The & cases have been set for the term of >3 court which commences on the 4th k Monday in that county. Attorney 4 General Lyon has received a letter ^ from the clerk of the United States $ supreme court saying that the case ^ of Pink Franklin against the State ^ of South Carolina would very likely k be calledthe latter part of March. f If the Franklin case is not called & before the 4th Monday in March f the trial at Chester will have to be ^ postponed, as it would be impossi- J ble for Attorney General Lyon to o, attend to both, and the argument in 5 the Franklin case cannot be put off. $ The Franklin case is a most in- c teresting one, and has been in the ^ courts for several years. 4. Attorney General Lyon cannot ^ now make a definite statement as to <s whether the ti;al at'Chester will be f postponed or not. He will continue his preparations just as if the cases >2 !11 1 11 ? J ^ win uc taucu. Pink Frankln and his wife. Sad k P'ranklin were tried in Orangeburg Jcounty in 1907 on the charge of f killing Henry E. Valentine. The de- y fendant. Sad P'ranklin, was acquitt- x ed. Pink P'ranklin was found guilty e7 and sentenced to be hanged on Oc- i tober 25 1907. An appeal was taken ^ to supreme court. The opinion of k the supreme court was that the d judgement of the circuit court be $ affirmed and a new day of execution k was ordered. ^ The attorneys tor P'ranklin then x asked for a writ of error from the X decision of the supreme court. No- -=^c tice was given that the case would be appealed to the United States ni supreme court, a id the South Caro- Ul lina supreme ordered that the writ be issued.
