In refusing the captain's resignation the Southern gave him a year's virea tion with the choice of re-entering the railway service at the end of tbat tirm or of going into something else just e he might elect. The most remarkable thing cOn neeted with the case is that the Su preine court on the re-argument re versed itself and sustained the ruling of tLe court below. This is worthy of note and a credit to Messrs. Johnstone & Welch and the ability with which they presented the case, when it is re memnbered that out of at least fifty pe Stitions annually asking a re-argument pessibly this is the only case in twenty ive years where the re-argumfent amounited to mre than a formal mat ter. In this case the petition was t jgranted, the re-argument had, and the jformer opinion reversed and the vic tory won by Messrs.
