AN ORDINANCE \ To Regulate Licenses Within the Limits of the Town of Kings tS. C., for the Year A. D., 1921, and to Provide for the Collection of the Same. Be it ordained by the Mayor and Aldermen of the Town of Kinffsrtee, S. C., in Council assembled and by the authority of the same: ? ?n-n/1 in Ar Section l: mat every person, mm, ur wijwiouuu cugu6?u ??, ? .*? tending to engage in any trade, business, occupation or profession hereinafter mentioned in the Town cf Kir.gstree. S. C., shall on or before the 15th day of January, A. IX, 1921, obtain a iicense therefor in the manner hereinafter provided. Section 2: That every person, firm, or corporation commencing or engaging in any such trade, business, or occupation in tire Town of Kingstree, S. C., after the" 15th day of January, A. D. 1921, shall in like manner obtain the license therefor before entering upon or engaging is such trade, business, occupation, or profession. Section That every person, firm or, corporation required by this Ordinance to obtain the license to carry on or engage in any trade, business, occupation, or profession, shall at the time of applying for such license make a statement and file same with the Clerk and Treasurer of said Town, setting forth: (1) his, her or its name and style, and in the case of a firm, the name of the several members constituting the said firm; (2) the trade, business, occupation or profession for which the license is required; and (3) the place where such trade, business, occupation or profession is to be conducted or carried on. * * * 1 1 ? ?~ ^ TAttm oUnll fliovo. Section 4: mat tne v^ier* ana ireasurcr UI iXUU 1VVTI1 kMUMi Witvi V upon issue to such applicant the proper license as required and provided for in this Ordinance, the amount of said license having first been paid when such application is. made for the license for a trade, occupaton, business or profession, established, carried on or engaged in at the time of such, application. Provided, that nothing herein contained shall in any way affect any other requirement of the law elsewhere enacted in regard to any such trade, business, occupation, or profession. Section 5: That if any person, firm, or corporation shall carry on or engage in or conduct any tadc, business, or occupation or porfession for wliich a license is required by this Ordinance, without first obtaining a license therefor^ herein required, the caid person, firm or corporation shall be liable for the said license required^ and in addition thereto shall be subject for each offense to a penalty of fltteen per cent (15%) of the amount of such license, which license and penalty shall be recovered aa hereinafter provided; and if any person, firm, or corporation, shall refuse or neglecct to make out and deliver to the said Cloik and Treasurer, on or before the 15th day of January, A. D. 1921, the statement hereinbefore required, the said Clerk and Treasurer shall proceed to ascertain as nearly as possible the trade, business, occupation, or profession of such person, firm, or corporation, and upon the information thus acquired, he is hereby empowered and instructed to issue the license - nwiwnM snrVi nerson. firm, or corporation, having i- 1V\JU4?VU MIIU j/ftVWkavvM w t r ^ r first collected the amount of the license required, together with the aforesaid penalty of fifteen per cent(15%) of the amount thereof herein imposed. Section 6: That if the said license tax and penalty shall not be paid within fifteen (15) days after the Clerk's ascertainment herein provided for, the said Clerk and Treasurer shall issue his proper execution* to the Town Policeman for the collection of the same, and the said Policeman shall thereupon ^id thereunder proc-jcd to collect the said tax license and penalty, by distress and 6ale, or by levy and sale, in the same manner as is now provided by law for the collection of taxes, together with a further penalty of ten per cent <10%) of the entire amount due for which said execution may be issued. Provided, that in lieu of the remedy herein given, suit may be brought in the name of the Town of Kmgstree, S. C. in any court of competent jurisdiction for the recovery of the said liceure tax, and the penalties thereon. Provided further that the remedies provided for in this section for the collection of the said licenese taxes shall not in anaywise interfere with, alter, affect nor restrict any other provision or provisions of this ordinance, or any other ordinance of the Town of Kingstree, S. C.. prviding for and prescribing the punishment of offenders against this ordinance, or any part thereof, on account of the non-payment of the said license taxes hereinafter prescribed and provided for, and hereby imposed and required. Section 7: That if any person, firm, or corporation shall enter upon, engage in, exercise or carry o:. any trade, business occupation or profession for the exercising of, engaging in, entering upon, carrying on or doing of x which a license is hereby required, without first obtaining or taking cut such license as in that behalf is hereby required, such person, firm, or corporation shall for each offense be subject to, and liable for a fine of not more than rtwxo. ruiiorc /1 oo ooi nor 1a?s than Ono Dollar <$1,001 or bv imnri sonment for not more than thirty days and not less than five days, in the discretion of the Mayor before whom the case shall be tried, and each day for which 01 during which such trade, business, occupation or profession shall be engaged .n, carried on, or conducted without the license therefor, and the payment of the license tax 'herein proscribed and provided for, shall be deemed and taken for a separate and distinct offense. Provided the Council in its judgmecnt may extend the time for the payment on the 1 incense tax in a proper case, and upon due application. And provided further that no fractional part of any license shall be granted. No conviction under the provision of this section shall entitle any person, firm, or corporation so convicted to thereafter enter upon, engage in, carry on or conduct, or exercise such trade, business, occupation or profession without paying the license tax and oDtaining the proper license therein required for such trade, business, occupation or profession. Section 8: That each and every license applied for and issued under the provision of this Ordinance shall be non-transferable, and shall be applied for, issued and granted with the express understanding and condition that should said license for any reason be revoked, annulled, or cancelled, or should such trade, business, occupation or profession, for the conducting or carrying on or exercising of which such license may have been granted under this Ordinance, be interfered with, restricted or prohibited by any authority paramont to the Town Council of Kinkstree, S. C., then and in such case ana event the said Town of Kingstree, S. C. shall not be liable to the said license, or thjse claimirg under him, her, or it or them, for any damage arising from such revocation or cancelation or interference with, restraint or prohibition of such trade, business, occupation or profession, or the license therefor granted under the provisions of this Ordinance. section 9: Thi.t all license granted and issued pursuant to and under the provision of this Ordinance shall oontinue in full force and effect until the 31st day of December, A. Section 10: That the license charge or fee for any trade, business, occupation, or profession not herein after named, enumerated, and specified shall be determined and prescribed for by the Council at any regular meeting or special meeting called for that purpose. Section 11: That the following sums and amounts shall be paid to the Clerk and Treasurer ?f the Town of Kingstree, S.
