Tillman and think some of bis utterances are unwise and imprudent. He is an executive oflicer whose duty is to see all law properly enforced. The construction of law belongs to the Judiciary and after the interpretation and construction of law, the Governor cannot bo too positive in its enforcement. In the matter of the Evans Dispensary law we think the Governor transcended his prerogative in the declaration that the law should bo enforced des- j pite the courts. If the courts sus tain tho constitutionality of the law then the whole resources of the State are at his command to put the law iuto practical operation. We think tho News atul Courier and The /State are wrong in their efforts to create a public sentiment adverse to to tho law.^Tho law is experiment al in this country though one of somewhat similar nature has been in successful operation in Sweden for several years. Tho effects have been beneficial in reducing drunkenness in that country and why not, give the law a practical test in South Carolina. Nobody seems specially concerned about the operations of the law except tho bar-keepers. It is true their capital invested in intoxicating liquors will be idle, unless they choose to invest it in industries whose products would be more profitable to the general public. Other people should have consideration as well as the bar keepers they were not specially concerned about tho destruction of capital when they were unconscionably appropriating the hard earnings of poor women and children to gratify tho depraved appetites of some of their customers. They were willing to sacrifice women and children tipo? the altar of the Moloch of strong dring, so long as they could make money out of the transaction, hut now me mw steps in ana commands them to stop their unholy business and they are almost ready to begin a rebellion, Cet the courts 'construe the law, determine its constitutionality and then we are satisfied, if con stitutioual, the Governor will rigidly enforce it. We desire to see the law practically tested and feel satis tied drinking intoxicants will be con siderably restricted. The North Carolina legislature met the first Monday in January and has gone to work as if it meant to v > something of practical benefit to the people. In anticipation of the repeal by Congress of the 10 per cent tax ou State bank issue, a bill has been introduced providing for and regti lating the issue of notes by State banks. With proper safe guards to protect thd holders of these notes and secure their redemption, this plan, in our judgment, will afford all the relief to our present financial depres sion that can be obtained under existing national laws. We hope Congress will soon modify existing tar iffs so as to give some relief in that way also. We take from the Wilmington Messenger^ The following synopsis of the bill introduced in the Senate by Senator Sherrill, of Catawba, entitled an Act to "Authorize State Hanks to Issue Notes." it U an open secret that Treasurer Tate drew the bill. It provides that any bank or banking association now chartered or which may be chartered bv the State and doing business within the State matissue circulating notes payable on demand in lawful money ef the United States, under the limitation con1 ?. tained in the act, to an amount not! exceeding the paid tip-cash capital of such bank. To secure the payment of these circulating notes North Carolina 1 per cent, or (5 per cent, bonds shall be deposited with the State Treasurer in amount equal tc the circulating notes to be issued to any such bank. The bonds to deposited shall be held exclusively for the so-: entity of toe circulating notes until the latter are redeemed; but any bank may return any part of its cir-' culating notes for cancellation and withdraw ratably the deposited col lateral. Upon t be deposit being made the State Treasurer will issue to the bank circulating notes in blank, registered and countersigned, equal in amoun' to the par value of bonds deposited. No bank shall issue post notes or any other notes to circulate \ as money than such as are authori ' zed by this act. The circulating notes shall l?o printed from plates engraved in the best manner, to guard against counterfeiting, etc., and be in $1, $10, 20, and $50, as may be required, and on their face , it shall be satted that they are secured by Slate bonds deposited in the Stale Treasury. The plates and dies are to remain under the entire control of the State Treasurer. The expenses are lo hi- paid out of the taxes or duties collected on the notes afore said, t'pon a bank's failure to pay these notes, at its place of business the holder may have the same pro tested and presented to the State Treasurer for redemption, and then, after giving notice to such defaulting bank, the Treasurer may advertise that ho will sell by public auction so much of the collateral in his hands as is applicable to the payment of such dishonored notes and out of the proceeds of such sale redeem the same. To further secure the notes the stockholders of the hank issuing them shill he liable for their paymotif t??>i uouMint o/???o 1 4.. The tax to he paid by the hanks upon such eir ulating notes! shall bo upon their receipt of one half of of one per cent upon the! amount of notes delivered, and then, | the same tax semi-annually upon the! amount of notes outstanding. Neith or the State Treasurer nor any one in his office shall own any slock or other interest in any bank issuing such notes. ? ? -cIIai> our deform Legislature pas ! sed a bill endorsing lite Ten Com mandments, certain papers and politicians in this State would have taken the other side. The strongest endorsement the Command mcnts can receive is their observance and we hope the legislature was not derelict in this particular in their private lives whatever was their le gislativo action.
