Patterson, game warden for Barnwell County, has re- ceivevd the following letter from the th« chief Game Warden: In the pamphlet of bird, game and non-migration fish laws of South Car olina, published by authority of W. H. Gibbes, chief game warden of South Carolina, in April, 1920, there is a failure to incorporate Act No. 386,cf the acts of 1918, which act in part, ' i say*. “There shall be a close time in all the creeks, streams and inland waters of the state from the setting of the sun each Saturday until the rising of the sun each Wednesday dunng which time all teines, nets or any plun or device for the stoppage orcollecti >n of fish, which obstructs any port on of any creek, stream or Injcnd waters other than a dam for manufacturing purposes, shall be removed front said creeks, streams or inland waters; and any person or persons using such seines, nets, plan or device in viola tion of the provisions of this act shall be deemed guilty of a misde meanor, and upon conviction thereof before any court of competent juris liction, shall be fined in the sum of $200, one-half of which shall go to the informer and the other half to the court in which the easi shall be tried or be imprisoned for a period of not less than three nor moro than six months, or both m the discretion of ♦he court trying the ic.se Nothing herein contained shall rnply to fish ing with dip nets used by handi And wherever any aein.*, net or any nlt'.n < r device for the stoppage or collec ting of fish, as above stated, shall be used, the chief game waiderf or any warden shall have the authority, in the name of th • state, to seize and hold said seine, net or plan or device for the stoppage or collecting of fini, and to use the sana* as t' dence ' the purpose of convicting any person violating the provisions of this sec tion; and upon conviction of the p?t aon so using said seine, net or plan or device for the stoppage or collect ing of fish, the same shall be forfe't. ed to the state and sold, the pro ceeds of said sale to be t-ansmiUet fo the credit of the game protection fund.’ Approved the 12th day, of February, 1918. “On May 12, 1921, I took this mat- terup with th» attorney general an his opinion is: “ ‘1 find no amendment or repealing act changing the provisions of this section in the respect that it requires n ‘dose time’ in streams, creeks and inland waters of the state. He was given all attention which could be given him, hut a rail came for him, and he fell asleep, to awake no more until on the .ludgment Throne. He was so sweet and dear and every one loved him dearly. Can we now bring him back again? We can go to him, but he shall not i return to us.
