The lawyers, however, lavo m1aiagedt to woakon it inl many plrticuliarF, until it star.ds today but a noro mass of verbiage, with no lo fial Support, savo that given it by tho idimiiiistratiam olicers. It is to nock this prop from under the law hat action was institiltted in the Unitled States circuit court to. ]ay. The papers in the case woro filed by Mr. J. P. K. Bryan, who has much experienco in fighting the law. The cast) is brought by W. 11. Vand ircock & Co., of San Francisco, Cal., and Constables S. W. Vance, W. N. Bahr, J. N. Scott, W. Livingston, C. S. Moseley, M. Potorman aid others are mado parties to the Snuit. The plaintiff's bill of- complaintis quite a longhty ono and deals fully with the particulars of the soveral seizures of their liquor by the con stables during the past months, with which the public is familiar. It states that the Vandorcock company has suifered to the extet of $5,000 already and that wit h t lie other ship ments of liquor now on the way here, they will sustain a loss of $10, (001, shonld these shipments be also seizmd by the constibles as they th renit In. The com plaint assorts the rights of the pliniitill' to ship liquor into the Slate for direct salos, stor ago aid waihiomsing aild states that the seizuro and coifiseition of this liiqtior by the constables is uiwar raited and that, so nmich of the dis penisalry its autthorizes ioso acts is inl conflict wiLh Ihe Coistitution and laws of -1ho United States, anld thore fore null n1111d void. The plainat iff prays relief of the coirt from t.hese iinterferenices with interstate coinmierco and damages to their t.radol and1 business. It. asks for an imnjnnctioin rest raining the con stables from seizi ng its liquor and also dlesires to b)e roimbu)irsed for the damages (lono. Upon reading the hilt of complaint and the accompanying allidavits set ting forth the facts - in the caso, Judge Siimointoni signedl the follow ing order which 'nasn given to the marshal's dlepari.mn t to be served: The United States of America, Dis trict of South Carolina-in the Circuit Court, Fourth District. WV. A. Vandercock company, a cor poration created under and by the lawsn of the State of California, complainants, against S. W. Vance, W. N. Blahr, J. M. Scott, WV. Livingston, C. S. Moseley, ii. Ptrman, citizens amnd residents of the State~ of Sonth Carolina, de fendants. On hearing and filing the bill of complaint herein, and on motion of Bryan & Bryan, contplainaant's solic itors, it is Ordered, Th1at the defendantsB show cause before this court on Monday, May 17th, 1897, at 10) a. m. or as noon thereafter as counsel can b)o heardl at Charleston, S. C., why the injunction as prayed in the hill should not, issue. CARanus H. SiMoN-roN, 3r-d May, 1897. Circuit Judge. It has been known all along that the Vandercock coimpany was mak. ing preparations for such action. Mr. Bryan was engaged several weeks ago to r-ecover the eam load of liquor which had been peized, or its value, and to) secure such protection for the company's' shipments as might be necessary. The Staito has refused to surrender the liqluor to its various consigneos, and has thrown every impediment in the wvay of the company's trade. The case will come up before Judge Simnont.on on the 1 7th~, as the order shows, and a battle royal may be expectel. A decision for the plaintiff would probably b)0 the plac ing of the lost screw in the cofila of the dispensary law. Wha t4 l" Ca18tora11 JS Dr., 81amu11e Pitelleti and h lildren.
