Their duties and powers as a Board of Health are defined by the follow ing section of an Act amending the Charter of the Town of Darluigton, approved December 2(1, 1884. _ Sec. 2*>. That the said Mayor and Aldermen shall have power to abate the nuisances within the incorporate limits of said town, and also to ap point a Board of Health for said town ! and to pass such ordinances as may he necessary to deline the power and duties of the said Board of Health, and to impose a tine of not more than twenty-five dollars upon any person who shall refuse to serve upon the said Board of Health; and it is ex pressly provided herein that upon the failure of any person in possession of laud within the corporate limits of said town to cleanse the privies or water-closets or remove any other nuisance from the premise in his pos session or under his control when so directed to do by either the Mayor and aldermen or the Board of Health, it shall he made the duty of said May or and Aldermen to cause their mar shals or other employees to enter the premises in question and abate the said nuisance at the expense of the said person in possession of said prem ises; and It any person shall interfere with the marshal or other employees of said town, he shall be adjudged, upon proof to convict, guilty of a misdemeanor, for which he may he tried before the said Mayor and Aider- men and sentenced to pay a fine of not more than one hundred dollars or be imprisoned for not more than thir ty days; and if person in jiossession of said premises, when the expense for cleaning the same shall be demanded of him, shall refuse to pay the same, he shall he adjudged guilty of a vio lation of tile town ordinances, and may be tried before the said Mayor and Aldermen, and upon conviction may be adjudged to pay a fine of not more than twenty-five dollars or im prisonment for not more than twenty tto-y*- r,.
