PLAINTIFF 01VEN $3,500 DAMAGES. Drowning of Luther Fianks in Reservoir of Cotton Oil Company Cause o'f Damage Suit. An important and probably the most interesting case for this term of court in Laurens was the suit for $25,000 damages instituted by Mr. R. J, Franks, administrator, against the Southern Cotton Oil Company. A ver dict was reached Wednesday afternoon of $3,600 for the plaintiff. The action was for recovery of dam ages on account of the death of little Luther Franks, caused by drowning in the reservoir of the mill on April 20th, 1906. It seems that the oil mill com* patiy has this reservoir on its premises in the city and that there is no fence around it nor any protection against children going there or even going bath ing in the water. Little Luther Franks was only seven and a half years old, and at the time he met bis death was hang ing over the water by the supply pipe allowing the water to run down upon his feet; presumably, he lost his bold and fell into the reservoir and was drowned. It was a custom of the mill boys to go to the reservoir to bathe, and to do as young Luther Franks did. The question, as it appeared for the jury, was whether or not the boy was of sufficient age and intelligence to know the risk and danger of his act, and whether or not the mill was guilty of negligence in having such a reser voir in such a place and unprotected. The arguments in the case were un usually strong and Judge Gage's charge to the jury was especially clear in deal ing with all points of the law. To the Cotton Planters: 1 have received so many letters en dorsing my efforts for a reduction in acreage from nearly every section of the South that I have decided to con tinue the work and by request write another article on similar lines that will be carried by the southern weekly papers all during this month so that every planter will have a chance to read it. Cotton for October delivery sold this week af oighl cents per pound. Can you produce it at a profit at this price? No. Then in order to get a profit on what you raise this season you must plant less than you intended planting at first. Reports on the acre age issued so far show that the acreage will hi; about 1 per cent, larger than last year. This is probably due to the new farmers that have settled in Okla homa and west Texas putting in so much new land. We must more than offset this increase by reducing in the rest of the belt. I again state that the main cause for the decline in prices is lack of confi dence caused by the fear of a large acreage which means, with good weather con lit ions, a large crop and even lower prices than at present. Do you want to grow a crop at an actual loss? If not reduce your acreage; then if your neighbor persists in planting a large acreage and you have to sell your crop at a loss you lose less than he. If by reducing you add $300,000,000 to the wealth of the South you will not only receive a part of this but you can feel that you did your part to add to the prosperity of the country. It Is good business to plant a crop where there is no profit in it? No. Then let every reader at once plant part of his present acreage intended for cotton in some feed crop or let the land lie idle one season as you can get more money for the crop grown on the part you do cultivate. If you have it already planted do not work it out as it will be labor thrown away. Which do you prefer to plant your present acreage and get from 7 to 8 Cents per pound or reduce it and get 11 to 12 cents and possibly higher? The present contemplated acreage and good weather means a return to the old days of cheap cotton of ten years ago while a reduced acreage means a continuance of the prosperity of the past few years. Let every planter that reads this sd once make up his mind that he will not be the cause of Wall Street Bears fix ing the price for your crop as they will do with a large crop. Go to work at once to reduce your own acreage and see as many of your neighbors as possi ble at once and get a united action in this matter as this is the only way we can be independent and pros|>erous. I again urge the members of the Farmers Union and Southern Cotton Association to work together for a re duction in acreage which means much higher prices for the balance of this crop and all of the next one, as well as an influence on future crops. Mr. Furmnn Martin, who has been quite sick for some time, is much Im proved and able to be out now. The ML Gallagher school will close within about two weeks.
