But this 4M not end the 14-year campaign against A4P, according to the fourth edvertUgment in a series discussiag previous unsuc cessful attacks on the pioneer food chain by Anti-Trust lawyers. “The Anti-Trust lawyers were not satisfied with decisions against them by these Federal Judges.” the ad says. “They still granted to de- sti^by A4P.” The advertisement tens how in 1944 the Dallas case, based on alle gations similar to those in the cur rent suit to put A4P out of busi ness, had been thrown out of court by Federal Judge W. H. Atwell. On appeal, the ad says, the Cir cuit Court at Ne^ Orleans, al though reinstating the indictment, agreed that it was '‘vague and con tained many allegations which were inflammatory.” The Court decided Judge Atwell “should pro tect A4P from these Inflammatory allegations by striking them out” Judge Atwell struck these state ments, the sd says, and instructed the Anti-Trust lawyers to furnish him “specific charges instead of vague generalities.” “On February 21, while the Judge waa still waiting for his answer in Dallas, and without any previous notice to him,” the ad states, “the Anti-Trust lawyers gave a story to the newspapers In Washington, announcing that they were drop ping the case in Dallas." In dropping tha case, the Anti- Trust lawyer* were quoted as say-. Inc they Intended “to file' a sub stantially similar suit in an ap propriate Jurisdiction at an early date.” The “early data” proved to be the same day, A4P saye in the advertisement. “As soon as one Anti-Trust lawy er killed the case In Dallas, another Anti-Trust lawyer filed a new case In Danville, 111.” The ad continues. “This new case made most of the same allegations that had been made and dropped In Dallas and that are being mad* again.it us today. “Despite defeats la three Federal Courts In widely separated parts of the country, they continued their campaign to destroy A&P.” When Judge Atwell heard of their action, he ordered the Anti- Trust lawyers to prepare an order tor hit signature diamisslng the Dallap case, the advertisement says. In signing the order, the Judge told OM lawyers: “This nolle prosequi does not have the sanc tion or approval of this court. That is a matter that may be presented to the other Court and may be of Interest to the peopls at large.” Summarising previous court no tions In the Anti-Trust lawyers*' 14- year attack on A4P, the advertise ment observes: “Three times the Anti-Trest lawyers went Into Fed eral Courts and made serious and damaging charges against A4P. Three times Federal Judges said the Anti-Trust lawyers were wrong and rendered decisions against them.” After they failed in Washington, D. 0^ Wilson. N.
