States District Court in Charleston, which resulted in a compromise of $11,000 for the Collettfn Cotton Mills. The suit was entered by the Colleton Cotton Mills to recover a loss sustained bv reason of the fail -i ure of a New York firm. Garner & Co., to carry out its contract to pur chase the product of the mill. It appears that a contract had been en tered into with this company when the price of cloth etc, was good Soon the panic of 1907 came on, and the company then refused to pur chase further from the mill.' Suit was entered to recover $16,000 the amount of the damages alleged in the complaint. At the call of the before Judge Brawley argument was made by the counsel for the de fendant company to have Judge Brawley pam upon the merits of the Plaintiffs counsel held that it was a jury case, and when the Judge decided it was, an offer of a promise verdict was made. Finally $11,000 waa agreed upon, which has been .paid. Hie mill feels justly proud of this settlement, as it is a vindication of the produet of the mOl. If the de> company could have shown that the product of the mill was not up to the contract, it would have been very easy to have broken the contract. The.
