Smith led off for the state, followed by Mr. Blakeney and Mr. Kirkland for the defense. Solicitor Cobb elosed for the Htate aud Judge Sease delivered an uble and absolutely Impartial charge to the Jury, who retired about 1 : 30 o'clock. Owing to the prominence and large family connections of all par ties concerned the case haa attrac ted large crowda from every section of the county each day. and many ladiea were In evidence to hear the speeches on both ?sldeB. Brooks Elder and John Elder plead guilty to assault und battery with Intent to kill Anthony Patter son. Three years on the chain gang. G. S. Mullls plead guilty to house | breaking and larceny and was sen tenced to 18 months. Jim Furtic plead guilty to assault and battery and was sentenced to nine months. The jurors and witnesses were dismissed yesterday afternoon * until Monday morning, when the civil docket will be taken up. Sam Logan, colored,, charged with housebreaking and larceny was ac quitted. Ernest Simons, colored, was found guilty of assault and battery with intent to ftill, and was sentenced to 5 years on the chain gang. In the case of Win. A. Stewart, white, charged with the killing of a negro some time ago on or con struction train on the .Seaboard, the court directed a verdict of acquits!. lOd. Green, colored, plead guilty to larceny and was sentenced to servo a year in the reformatory in Lex ing'on county and to pay a fine of *1.00. Tally Cruuipton, better known as '^Blind Tally," plead guilty to a charge of selling whiskey and was sentenced to pay a fine of $1,600 or serve one year on the public works. The court, however, sus pended sentence pending Tally's conduct in the future, but left in s ructions that should he deal in whiskey again that he be Immedta te'y arrested and the sentence of the court carried out. Irene Johnson, colored, was found guilty of petit larceny and sentenc ed to pay a fine of $30 or serve 26 days in the county jail. Gilbert Kelly was found -itiliUy of assault and battery with Intent to kill and was sentenced to serve 3 years. Isaac Anderson, colored, charged with assault with Intent to ravish was acquitted. The defendant was represented by attorney G. G. Alex ander, Jr. This was Mr. Alexan der's first appearance ' before the To His Honor, T. S. Seas, Presiding Judge, SpYJng Term 1913 Court. We the Grand Jury for Kershaw county, beg leave to make the fol lowing presentment: . We have passed on all "bills handed us by the solicitor. We find the roads are in as &ood con dition as could be expected, owing to the weather conditions. We would recommend that the County Commissioners would take up the matter of. building a road from the west side of Wateree bridge, "from said bridge to the hill on west s^de of said bridge, so that the travel from, and to that side of- the river will not be Impaired, as heretofore by high water, up to . a thirty-foot freshet, if not higher. We would also call the attention of the au thorities to the crossing at the brick yard, across the Southern rail road track. The same is in bad condition, and needs immediate at tention, also the crossing west side of depot creek, on main line of the Southern railroad *be made wlde?, as we consider a condition. "*7_J We would recommend that the trustees of the different school ing tricts of the coimty would have a stipulated time made in contracts with teachers, . as to time actually put In school room.
