Attorney General Calls Attention To
Duties Devolved Upon Them.
Columbia, Aug. 2.? -"Samuel M. Wolfe,
the Attorney General, iu a letter to the
foremen of grand juries of the several
counties of the State, calls to their at
tention certain tspscittc duties devolved
upon grand jurymen*. They are to in
vestigate county offices, and present of
fenders against the law and calls at
tention to the law regulating the em
ployment of females iu mercantile es
tablishments. The letter follows:
"My Dear Mr. Foretman : There are
several matters that I have, felt could
be properly called to your attention by
this office and which might assist you
in Nome degree in better knowing of
these things witliiu the proviuce of your
duties and in oixler that you may have
these in mind (hiring the closing months
of the year and pending your fiua pre
sentment, 1 am taking this occasion to
write to you.
"i cull your attention to Section 728,
Volume I, ( Vsle of 11)12, authorizing
you to call in the assistauce of the
solicitors of your .circuit in the exami
nation of the condition of the offices
of Hie clerk of court, sheriff and of the
register of mesne conveyance prepara
tory t?> your report at the fnll term of
your court each year.
"It falls to the duty of this of&ce
to prosecute actions for the recovery j
of penalties ami defalcations and by
way of obviating the complications which
necessarily arise in connection with suits
against personal sureties on official bonds
ami to better secure the State against
the exigencies in such cases the General
Assembly in 1912 enacted that before
any county official, who is required to
give bond. except magistrates, constables
or rural policemen, shall eutep into the
discharge of the duties of his office, he
shall, if possible, procure a bond in some
reliable surety company, and it is sug
gest ??<l that your body keep this fact
ever before the minds of the county com
missioners, whose duty it is to approve
these bonds as to snirety.
"1 call your attention further to the
fact that it is within the province of
your body to present an offender against
tin' peace and dignity of the State, in
which cum1 the court will direct the pro
cedure by which such offender may be
brought to justice.
"In your deliberations upon hills of
indictment handed you by the solicitors^
yon do not sit as a petit jury to try
the case upon its merits but simply to
ascertain whether or not in the light
of such competent testimony aa Is avail*
ible the probabilities of the case would
warrant prosecution on the part of the
State and in arriving at this conclusion,
under the law, concurrence of only
twelve. of your number is necessary. It
is not an iudi>ipensnble prerequisite to
indictment that the offender be given a
preliminary trial before a magistrate.
Frequently an offense is committed dur

event it is pcrinissable that the matter
be forthwith brought to your attention

"The law approved the lirst day of

?solicitor. This is to expedite the dis

"I take occasion also to call your
attention t?> sections 420 and 430 of
the < 'ode for Criminals, 1012, regulating
the employment of ftwiAlcs by mercan
tile establishments. While the enforce
ment of this law is charged to the Pe
partjnent of Agriculture, Commerce and
Industries. I am sure this department j
will appreciate your cooperation in bring
ing to its Attention, or by presenting
the offenders of your own initiative,
wherever violations of the law may rome
under your observation.
"I wish to assure you in this con
nection that this office stands at all

discharge of your duties.

Roads.

from the primary election held today

issuance of $2,000,000 in bondu for the
building of a system of permanent hard
surfaced highways in the county The
vote was somewhat 'light, 1,013 voters
favoring the bond iseue and 700 being
opjiosed to it The vote in the city of
("Y>hifr?bin was about five to one for th?
issue while its' oi>i>ouentfl carried the
rural districts by a ''small majority.
The eloction today has no legal status.
It was merely for gaining an estimate
't*f the sentiment of the people on the
permanent highway system. A bill has
been prepared authorizing the issue to
bo presented to the nert session of the
(Jeneral Assembly, which undoubtedly will
pass it. It is probable that the work
on the highways will begin next spring.
