The building is a complete ruin, and was the property of Col D. A. Spivey. on which there was no insurance. Several parties lost suits and Alston, the proprietor, lost his tools and a few other things. It was indeed a fortunate tiling for Conway that there was no wind < and that the tire occurred at a time ; when it did, else another story would ha\e been written. Jan 27 Special: What will p ove a test, case as to whether or not G, C. Bi^ham, the Murrell lulel man, convicted of complicity in the killing of his wife, can be arrested, came up today when habeascorpus proceedings were instituted by Attorney llaj/sdale for the release of W B Avant, who is now in the Penitentiary. Solicitor Wells was tit anted five days in which to tile his answer to the writ. The position taken bv the attorneys for A van t is t hat, A ;ant. not, bo in prison because, as claimed fciuoe, Judge Watts issued the order admitting the prisoner to bail and Solicitor Wells was in court, and, therefore, accepted the notice of up peal. Solicitor Walls' position is that ho did not waive the filing of formal notice of appeal in the case, and that since the appeal has not been perfected Avant is rightly in j.iil ami Bighorn is sut)j< ct to arrest. It will bo recalled that when Avant was arrested and Dr B.gham left Georgetown the impression was that Bigharn had lied it is true ho did remove himself from the danger of immediate arrest, but if the Avant habeas-corpus proceedings should fail he will now bo subject to arrest. There was some doubt before that he cou.d bo legally arrested. If Avant is freed under the habeaseorpus proceedings then either the appeal will bo formally dismissed o. the ciso will bo heard on ic merits in the September court. The young wife of G. C. B'gham was killed last September by a shot from a gun in the hands of W B Avant. The two incu were together at the time, and both were found guilty of manslaughter, and each was sentenced to serve three years mid six months in the Penitentiary. The killing was never fully explain*d, and while many people took the Gew that it was a cold blooded marJer the jury believed that no malice tiad been showu. Mr and Mrs Chtstnut were away from home at tho time, Mr Chestnut, being at work at a ncar-oy saw-mill while Mrs Chestnut had gone to a near-by neighbor's. Tho smoke arising from ihe doomed building was discovered by some oi neighbors who gave the alarm and in a few minutes there were several people at the pl;ce, but only iu time to save a part of the household furniture.
