VOl'MAN'S* TH1K1) KFFORT FAILS. Allendale Slayer Still Out of State Hospital. Columbia, Aug. 6.?Richard Youmans, of Allendale, who shot and killed his brother-in-law, John Dunbar, in Allendale, July r>, yesterday failed in his third attempt to get into either the state hospital or the state penitentiary. Youmans, who is being held in the Barnwell county jail pending trial, is apparently suffering from some mental derangement and the Barnwell authorities do not wish to keep him in the county jail. Sheriff L. C. Bennett brought You mans to Columbia last Friday when efforts were made to have him placed in the state hospital for treatment and examination as to his sanity, but in the absence of court orders and committment papers admission could not be granted. Sheriff Bennett then attempted to have Youmans placed in the penitentiary and again the absence of court orders forbade admission. The prisoner was then carried back to Barnwell. Sheriff Bennett again brought the prisoner to Columbia asking that he be admitted to one of the two state institutions. Governor Cooper held a hearing yesterday morning in connection with the case, deciding that he did not have the authority tc commit Youmans to either the state hospital or the penitentiary. The second attempt to have Youmans placed in the state hospital was when his attorney appeared before Judge ui viaugcuuis, ctsiMiii; IUI order committing the prisoner to the state hospitl. Judge Bowman declined to grant the order and James Patterson, attorney for Youmans, left Columbia with his client for Charleston yesterday to appear before Judge Memminger in another effort to secure the commitment order. Youmans developed symptoms of apparent mental derangement about two weeks after he shot Dunbar and when he was in Columbia Friday he spent the greatest portion of his spare time singing, his two favorites being "In the Sweet By and By," and "Go Forth and Face Your Lover." He is now said to think he is chasing rabbits. JUDGE ANNULS MARRIAGE. Divorced Man, It Is Alleged, Had No Right to Wed. Spartanburg, Aug. 6.?The marriage of A. Lee and Miss Alice Cat- ' lett, which occurred at Anderson May 10,. 1904, was annulled by a decree . signed and filed yesterday by Judge Thomas S. Sease, the grounds being that Lee had a wife living at the time of the marriage. The ceremony was performed by a minister. Miss Catlett's complaint to the , court follows: "1. W. B. Hawkins at Anderson, S. C., that the plaintiff believed and was told that the defendant was an unmarried man and capable of contracting matrimony in accordance with the laws of South Carolina, but afterwards plaintiff was told that the defendant had a wife living, from whom he was legally divorced and on account of said pretended divorce he had a legal right to contract matrimony, but still later plaintiff was informed and now believes and alleges that the defendant had no legal right to contract matrimony j " with the plaintiff 011 account of his then living wife, and as soon as plaintiff discovered said fact plaintiff declined and refused to live longer with the defendant and does not in the(>. future inteed to have anything to do with the defendant, wherefore plaintiff demands judgment against the defendant. '*2. That said pretended marriage be declared to be a nullity and void." The court ordered that the plaintm has a right to use her maiden name the same as if such pretended marriage had not taken place. Denmark Doings. Denmark, Aug. 7.?The D. D. D. club had a very successful meeting Friday night. All members were present and also a few visitors. J. C. Folk was unanimously elected president. The old maids and the bachelors enjoyed a very pleasant straw ride last Friday night. Miss Maxie Duffts has just returned from Augusta. Roseoe Still has returned from a pleasant trip to Elliot, where he visited his brother, Russel Still. D. P. Folk is spending a few weeks in New York. Miss Leoline Walker, of Columbia, J is spending a few days with her relatives in Denmark on her return from Florida. Carlisle Folk is spending a few days in Hampton.
