D A Miistake of the Lawyers. . i The South Carolina Bar Association has had three annual meetings; at the -- first meeting the annual address was S delivered by the Hon. John F. Dillon, of New York; at the second by Judge lJ Thomas M. Cooley, of Micdigan; at i the third by Mr. Joel Prentiss Bishop, le of Massaohusetts. e1 At the last annual meeting printed 18 copies of the address of Judge Cooley 0 were distributed among the members. i The title page of this pamphlet reads: ft "The Influence of Habits and Thought o upon our Institutions. Second An, ai nual Address, delivered before the t .South Carolina Bar Association by the 1 Hon. Thomas M. Cooley, of AnaI Arbor, Michigan." Judge Cooley will be surprised to learn that he has delivered two annual addresses before the Association. A Statesmanilko Document. Judge Cooley's address before the Bar Association in December, 1886, is g a profound and statesmanlike docu- N ment. It ought to be read and in wardly digested by every man who apprehends any danger of being here after sent to. the Legislature. It ought u to be read, too, by every intelligent J. voter. In a masterly way Judge in Cooley demonstrates the importance of 7 preserving constitutional guarantees. ; The address was most opportune, in b view of now almost universal tendon- d cy, both on the part of the legislature J. and the people, to ignore the limita- f tions of the constitution, however per- m fectly they may have stood the test of time, Speaking of the taxing power, which Chief Justice Marshall with inimitable faecllity of phrase, called "a . power to destroy," Judge Cooley says: di -.....-'#.MA~ . uosoo ?m -eney ripen inta a right, and the barest assumptiouiWE - ay the foundalIon for a mnos& solid ai@d g permanent huthorIty." in And, again, in another connection, spe!'ng of the duty ofjtho law-maker: n<4 "It is the duty of each delegate to ~ make himself acquainted with the to the merits of all proposed legIslation, co and to take the advice and hlave tihe benefit of tihe jutdgmenlt of his associ- an ates upon it. Hie is then to apply Is -11 Own judgment to the question of its ea adoption. No member of the delibera- W< tive body canl delegate tile law-making function to another person, evenl "j though that othler person be liis asso ciate; but 110 in person must assume A< the responsibility." "Finally," says tihe learned author, thl "thle habit of mind which consents to the doing of constitutional wrong, * when it is supposed some temporary in good may be accomplished, should be recognized as a foe to constitutional nlu limitations and securities, and which, I therefore, at an~y cost, must be cor- C. rected." ** * "Especially should every insidious charge whlich threatens to creep in b)y usurpatleon of authority be mfet at tile Y thlreshold and be sturdily resisted. And such chIango wvill owe its accoln'b plishment either to general ignorance es among tile people regarding the funi- b( damental principles of government, or to general indifference. In either case it would be evidence of a condition of things whichl would render thle public mind fallow ground for tihe seeding of wild speculatIon and fanciful experi ment, especially for thlat wildest of nationls, that whatever is ne0w isproba bly progressive and shlould, tihereforo, i for its very novelty, be welcod and w embraced." thi Judge Cooley closes hlis admirable b) address with a patriotic appeal to the lawyers to stand up for the Constitu- sa tion. "The legal pirofession of the mI 7~~ country," lae says, "stand at the por - tale of the future, chlarged with the d duty of protectinlg the Constitutions, re national and State, under Whlich they re exercise their fenotions as mianistors of m~ justice, and which constitute at once is the defence of individual liberty and the guarantee of public order. It is a 1U solemn and very onerous duty,. and requires for its performance a carefhl and conscientious study of the emer- ut genoles of governulont as from time to *time they .arise." The address is a 4' timely noto'of warning to a generation that has takett private property for private purposes; a generation that JI thi'ongh the "police po,er" has as samed at-bitrary yower ver corporate wealth; .a generatilp' ,which the s( legisatur hasabanon finotions, anld embracedo the paeiniples of "local di Qption" and "local taxation;" a gen oratiot which has clothed itself in a' iodleeely itinn 1' a: t e b,lnitb, ~$ I Ip *bl6lngthat Sn 000abI ithi "whIch .t calle the public d I3 8'v p,: toWor d for tie, Z4 or pec Ian0 hlblatls rns, and Eu n d rely cures Piles, or no a red.
