That every p-ison, tirm or corporation required by this ordinance i?* obtain a license to carry on or engag** in any trade, business, occupation or; rofession for which a license therefor is ti -reoy required shall, at the time of applying for such license,make a -tatemen; a:.d file the sam.- with the Clerk and Treasurer of said Town, setting forth; |l) lib.her or its name and style, a.id in case of & firm, the names of the sevial inembeis constituting such ttiu;; <2) the trade, business, occupation >7 prole-sion for which a license i> required. and 13) the place where such trade, business, occupation or nrofessi n i- to b; conducted or carried on. Section 4. That the Cierk and Treasurer of the said Town shall thereupon is-ue to such applicant the proper license as required and provided for in this erdinauce, the amount of said li-1 cense having nrst Deen paia, on or oefi re the day named in the first section herco! when such application is made lor a license for a trade, bc?iness, occupation or profession established, carried on and engaged in at the time of such application. Provided, thatnothi ng herein contained shal I in any manner affect any other requirements of law eisewhere enacted iu regard to any trade, business, occupation or prcfess ionSection 5. That if any person, firm or corporation shall carry on .engage in or conduct any trade, business, occupation or profession for which a license is required by this ordinance, without first obtaining and taking out a license therefor,as is hereby required, the said penton, firm or corporation shall be liable for the license required,and in addition thereto shall be subject for each offense to apeualty of fifteen percent zifcivi nf amount of auch license. which license, and penalty shall be recovered as hereinafter provided; and if any person, tirra or corporation shall re-fuse or neglect to make out and deliver to the said Clerk and Treasurer, on or before the first day of March. Section 6 1 hat if the -aid license tax and penalty shall not be paid within fifteen (15) days aft-r the Cleik's ascertainment a- hereinbefore pi ovided for.the said Clerk and Treasurer shall issue his proper execution to the Town: policemen for the collection <?f thes ime j and the said Town policemen shall! thereupon and thereunder proceed to c-ilect the said licen-e tax and penalty l?y di-tress and sale. or by levy and sale, in the -atne manner as is now ] provided by law for the collection of taxes,together with ten per cent tlOo10 of the whole amount for which said ex- j eeution may be is-ued. Provided, further, ?h ?t the remedies provided for in this section for the collection of said license taxes and the powers and authority j herein and hereby iixed, esiablished and delegated for the collec;ionof-aid license taxes shall n>t in anywise in-; terfert* with, atTect or re-frict any other provision or provisions of this ' ordinance or any other ordinance or ordinances of said Town of Kingstree,! S C. providing for and regulating a punishment of offenders against this j ordiuance on account of non-pat ment of the license taxes hereinafter named and nruv ded for and hereby required, i Section 7. If any person, firm or cor-1 l>orution shall engage in, exercise or carry on any trade,business, occupation | or profession for the exercising, en- i paging in,carrying on or doing of which j a license therefor is required by thi< ordinance, without first taking out suchli-1 cerise as in that behalf is hereby required, sucn person.firm or corporation shall for each and every offense be subject to a line ??f not more than One Hundred Dollars ($100.00) or imprisonment of not more than thirty (30) days, or both, in ? the discretion of the Mayor before whom the case shall be tried, and each day that such trade, business, occupation or profession -hall be carried on or conducted without the license therefor and the pa>ment of the license tax as herein provided for, shall be deemed and taken to be a -eparate and distinct otTense. Provided, the Council in its ^ judgment ntay extend the time for the .Li payment of the said license tax, and provided further that r.o fractional part of a ileense be granted. Put no conviction under this section shall be held to entitle any such person, firm or corporation to thereafter exercise, conduct. carry on or engage in such trade. busiiiess,occupation or profession without first paying the license tax herein required for such trade, business, occupation or profession. section 8.
