HERBERT SPAUGH Have you made your will, that document which will determine the distribution of what you leave in a material way? Remember that you will leave all of it. Your will is the most import ant document you can write. Many say that they will leave it to the state to distribute their posses sions. Be sure you know what your state law is. With a will you can name an excutor of your own choosing and a guardian for your minor child ren. You can exempt both from furnishing surety bonds which would have to be paid by an ex ecutor appointed by the court. If you die in North Carolina without a will the court will appoint your administrator, and your property will be distributed as follows: 1. Married man or woman with no children or other descendants: with parents surviving, one-half of your real estate will go to them, shared equally, but if only one survives, the survivor takes the entire parental share; one-half goes to the spouse. Where other property is worth$10,000or less, all goes to the surviving spouse. With no parents surviving: all to surviving spouse. This is true in the case of no will. In case the surviving widow dissents from the will, she will receive only one-half of the estate. 2. Unmarried man or woman or widow or widower with no child ren or other descendants: With parents surviving, all goes to parents to share equally. But if only one survivor, the survivor takes the entire parental share. No parents surviving, but bro thers and sisters surviving: It is shared equally among bro thers and sisters. If there are deceased brothers and sisters represented by children or other descendants: distribution will be made on a per capita basis by class represented. If there are- no brothers, sisters, grandpar ents, uncles, aunts, or collateral kin, the entire estate passes to the University of North Carolina. Married man or woman with children or other descendants: with one child or lineal descen dant, one-half goes to spouse and one-half to the child. Ifthere is more than one descendant (child) then one third goes to the spouse and two thirds equally among the children. 4.
