said town of Sumter, so as to afford the most adequate supply for domestic use, and the greater protection agairst fire, said gran tees to have the right, to maintain, establish, construct aod operate said water works as herein specified for a term of ninety-nine years from.date of the passage of this ordi nance, unless such rights shall sooner termi nate as hereinafter provided by purchase. Sec. IE?The said water works shall, be complete and perfect in all details, the ma chinery shall'consist of two separate, distinct pumping engines, made by Geo. F. Blake MTg Co., with suitable attachments, capa ble of pumping one million gallons each, in twenty-four hours, and shall be capable of so pumpic* against a head of one hundred and fifty feet. <Tbe pumps shall be arranged so that they they may be worked singly or to gether as required, furnisbinjr direct pressure. An iron or steel stacdrjipe fire feet in diame ter and eigbty-five feet high shall be erected and maintained, at a point wherein the judge ment of the grantees it will render the best and most service for fire protection. Sec. Hi ?There shall be no less than two miles of cast iron pipe laid, no main pipe to be of less internal diameter than six inches. All.of the water mains used by said grantees, their legal representatives or assign's shall be of the best quality of iron, coated inside and out, while hot, with water proof varnish, acd shall be tested at their place of manufacture before leaving the shops to withstand a hy drostatic pressure of three hundred pounds to the square inch, and shall be of ample size to carry out the provisions of their agreement, and of affording the town where such pipes are laid, first class fire protection. Said mains to be laid of sufficient depth to prevent freezing. Sec. IV.?During the progress of the work, the grantees shall not unnecessarily obstruct any streets, avenues, alleys or public grounds, and in laying their pipes and conduits they shall properly repair aod make good any gas or sewer pipes previously laid that may have to be disturbed by them, and shall complete each part of the work commenced tberejf? as speedily as practicable, and restore tbe^aid streets, avenues and alleys and public grounds without delay,- to as good condition as they were before said work commenced. Sec. V.?The said water works shall be completed to successful operatioa.on.or before January 1st, 1883. Any delaj,' 'however, caused by strikes or malicious interference or order of court, shall .work an extension of time for the loss of time so occasioned. From the completion, the said grantees agree to us'e and constantly operate the works duriug the full term and continuance of this franchise rod license. Sec. VI.?Upon the completion of said works they shall be tested as to their power and capacity; when said works shall throw water with the aid of their pumping machine ry from separate hydrants, five (5) streams at one and the same time, one stream from each hydrant, through one hundred feet of 2? inch hose and a 1 inch nozzfe, to a height-of at least fifty feet. If successful the rental for fire service herein stipulated shall begin, and the said town agrees to furnish said grantees upon said test a certificate in duplicate to that effect. Sec VII.?Upon said mains shall be placed in connection therewith forty double hydrants, all to have double delivery nozzles and to be of approved pattern and workmanship. The thread of such hydrants shall be ronde to fit any particular hose coupling now i>: use by the fire department of said town, which shall be within ten days after the acceptance of tbis ordinance, presented to said grantees by the constituted authorities of said town. Such hydrants shall be placed at such points along the said lines of pipes as may be designated by the Town Council of said town, if the said Town Council shall so designate such points within sixty days after the acceptance of this ordinance. In case the Town Council sball fail to designate the location of such hydrants within such lime, said grantees shall locate said hydrants. * Upon said pipe system there shall be placed a sufficient number of gates or valves of ap proved manufacture so as to permit shutting off the water from portions of the said system, without unnecessary interference with the general supply. The said town, at any pro per season of the year, may require the said grantees to make extensions of the pipe system of said works with hydrants placed thereon not less than 300 feet nor more than 400 feet apart, by giving 30 days written notice to said grantees. But as-a condition of making such extensions, the said town agrees to pay rent for public fire service upon such exten sions at the rate of seventy-five dollars ($75) per aunum'for each* hydrant. The said rental to be paid semi-annually, on the first days of January and July of each and every year. It is also herein provided that the town roa}- at any time if needful, cause to be placed ad ditional hydrants on the aforesaid original two miles of pipes, it being understood that the said town hereby a^ree3 to pay rent for public fire service upon such additional hy drants, as shall be placed upon the original two miles of mains, at the rate of fifty dollars j ($50) per annum for each hydrant; said reut to be paid seuii-Jinnually on the first days of January and July of each and every year. Sec. VIII.?A sufficient tax sball be levied and collected annually upon all taxable pro perty of the towo, subject by law to such tux, to meet the pay men is under this ordi nance, as they may respectively mature dur ing the existeoce of auy contract for public fire service, which tax shall be irrepealable from and after the passage of this ordinance, and in case the town shall be authorized to levy a special tax for such purpose, such tax shall be annually levied and collected, and the proceeds thereof shall be kept as a separ ate fund, and sball be irrevocably and exclu sively devoted to the payment of the hydrant rentals under this ordinance, and shall not be otherwise employed, except that any ex cess of said tax in any one year, over the amounts necessary to pay rentals for such*j ye*r. may be used for any purpose that the said Town Council shall direct. Sec. IX.?The said grantees shall charge consumers during the continuance of the fran chise granted by this ordinance, annual ratei, which shaii be collected quarterly in advance, and the said grantees shall have the right at will to supply consumers at meter rates instead of a-sessed rntes. The connections between the mains shall be made al the expense of the consumer. X.?The town of Sumter on request of said grantees, shall adopt and keep in force ordinances protecting the said grantees in the safe and unmolested enjoyment of the fran chise hereby granted, from waste of water by consumers ; against the malicious pollution of the source of water supply ; and also to carry into effect the provisions of this ordinance and tbe contract thereunder entered into. Sec. XI.?Said grantees shall have power and authority to make, adopt, and enforce regulations not inconsistent with the law, for tbeir convenience and security, as well as that of the public, in the operating of said works, and shall have the right at all reasonable hours of tbe day, to bave aceess to tbe water pipes and meters of the water takers, to pro tect themselves against abuse and fraud, and repair, observe or remove the same, and may require all water takers to sign cou tract to all reasonable regulations as a consideration to famish water. In consideration oF the benefits which will be derived by tbe said town audits inhabi tants from ihe construction and operation of tbe said water works, and asan inducement for the said grantees to enter upon the con struction of the said water works, the fran chise and license hereby granted to, and vested in them, shall remain in.full force and effect for a term of ninety-nine years, subject however to a prior termination by the right of purchase, made as in the ordinance herein after provided ; and for the same considera tion, and as the same inducement the town of Sumter hereby rents of the said grantees for tbe uses hereinafter mentioued, the hydrants hereinbefore described for and during the term of nin?^nine years from the comple tion of the saia wprks, unless said term shall be sooner terminated as herein provided. Sec. XK-.?The town of Sumter agrees to use the said hydrants for the extinguishment of fires only, and to make good to tbe said grantees any*-injury which may happen to any of said hydrants when caused by the carelessness or neglect of the town employees, and hereby agrees and promises to pay an an nual rental of fifty dollars each ior the first forty hydrants located upon the original two miles of pipes herein specified, for the term of ninety-nine years, or for such part of said ninety-nine years as said water works shall be operated under this ordinance, which ren tal the town of Sumter agrees to pay in"semi annual sums of one thousand dollars upon the first days of January and July of each year, duriog such term, to the said grantees or their order, as hereinbefore mentioned. Sec.-XIII.?The said grantees shall continu ally day and night, except in cases of extreme and unavoidable accidents, keep all ihe said hydrants supplied with water, and shall keep i said hydrants in good order and efficiency for such purpose. The Chief of the Fire Depart ment of said town, and in case of his ab sence, the officer in charge thereof, shall in spect the said hydrants from time to time, and if on inspection any of said hydrants are found to-be out of working order, he shall forwith notify the chief officer in charge of the water works in writing, specifying the hydrant .? hydrants out of working order, and said officer of the water works shall forth with repair tbe same. XIV.?In ihe event that the said grantees shall issue mortgage bonds secured by .mortgage or deed of trust upon said water works, their franchise, rental, rights and liberties, so much of the hydrant rentals pay able under the terms of this contract as will discharge tbe interest upon such bonds as shown upon such coupons thereon, as it will mature from time to time, shall be paid from time to time by the town to the trustee or trustees of such bonds ; when, and as, such hydrant rentals are payable by the said town, and such suras shall be paid so long as interest on such bonds shall remain due and unpaid, and.the Intendant is hereby author ized and instructed to sign a certificate, certi fying to the provisions oJ^tbis contract, and to affix the seal of the t?wir to such certifi cate: but the said town'sna? not be required at any time to. pay to th?'said trustee or trus tees, any greater amount than the amount due to said grantees, and all payments made to said trustee or trustees, shall be made exclu sively to pay interest on said t>onds, so long as the same remains due and unpaid; and any surplus not payable, and the whole after said bonds shall have been paid the said gran tees, shall be paid over by said town to the said grantees. Sec. XV.?This ordinance is passed under the express conditions and reservations that the town of Sumter reserves to itself the right to acquire of the said grantees, the said water works ; and all lands, and machinery, pipes, mains, hydrants, property, privileges, rights, leases, and appurtenances thereunto belong ing. And the said grantees in accepting this ordinance expressly covenant and agree, that they will sell and convey to the town of Sum ter, tbe said water works and all lands and machinery, pipes, mains, hydrants, property, privileges, rights and leases, and appurte nances belonging thereto, at the expiration of j thirty years, and at any interval of five years j iherenfter, at an appraised value of said works to be determined as follows, viz : Whenever the said town shall determine or desire to purchase said works, the town Council shall give written notice to the suid grantees, of the intention of the town to ! purchase at the expiration of the said thirty ; years, or of the interval of five years follow- ! ing such'notice. Such notice shall be?.-rved at least one year prior to the ex pi cation of said thirty .years; or of the interv/.i of five years ; and shall demand of said g- nutees to appoint and select two appraiser.*, in fixing and appraising the value of such -.valer works. | Within thirty days after the ??ate of serving said notice the said grantee, and the town i shall each select two persons as appraisers. Said five persons or a majority thereof at a ? meeting of which all of them shall have had j a personal notice, may and shall as ap- j praisers on examination and evidence, fix and i determine the value of water works and j property ofjiverv^iud ami description : ';::? ' eluding all franchises, real estate, rights of way, improvements, buildings, better ments, machinery or other appliances placed by the said grantees upon or connected with the property, and used fer the operation of said water ivorks, or which may be leased to them by the said town and constituting a part of said water works at the time such appraisement may be made. Said appraisement shall be stated in writ ing by said appraisers, in duplicate to the said grantees or to the chief officer in charge of the said water works in Sumler, und shall file the other with the Town Clerk of said town within te? days after same is made. And the town of Sumter shall have the right within thirty days, to exercise the option to take the said waterworks and all property, rigbtsand appurtenances connected therewith, or in any manner appertaining thereto, at the amount so fixed ; which purchase money shall be payable to the grantees ; such pay ment to be made within twelve months from the time s?id to\tn shall elect to purchase. - In case the town shall after such appraise ment, fail or refuse to purchase, it shall pay the expense of such appraisement. Sec. XVI.?Before the placing of ~ater mains and pip?s on a street, of said town, not having an established grade, the grade of said street shall be established by the said town, and in the event said town neglects to establish said grade, end the water mains or pipes on that account have tobe rela?d, the town shall bear the expense of changing such mains and pipes. Mains to run from Dingle, on Main Street, to Warren?with extension, to va cant lot north of residence of Judge Fraser, from Warren to Washineton St., from War ren, oo Washington to Bartlette Street, from corner Church and Liberty to corner Magno lia and Liberty Streets, corner Liberty and Church to Btanding Street on Camden road. Sec XVII?Each and every ordinance or portion of the same, heretofore made by the said town, in any way interfering or couflict iog with the provisions of this ordinance, is hereby repealed and annulled. ' Sec XVIII.?The Intendant and Clerk of the town of Sumter, are hereby authorized to execute duplicate copies with the seal of the town of Sumter, and shall deliver one of the said copies so signed and sealed in behalf of the town to said grantees, aud accept the other when signed and sealed by them in be half ofsaid town of Somter. Sec. XIX.?The terms and conditions of this contract shall apply to and be binding upon the heirs, administrators and assigns of the grantees. Sec. XX.?This ordinance shall take effect and be in force from and after its passage and publication. Sec XXI.?Work on said water works plant is to be commenced within sixty days of the passage of this ordinance. Sec XXII.?The town to have the right without charge to use water from the hy drants, within the fire limits for use of town for watering streets, viz: from Caldwell to Republican streets, on Main Street, and from Sumter to Harvin Streets, on Liberty Street, between the hours of 6 and 8 o'clock A.
