Thla deduc tion, therefore, relates to quantity not to ve/n*; and hence, whenever quantity ami value are not the same, for the purpose of ascertaining the duties, toe deduction must be made with reference to the former. But a# the quantity and value under a regular ad valorem duty, bear n uniform relation to each other, they have no doubt been con founded In the custom-house calculations befbro the adoption of the tariff of 1828, which fixes what may be termed a dutiable value on these goods, not Iti any uniform pro portion to the real value but In classes; and hence the propriety ot looking Into the ori* gin of the cpstom as an unerring guide or an uniform regulation. This was done in framing the recent instruction, the charac ter of which admits ot an caw illustration. Suppose for example that the deduction is to be made from the value. A merchant who imports broad cloth at t\to dollars per yaad, must pay at the rate (say) of 40per cent on 12 50, which is the dutiable value fixed by law ui such cloths. If a deduction of Ave per cent on 02 be made, the price will be f 1 90, but the law imposes the same duty U|H>n cloth at 51 90 that it does upon cloth at 81. Hence'the importer could derive no benefit from the deduction, unless the value of the cloth should be above the mini mum point, and within five per rent, of it; whereby it would4ic thrown from a hi gbcr to a lower class, and if from the 5"- 50 to the *1 clsss, the deduction, would be, not five per cent, but 6< per cent j a most extraordi nary result to be produced under color of an allowance for the shrink of cloth from the manufacturer's measurement. It is clear, therefore, that the al lowance for measurement ought not to be nude In calculating the value. But let us rest the deduction from the quantity (as di rected inthelnstructioo,) in the same way. A merchant imports 100 yards of cloth at IV the deduction of five per cent, being made, duty is charged on 94 yards, and at whatever price it msy be invoiced or valued by the appraiser. The allowance being made from the quantity will be uniform, and operate alike upon every importation of that description. The importer will thus not depend upon any contingency whatever, for his right to have the duties charged up on the actual number of yards imported: equal and exact justice will be done in all cases, and in strict conformity with the principle of the usage that authorises the allowance. It was ascertained at the traasnry that different rules were Observed as to this de duction In the principal importing cities, and It was of tho utmost consequence, not only that the rule should be just, but that it should be uniform.
