There were several othi per'sons inu the house besides the de. 3-ceased and flue prisoner, anid afte: talking together for a short time during which the piirties seemed to bc perfectly friendly towards each other Glover and Jenining~s began to banltel each other for a trial of their strengti and activity in a wrestle or scuffle George Glover asked the defendan -to go out into the yard, and at thn --same time started1 ont himself. Th( defenldant followed him, and- as h<t came outof the door, saw Glover witi --an axe upheld in his hands. Tihe do. fendant stooped dowvn, picked up 1h00 near at hand, and attempted t( -strike downi the axe held by Glover, The stroke of the hoe failed' to dis place the axe in Glover's hanids, and fell with such force upon tihe head _of Gilover as to Inflict a mortal WOundU -from which lie died the next morn lng. From the .evidence, it ,appeared that thiere was no malice or ill-will ox. istlingi the mlind of the defendant to. wvards the unfortunate lover. Mr. -Buchanan made a. brief argument Ir the prisonier's behalf, in which she di1 himself much credit. This was Mr Buchanan's first ap pearance as an ad. vocate, having but recently been td, mitted to the bar, and we COngratulat< _- him upon his zeal and eni'nestnedui -lHe was followved by Col. RIon, wh< argued the case with his accustornoic -force. After an elaborate charge froni -his Honor,.the jmuy retired, and, ii about ten minutes brought in a ver diet of "Not guilty." The next case called was that of th State vs. Andrew Gadsden, fadictei for grand larceny. Mr. ;Mackey ap peared for the defentdant.' Ketchin, who went to Columbia and Identified the accused. Mr. Mackey argued inl behalf of the defend ant, and was followed by the Solicitor for theI Staite. HIs Iionor charged the jury upon the law relating to the case, and after being out for more than an hour they brought in a verdict of i (ljy, with a recomeniiedation to the mercy of the Court. Mr. Mockey then imade a imotion for a new trial, but after argiiment, his Ilon1or refused to grant the imotion. Jose)li Ciiapian, indicted for ap sault and batterywith intent to ravish, pleaded guilty. The lastcase trIed was thatof the State vs. George Moore, indicted for grand larceny. Moore wias indicted at the last terni of the court for stealing a cow froim William Dunlap, but was not covvicted. The present case arose out of the same facts. After a short deliberation the jury returined a ver dict, of "Not guilty." The prisoner was represented by Mr. A. M. Mack 'y. Upon the rendi ion of I he verdict, JuIdige Mackey said: "George 'Moore, you canl go. There wZas some inisuiiderstanding between Mr. Clarke, the at torney for tle prisoners, an(d Trial Justice E lkin, as to the regu larity ofthe defendants' appeal. The pris oners were conimitted to jail and made application for bail on a writ of hibes corpus. lastOc tober before Trial Justic es Neil and Robertson. At this time a written not ice of appeal was served on Trial Justice Elkin. Justices Neil anid Robertson refused the discharge, and the prislers then applied to Judge Mac key for release on bail. His Honor dischar 'ged then on their recognizance to appear at the preselit term of the Court of Genieral Sessions. The case now came up on the appeal from the sentence of Justice Elkin. After hear ing colsideral argument i upon difl'or ent, points, Judge Mackey called for the original finding of the jury in the Trial JuIsticeCs's court. The verdict of juiry was in the following words: "We find William Christer not guilty, the other defendaits guilty, but recon nended to mercy." This finding was written on the warrant issued in the case of Jeff J. Posey, one of the other defecndtanits. Jutdge Maickey ruled that this vei'dict could not affct any of the def'endants-holding that the verdict in the case of each defendant should be writtlea on the several warrants sepa rately. Up)on this~ showing, his H Ionor held that the sentenices p~assed byv Trial Justice Elkin must be set a lde iTe question next arose as to Iwhatdispositioii should( be made of lhe cases. The defendants' counsel made the point that the prisoniers mnust he dischanrged absolutely, and that to lbe tr ied again they must be re-arrested, and all proceedings had anew. ..The Solicitor resisted -this pr1opositionl, holding that the defenidanits wore still in the custody of (lie Court, and that the case must be remnanded to the Trial IJustice for a new trial. The .Judge Rustained the Solicitor's view, and an ordeir was accordingingly passed, requiring the dlefendants to appear for trial before Justice Elkin at Winnsboro on the second day of March. The pi'isoners convicted during the term were brought into. Court, and sentenced as follows:. IScipio Cohen, convicted of assault and bat tory with init'ent to murder, six months at hard labor in the peniten -tiary. Andrew Gadsdon, convicted of grand larcony, a fine of ilve dollars and costs, or three months imnpr'ison ment in the couiity jail. Joseph Chapman, who pleaded guil ty of assault and battery with attempt to ravish, four months at hard labor in the penlitentiary'. The grand~ jury made their final presentment for the term, and were discharged. The presentment will be p~ublishled horeaf'ter. The Court of. General Sessions was then adjourned sine die, andl the Court of Common Pleas was opened.
