FORMER BANKER INDICTED. J. II. Carter, cf AsherlHe, H-Hrged with Misappropriating $100,000. Greensboro, N. C, December 7.?An Indictment against John H. Carter, former president of the American Na tional Bank, of Ashevllle, charging the misappropriation of funds approx. (mating $100,000 during a period of seven months, was returned by a Fed eral grand Jury here today. There are 64 separate and specific counts. The indicted banker is widely known us a promter of banks and other insti tutions in the South Atlantic States. In twenty-one of the counts return ed Carter is charged with misappropri ation of the funds of the American National Bank of Ashevllle, by draw ing exchange drafts on the Institu tion's New York correspondents. These drafts, It is charged, were made payable to himself nnd the funds were not placed in the Ashevllle bank. Oth er counts charge false entries to cover the alleged defalcations, false reports to the Comptroller of the Currency and large overdrawals of his person al account. All of the alleged defalcations for which the Indictment today was re turned are said to have been commit ted during a period between Decem ber 27, 1909 and August, 1910. Carter tendered his resignation as president of the bank In September, 1910. Since that time, It is said, he has made resti tution to the directors approximating $40,000 of the alleged misappropria tions. Admission was made by govern ment representatives who conducted the investigation on which the Indict ment was returned, that Carter's al leged shortage had boon known for some time, but that It had been fully covered by the directors of the bank. It also was stated that the banks condition now was satisfactory. The indicted banker organized sev eral banks In North Georgia and North Carolina. Ho was Interested in a number of Atlanta enterprises and Is said to have lost heavily by the failure some time ago of the Florida Home Insurance Company, of which he was an official. Carter came to Ashevllle from Geor. gia in 190") and organized a national bank, which later was merged with another institution into tho American National Bank, with Carter as presi dent. Judge James E. Boyd. today order ed the case transferred to Ashevllle for trial. It Is probable that the trial will be held In May, 191.1. FAIRBANKS PRAISES MARSHALL. "Has Been' and "Going ?? B?" Side by Side at Banquet. Chicago, December 7.?Vice Presl dent-elect Thomas R. Marshall and former Vice President Fairbanks sat together at a banquet of Indlanians, who live In Chicago. Mr. Fairbanks, In a speech, referred jocularly to the recent Democratic victory and later paid a high tribute to Vice President elect Marshall. "You would not recognize the old State now were you to return to the haunts once so familiar to you," he said. "Where there once was light and faith you will find the wreck and ruin of a noble party; gloom fills the air; our fair fields are overcast with doubt and despair; the sons of unrighteous ness, through one of those inscrutable dispensations of an overruling Prov idence, have captured the citadel of your fathers and now hold high carni val in the seats of the mighty." Later In hs speech Mr. Farbanks sad: "It Is a matter for congratulation if we leave partisan politics aside; a difficult matter I grant you?for poli tics and literature are innate with us. It Is a matter for congratulation, I say, that the next Vice President of the United States is to be one worthy of high distinction.
