And he is now and for some time has been pretending to exercise the powers and performing the functions of the office of governor aforesaid. He has been pretending to send messages as such governor to the General Assembly of Kentucky and has pretended to appoint defendant, John B. Castleman, as adjutant general of Kentucky, and to invest him with power and control over the military of said State, and the defendant, Castleman, is now claiming and pretending to be such adjutant general of said State. Plaintiff says that by reason of the aforesaid acts of defendants herein great confusion has been prodused and is now existing in the State of Kentucky, and plaintiff is beinggreatly hamper ed and interfered with in the performance of his duties as governor of the said State. I'he Senate met today without a quorum and adjourned until to morrow In the liou-c the Senate resolution calling upon Governor Taylor to withdraw the militia from the capitol and surrender the executive office to Governor Beckham was adopted after some debate, the feature of which was a speech by Representative Km raett Orr, taking exception to the clause of the resolution asserting that the shot which killed Governor Goebel was fired from the executive building. The house then adjourned until tomorrow. NO FEDERAL JURISDICTION. Cincinnati, February 14.- Holding that the Federal courts had no jurisdiction in the contests in Kentucky Judge Taft this after noon refused to grant the appli cation for injunctions against the Kentucky State board of elections and the Democratic contest ants for State offices other than governor and lieutenant governor. The case can go ultimatelv to the United States Supreme Court. The decision says unusual care was given the court's delibera tion, owing to "the importance of the interests involved and the outrageous character of the electoral frauds under the forms of law which the bill charges that the State contest board is about to consummate."
