AN ACT TO PROVIDE THAT HORRY COUNTY SHALL ISSUE ONE HUNDRED THOUSAND DOLLARS IN HONDA FOR PERMANENT HIGHWAY IMPROVEMENT UPON THE SAME BEING APPROVED BY THE QUALIFIED ELECTORS OF SAID COUNTY, AND TO CREATE A IIKJIIWAY COMMISSION FOR SAID COUNTY. Section 1 Ho it enacted by the General Assembly of the State of South Carolina, That Horry County I shall ibsuo one hundred thousand dollars in registered or coupon bonds for permanent highway improvement. Said bonds shall be of the denomination of one thousand dollars each and shall draw interest at the rate of not more than five per cent, per annum, payable on the lirst day of January and July of each year. Bonds. Sec 2. That said bonds shall be signed by the County Supervisor and attested by the Clerk of the County Board (<f Commissioners and delivered 10 the public highway com- j mission hereinafter provided for. ! The lithographing of the names of the said officers upon the coupons, if coupo? bonds are issued, shall be deemed the signing thereof, but the bonds themselves shall be signed by the said cflioers personally. When sold, the cflicial seal of the County Board of Commissioners shall be affixed, and no bond shall be valid until said seal is affixed. Said bonds shall all bear the same date and shall be numbered consecutively as issued, from No 1 upwards; and a record of same by number shall be kept in the office of the County Supervisor and the disposition of same recorded therein When any such bond shall have been redeemed or paid, it shall be mutilated and filed in the Supervisor's office, and the fact recorded in the book above provided. To Whom Delivered. ^ Sec. 3. After said bonds have been signed and recorded in the Supervisor's office as above pro/ided, the same shall be delivered by the Supervisor to the public highway commission herein provided for. The said public highway commission shall also keep a record of said bonds by number consecutively, and the dispositions of same, in a.book kept for that purpose. Special Tax Levy. Src. 4 One-half of said bonds shall become due and payable not more than twenty years from the date of issue, and the other half shall become due and payable not more than thirty years from date of issue. For the purpose of paying interest on said bonds and of creating a sinking fund with which toredeem same at their maturity, there shall be levied each year a two mill tax. It shall be the duty of the County Treasurer to collect said tax, keeping a separate and accurate account of same, and upon application by the Treasurer of said commission to turn the same over to him as collected, whose receipt shall be a sufficient discharge of the County Treasurer for the amount or amounts so paid. O I U UU^VIllVO due and also to redeem the bonds themselves as they fall due out of the moneys so turned over by the County Treasurer. If, at any time, said commission shall have any moneys undisposed of on hand for uuy purpose, they shall invest the same safely and securely or deposit the same in seme reliable and safe bank or banks at as high a rate of interest as it can obtain. It shall in no case be the duty of the purchaser or purchasers of any of said bonds to see that the funds are properly expended. Said bonds shall be exempt from State, county, school wo r\o ' io vn tion V i uiu moipui kU4iuviwu, Public Highway Commission. Sec. 5 The public highway commission shall be composed of three citizens of the County of Horry, to be appointed and commissioned by the Governor on the recommendation of the Senator and members nf the^l I onse r?f Representatives of said county, and no members thereof shall hold any public office except that of notary public. One of said commissioners shall reside in the town of Conway, one on the east side of the Waccamaw river and one outside of the town of Conway and west or north of the Waccamaw river. Officers Thereof. Sec C>, Said commission shall, as soon as convenient after appointment and commission, elect one of their number to act as ohairmun and treasurer, and another to act as socretary. The one elected to I act as chairman and treasurer shall Hra|||yf* receive the sum of five dollar per day, and the other two the sum of three dollars per day, for not exexceeding fifty days in any oue year. The chairman and treasurer shall give bond in some approved surety company to the county in the sum of t( n th usand dollar-, conditioned for the faithful performance of his duty, the cist of which shall be paid by the commission out of the funds herein provided. The commission herein provided for shall be appointed as soon as convenient after tin election herein provided for. Term of OiTice. Sec 8 The said commission shall have power and authority, and it shall be its duty to lay out, survey, change, alter, open aud make public highways in eiorry county, and for any rf said purposes it is hereby given full power and authority: Provided that the County Supervisor shall be ex oltioio a member of said board, and have a vote thereon upon all questions of improving tLie highways in the county under consideration. Should there be a tie vote upon any such questions, then it shall bi the duly of the Cierk of the Court of said county to cast the deciding vote, which shall be final. Right of Way to be Given. Sec. 0. Said commission shall not at any time or place expend any money upon any highway unless the parties ^whose property toucn or abut upon said highway shall, without expense or cost to the county, convey in writing all easements and rights of way necessary over and along same: Provided, This restriction shall not interfere with the right of the commission to improve any portions of said highway that do not touch or abut upon the property owner refusing to give the right of way. The commission shall have full power to employ competent engineer or engineers, contractors or overseers, wdo shall be paid such compensation, as the commission may fix, out of funds herein provided. Said commission shall tile with the County Supervisor four times each year quarterly a full statement of their receipts and disbursements. How Funds Expended. Sec. 10. Said commission shall expend the funds arising from the sale . of the bonds dividing the same among the different townships of the county in proportion to the assessed values in said township; Provided, That due consideration shall be 1/iven to the mileage and condi tion of the various roads of the respective townships in the discretion of said commissioners. Penalty for Drawing Fictitious Orders Sec. 11. The drawing of any fictitious or fraudulent orders or the expenditure of any of the said funds for any purposes except as herein provided shall be a breach of trust, and upon conviction the party so offending shall be fined or imprisoned, or both, at the discretion of the court. Election. Sec. 12. The above bonds shall not be issued and nothiug shall be done towards their issue until the same have been approved by a majority of the qualified electors of said county voting at a special election to be held for this purpose on the second Tuesday in November, 11)10 The Commissioners of Election for said coun t.y shall appoint the managers and receive and tabulate the votes as in other elec tions. They shall make their report in writing in duplicate, one copy to be filed with the Clerk of Court for Horry County, and the other with Secretary of State, and said duplicate copy shall be kept on perpetual record in both of said offices. The managers of election shall serve without any compensation; and the managers appointed shall have the power and authority to appoint substitute managers to act in their stead. Tha County Board of Commissioners of said county are authorized and required to furnish to the Election Commissioners of said county, in ample time before said election, a sufficient number of Ballots for and against said bond issue. On one sot of the ballots shall be printed t.hft wnrils "Pnr Public Ilii/h wa3* Improvement Bauds," and on the other set shall bo printed the words, "Against Public Highway Improvement Bands;" and the said commissioners are authorz^dl to pay the expenses of said printing out of the general county funds. In all other respects, said election shall be held as other elections, under the general laws as are consistent j with this Act.
