The trial . of the parties who J waylaid and assaulted and robbed Messrs. Frank Shaver and Robert 1). Ilagins on the night of Sept. lGthj as they were on their way homy from Lancaster, elicited a| keen interest, on the part of the pdblic?more than any case that has been tried in this court in a long tftne. The Court House was " crowded to its utmost capacity during the trial, and so great was the interest to those who heard t he case that the Entbrpkisk thought it woujd be interesting to our numerous'readers who did not f hear the trial. Hence we give a succinct synopsis of the testi .mony. It covers all the points IT * developed in the case. . The first two witnesses lor the State were the victims ot the murderous robbers being tried. They were, of course, eye wit liessesto the diabolical deed and each told a straight lorward story, and when they were done, every body was convinced of the guilt of two of the defendants, Ferrand Thaney Clinton, and of the probable^guilt of Wash Clinton. Other testimony soon showed that Wash Clinton was also guilty beyond a reasonable doubt. It. D. Hagins testified as follows: Ferr, Thaney and Wash Clinton followed me the evening of September 16, and tried to beat me out of drink of liquor. That night as we (Frank Shaver and myself) were going homo Ferr and the two Clinton negroes came un in front, of no nnrt If nnnlfo/t ma iff ray mule and knocked Frank Shaver down. Don't know which one struck me, but Ferr ran his hands into my pockets and rob bed me. Ferr appeared to wai 4 to rob me that evening in rear i the Farmers' Hanking <fc Mercan tile Co. They stole my money, $3.15, my pocket book and my gloves in which I fired an engine. They came out from the side of the road. Had part of a quart of liquor with me. (Exhibited the cut in his forehead to jury). When I came to, I found Richard MCManuR and some of his folks there. Broke my arm when they knocked me off the mule. Ferr came up in Dr. Poor's office that night aftef my wound? were dressed, ar.d I told the jailer to arrest him.- Upon cross examination he said he came to town about noon. These people were following me. We took a drink together. Frank and I never drank any after we left town.| Left town about dark. Richard McMatius testitied: was on my way home from tow Saw a mule standing in the roai When 1 got to the mule I saw man standing on a bridge. I heai a noise. 1 walked up to the ma on the bridge and he said he!l< I said hello. It was Mr. Ilagin bloody and groaning. I saw ni other man a little further on. T1 other man (Frank Shaver) wi lying down. I helped him up. li could not stand up, was blood and bleeding. My son-inla came up in a few moments, brought Iiaginn back to town t. a mule. Left town for how about dark. Stopped at. Ed Sa< dler's long enough to pull ofl' chew of tobacco, and then wei on. Took me about 15 minutes i get down to Jacob's hollow. W . M. Moore testified: I wei to my father's house alter suppe about a quarter from the hollo\ I knew Mr. Ilagins. lie came my lather's house inquiring f< me; no one with him. lie wi beaten and bruised up badly, took him to my ofliee at depi and tried to phone to his peep at Elgin. Then brought him ti to I>r I'oore's office. Went Jacob's hollow with the Sheri and got Frank Shaver. lie r cognized me, and wanted to kno if the doctor was there. The impression in the track corresponded exactly with the piece of glass in the shoe. Uriah Jordan testified : That he was at livery stable when constable passed taking Thaney Clinton to jail. 10 or 15 minutes afterward he saw Will Rice pick up a glove in front of stable. He identified the glove as the one put in evidence in this case, which was the glove identified by Hagins as his. Will Rice corrobora ted this statement. So did Frank ho wry. Here the State rested, and the defence began. \o:ih Robertson tostifiorl lw saw Tlianey Clinton about the time dispensary closed. F. B. Porter testified: Saw Tlianey that evening about same time near (lying jenny. 1 I,. S. Elliott testified that the dispensary closed at 6:15 on the evening of the 16th of September before sunset. Tlianey Clinton went upon the stand and denied any knowledge of the robbery. Wash Clinton also denied it, of course. John Green,attorney forTbaney Clinton, argued the case and was followed by Solicitor Henry. Mr. Green plead earnestly for the acquittal of Tlianey Clinton, but the Solicitor insisted upon the conviction of all three of them. His honor. Judge Buchanan, then charged the jury ?u(l turned the case over to them. They were in the iurv room iiist, 1ft minutes, when they tiled out and the clerk read the verdit, k,Guilty." The .Judge then passed sentence upon tlmm He took occasion to administer to them (especially Kerr) a severe reprimand. He sentenced Kerr to 10 years at hard labor in the State penitentiary. and the two negroes to 8 years each. The following are the names of the jurors who sat upon this case: \V. 11. It.
