WILL FORECLOSE DELETTRE FARM There was a reference hearing ; before W. L. Bryan, acting as special master, last Thursday, in the case of the Bank of Little River, Plaintiff against U. M. DeLettre, for the foreclosure of a mortgage of real 1 estate, the farm that stands in LeLettre's name, about four miles from Conway. DeLettre lived on this place un- 1 til about one year ago he moved 1 a-wav to tho Stilts * 1 --v -- ? "I uvui ^ ia, HI1U ' now lives near Waycross in that ' State. The mortgage on which the suit ' has been brought is for the security ( of a note in the sum of $1,500.00. The note and the mortgage are 1 both made from U. M. DeLetter to 1 W. Percy Hard wick and bear^ the ] date in March 1 i> 17, at a time when Hardwick? was doing business in < one of the Jenkins stores on the 1 Southward side of Third Avenue, < and L. W. Cooper was in the mer- ] eantile business in another of the s stores next door. When the suit was brought, De- { Lettre tiled answer to the complaint j in which he alleges that he did not ^ give these papers for the purpose of j securing any debt to W. Percy Hard- j wicke; that if he signed them at j all it was as he thought for the N purpose of witnessing an instru- i ment. He alleges ir^substance that ^ if he ever signed ann delivered this f note and mortgage that he was i i fooled into signing them by Hard- c wicke telling him that they were { something else and that his name j was only needed as a witness to j them. DeLetter is a half brother y of Hardwick. j DeLetter also said that Hardwick would not record this mortgage; that he kept the interest paid ^ on said mortgage at the Bank of > Little River until some time in 1920 when Hardwick left this place and moved away to Charleston, and from there to ^ome other place no- t body knows where. j This was the nature of the issup ( when the time came last Thursday f for a hearing on the matter. DeLettre was not present, his attor ney spying that he had written V stating that he had been sick for t two weeks and was unable to travel. The master continued the hearing un- I til a later date so that DeLetter may ^ come and testify, after he recovers. \ The Peoples Bank holds a first mortgage for $1,500.00. * The trial priceeded so far as to examine two witnesses. The wit- \ nesses to the mortgage are W. Mack ' Moore and Clarence Long. Mr. Moore was placed on the stand by the plaintiff and he testified that * ho saw DeLetter execute the note ^ and mortgage on the date mentioned ' and that the mortgage had been ' probated by L. \V. The testimony taken down from the two witnesses waa as follows: W. Mack Moore being duly sworn says: 1 signed the paper as a subscribing witness. As I recall Percy Hard wick was in one of 'the Jenkins Brick Stores. He 011 one side and Mr. Cooper on the other. Percy said to DeLetter, 'I have that paper ready I want you to sign.' DeLettre went over and signed the paper, i tlo not know whether he read it, but he signed it and I was asked to witness his signature and did 'so witn clarence L.ong. Mr. Cooper probated it. I do not think Mr. Cooper was in the store. Cross Examination: I was not informed a?> to what :he paper was. I was asked to witness its execution and did so. DeLett re was working around there nt the time. Hauling cotton ana >ther things at the time was what ie was engaged in. I know nothing >f the debts between the parties. Mr. H. E. Thompson being duly worn says: I am cashier of the Bank of Litle River. The Bank owns the I)e.ettre note and mortgage sued on. ['he Bank's books show that the Sank became the owner of these pa>ers by discount * on April 11th, 917. The face of the paper is due vith interest from September, 1020. | was not cashier of the Bank at the i inie, but this paper was turned >ver to me with other papers when he bank was audited and 1 was made cashier. This was in 1920. The liscount ledger shows that this pa)er was discounted for $1,500. Percy -lardwick has no balance at this >ank.
