McNabb was suing to get back his three children from Mr and Mrs llardee, lie having deliverod the three children to Mr and Mrs Hardee, their grand parents one year ago at tin; death of Mr McNabb's wife. The order of Judge Shi pp was substantially as follows: State, of South Carolina, (*oii 11 t.y of I lorry. Court of Common Pleas Kx Parte, Stanley M. McNabb, in Uehalf of (ieorgo Morton McNabb, Grace McNabb, and Mable McNabb, Minors. oilmen. Stanley M, McNabb is seeking by j pnlition for a writ of Habeas Corpus to recover from A. L Hardee and Mollie, llardee, his three children, George Morton McNabb, Grace McNabb and Mabel McNabb, infants, now in possession of the said Hardens. On the Kith of May I issued the writ, direeled to A. L. and Moll;e llardee repairing .them to produce said infants before me at (Jonwav, S O., on the 2(ilh day of May A. I). It'OH, The petition alleged that said infants were restrained of their liberty by the said respondents without right, and that petitioner is the fat her of said infants and is a householder and freeholder in the county of Horry and is fully competent and able to care for and educate those children, and that the residence of respondents is not a lit place for the rearing of said children. Respondents made due re turn uriore mo at the tune mentionod denying that said infants were illegally restrained and alleged that res|>ondents were grand parents of said infants, the mother of said infants bein;; the daughter of said respondents, and that said children were delivered into their custody hy the petitioner at the request of his wife, the mother of said children, on the day of her death or shortly thereafter; that he gave said children to respondents the two female infants absolutely, but reserved the right to call for the said male infant., George Morion McNabb at 1 some future time; that respondents h id in good faith taken said infants ' under their care and custody, relyf in?/on said a?/reenw?nt. and hart ?Vr*r?i I the death of their mother tenderly > reared and nurtured thorniand that although said gift was by parol, yet ' by reason of the promises, gift and / delivery of-said children to respond cuts, the petitioner is estopped from 3 questioning the right of respondents f to the custody of those children; re~ spondents further denied the allega1 tions contained in the petition sug gesting that their homo is an unfit plaee for the tearing of the children. y Several ntlldavits were filed by respondents in support of thoir roV turn and petitioner also tiled allii davits in reply. I ain satisfied that the respondents are worthy people and that by reason of their "relationd ship to said children and their atrs tochenont to them, the children C would be well and tenderly cared or by them and th.kt they are able
