' COURT OP SESSIONS. Adjourns After Being In SeMlon Two Days. The court of general sessions ad journed Tuesday afternoon after be- in# in session less than two days. The case against FTftik Tucker, charged with murder, wai continued, as were several minor cases. Solici tor Sease and Judge Gary left for their homes Tuesday aliernoon. Zeb Ferguson was put on trial charged with assault upon the per 1 son of J. F. Wtestmoreland. Wtest- mpreland testified that Ferguson oame to his store in the West End and cursed bis wife, claiming that he had sent his little daughter to the store the day before and that she (Mrs. Westmoreland) had cheated her out of twenty cents. That Mr. Westmoreland went out on the pizza and told Ferguson to leave when Ferguson threw a rock at him and that Wlestmoreland threw a hatchet breaking Ferguson’s leg. Westmore land showed by the testimony of several witnesses that Ferguson was the aggressor. Ferguson pleaded self defense, claiming that he was acting In self defense and that he was justi- fled in doing as he did. G. W. Speer. Esq., who represented Ferguson, made a very Ingenous ar gument fo'f his client, alleging sell defense in justification of the action of his client. Solicitor Sease. in his usual vigorous manner, made a strong presentation of the State's case, tak ing the position that Ferguson could not claim self defense inasmuah as Ferguson brought about the difficulty. The jury rendered a verdict of as sault and battery of a high and aggra vated nature in two cases and Fer guson was given a sentence of ten months on the public works of the county. Josephine Robinson and Dee Mor gan, white, were then put on trial for breaking a lock and entering a house belonging to Sam Lipscomb, colored, with intent to steal cotton therefrom. Both defendants denied that they went into- the house but testified that they saw Ellas Jackson and his wife do the breaking. The jury did not believe them and they were found guilty and Josephine Rob inson was sentenced to one year in the penitentiary and Dee Morgan six months. , j Solicitor Sease called the attention of the court to the fact that the gov ernor had referred to him the report of the county investigating com-; mittee. At the suggestion of the soli- 1 citor the court instructed the grand jury to appoint a committee to inves tigate the Irregularities reported by the committee and that the committee could examine the officers who are charged with the irregularities if they so desired, and that the committee submit its report to the grand jury ai the next term of court. The following is the report of the grand jury. State of South Carolina, County of Cherokee. To His Honor, Ernest Gary, presiding judge; We, the grand jury, hereby make this our panel presentment for this term of court: We have passed upon all bills handed us by the solicitor and return-1 ed same. We have appointed committees to examine and make reports at the next session of court on county, parish, jail, chalngang, also a com-; mittee to examine papers handed us by the solicitor to examine the re- port made by the Investigating Com-! mittee of the different offices of the county. The supervisor reports to us that he has built a road on either side o£ the Southern Railway, connecting the Iron bridge road and Stacy terry road, and has asked the railroad company td build a bridge across cut, to connect \the two ends of said road, they at one time having agreed to do so, but now refuse. He recommended that the railroad company be required to build said bridge, as same Is very necessary. Wte recommend that a shed or wood house be built at the jail for the use of the sheriff.
