Contrary to general expectation when the case of the State against Ex Lieut Governor James H Tillman charged with the murder of Narciso G Gonzales, editor of the Shite newspaper, on January 15, 1903, was called before the court at Lexington C H last Monday there was uo motion for a further continuance ^ and both the counsel for the prose- 1 cution and for the defence an- 9 nounced themselves as being ready * to proceed with the trial. 3 Following is the report of th? 2 trial taken From the Florence Daily ? Times: * MONDAY. 3 The examination of witnesses iu:^ the Tillman trial began this afternoon, the drawing of the jury hav-L ing been completed in the morning, j It consists of George II Koon, fore-j _ man, foi nier county supervisor and I ~ farmer; Jacob E Savior, merchant 8 and farmer; Irvii. ' u Policeman George E Poland told ^ of the anc6t of Tillman and the ^ finding of the second pistol in his ^ ]>ersonal armory. The pistol and ^ bullets were put in evidence. The fact that Tillman said that lie j( wanted to be assured of protection ^ before he gave up his pistol was made a point by the defense. The v question of the location of the pock- p et< in Tillman's ,overcoat was very n much discussed, this coat and all ^ of the clothes of the dead man were put in evidence. After a legal fight James A Hoyt Jr., Louis G Wood ; ^ and M C Wallace, of the State, were; ^ put up to testify as to the clothes.; j A file of the State from April to! September of the year in which the j killing occurred was also introduced, after another legal tilt. Judge Gary's rulings throughout j seem to be fair and impartial and o strict. j 'J Col Tillman's wife and mother ,11 were with him in court. His plea t 'not guilty" was made in a strong, Ja fclear voice. 11 i] TUESDAY. v I?xi56ro>v September 29:?Con- a ?ATTE The Sales giv< will put GOOD -IKING You Will receive 3 has advanced. < anxious for the W load, we guarante hard work we'll 11 the best arranged vantage and the 1 that yOu will find watchman On dul to see you very sO ^HKin vVe are your frien HERE ARE A FEW SALE R. Judge Gary admitted the stateaent "I am killed" as a link towards llmvincr the introduction of the dv ? e j ug declaration. The dying declar? * O tion, itself, has not yet been offered. Linbroze E Gonzales was presented o offer the files of the State in evience. The defense traced with Mr ionzales this spat between Gonales and Tillman and their con ten tjns. He could not recall that his rother had abused Tillman, but whatever his brother said of Tillman ,as printed in his newspaper. The ditorials he said expressed all lie rearded as denunciatory of Tillman. ?he editorials gave all he knew of rhat his brother said of Tillman. His brother wrote much more ban he talked. James A Hoyt, assistant editor of the newspaper, was put on the witness staud, and when he was about to give the ante-mortem statement of Gonzales defendant's attorneys obiected, and a long exhaustive legal ! argument was entered upon as to whethei it should be admitted. The question was whether Gonzales had , any hope of recovery after he was shot; if so his ante-mortem statement could not be admitted as evidence. The lawyers argued at great length whether from the testimony the deI ceased had hope or not. All attorneys on either side made arguments and finally Judge Gary said that the declaration of the deceased made to Associate Editor Hoyt was entitled to be admitted as testimony. As the examination of the witness would likely take up much time, a j recess was taken until three o'clock. All the buyers are now on the tobacco market at Lake (Jit v. Unfor' tunately for their* hopes they were caught m the act and the little I - scjiciiiu 11 usuttiru. The present apology for a jail, rickety, old and rotten, is a howling farce and if a prisoner wauts to get out it requires but little effort to make his escape. Either the old ' building should be torn down and replaced by a new one, or the cells < fitted with staunch and solid steel cages that would resist the frequent attempts at escape of the prisoner^ confined in the jail. There are now seven prisoners in jail and but for ' tne ninety discovery 01 men iutention most of them would undoubtedly have failed to respond to their names at the roll-call Wednes- i day morning.
