SB IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLINTON, SOUTH CARO LINA, IN C O U N C I L ASSEM BLED: Section 1. That the following special license taxes are hereby imposed for the privilege of car rying on the business, trade, pro fession, or doing the acts named or described herein, within, the corporate limiti of the City of Clinton, South Carolina, from the 1st day of January, 1963, to the 31st day of December, 1963, in clusive, and annually thereafter until repealed or amended, and that the same shall be due and payable on or before the 1st day of March, 1963, and each year thereafter, unless otherwise here in provided, except in cases where a person, firm, company, or corporation shall inauguarte and start a new business or enter prise,. whereupon the license tax for the same shall be due and ^payable on the day such business is begun. New businesses which shall ap ply for license on or after Janu ary 1st shall pay the minimum fee as stated in the ordinance for its classification at the time of acquiring the license and at the end of the calendar year the total license payment based on the ac tual business done shall be due and payable with credit allowed for that amount which has pre viously been paid. The license tax > for the second year shall be cal culated on the basis of business done in the first calendar year multiplied by the number of . months necessary to give busi ness done in twelve months.' For the purpose of computing and col lecting the license tax on any fire insurance company having an , agent or agents in the City of Clinton or doing business in the City of , Clinton, or issuing poli cies of any natufe cov ering any property, real or personal, or covering any risk: (a) The City shall compute and collect two (2%) per cent of the gross amount of all pre miums collected by the agent of the company, whether the property or risks be located within the City or not. Provid-, ed that no such compu tation or collection shall be made on any premi um collected upon a risk Icoated in another muni cipality within the State of South Carolina upon which such other muni cipality assesses and collects a business li cense. (b) The Qty shall compute and collect two (2%) per cent of the gross amount of all pre miums charged by ah insurance company for the issuance of any pol- *1$$ %Mch covers any property, ‘ real or per sonal, or any risk, lo cated in tbs said City, whether the premium be collected by an agent do ing business in the City or by any other agent Of the Company wherever residing. On or before February 15th of , each year all agents shall file with the City Clerk a statement under oath showing all premiums collected by the agent and premiums originating from poli cies, countersigned by the agent, covering any risks located within the City SI Clinton, although the premiums are not actually collected b y such agent. ^ Each insurance com pany Issuing any policy or policies covering any property or risks locat ed in the City of Clinton shall file with the City Clerk on or before Feb ruary 15th of each year a statement under oath showing all premiums collected on insurance policies issued during the preceding year by said company and cover ing any property or risks located in the City. Such statement, howev er, is riot to include any premiums reported and shown upon the sworn statement or its agent, but all others. It is hereby declared that it shall be conclu sively presumed that the premiums charged for the issuance of any pol icy covering any prop erty, real of personal, or risk withiri the City, was collected within the City. Where two or more kinds of business are con ducted in the same place, it shall be the duty of the licensee to keep an accurate account of the affairs/'Of each kind of business and to separate satisfactorily the affairs of each so that the proper amount of tax imposed and pay able on each type of busingps may be readily ascertained, oth erwise the maximum rate ap plicable to any type of business being operated shall apply to the whole. Section 2. That all licenses is sued under and by virtue of this ordinance shall be non-transfer- able and except for a license for a day, week, or month shall ter minate and end on the 31st day of December, 1963, but may be re voked at any time by the City Council of the City of Clinton on satisfactory cause being shown; and except licenses issued for a day, a week, or a month, annimi rate shall be charged for all li censes issued prior to June 1, 1963, three-fourths of the annual rate shall be charged for all li censes issued after May 31st, 1963, and prior to September 1st, 1963, except as otherwise herein provided; and one-half of the an nual rate for all licenses issued after Augdlt 31, 1963, and prior ot December 31, 1963, except as otherwise herein provided. Section 3. That every person, corporation, or partnership re quired by this ordinance to obtain a license to engage in any bust ness, trade, profession, or occu pation, for which a license is re quired, shall at the time of apply ing for such license, or any time as may be required by the City Council, furnish to the City Clerk, or auditor of the City, such other and further information as may be necessary for correctly ascertaining the license to be as sessed and collected. Section 4. Any person, firm, company or corporation prose- cuting or engaging in any busi ness, trade, occupation or profes sion or keeping or maintaining any establishment named in this ordinance without first having paid the licensee tax thereon, or shall violate otherwise any of the terms or provisions of this or dinance, shall, upon conviction, be fined not exceeding one hun dred dollars, or imprisoned not exceeding thirty days, at the dis cretion of the Recorder, z Section 5. Where a license is imposed by this ordinance upon any business, profession, or occu pation, and such business, profes sion or occupation is canned on or conducted by an agent, clerk or employee, such agent, clerk or employee shall be subject to all the penalties herein imposed should the business, profession or occupation be carried on or prosecuted without the license im posed having been paid in the same manner as if such agent, clerk or employee were the pro prietor of such business, profes sion, or occupation. Section 6. Where the amount of the license provided for herein is dependent upon the amount of income, receipts, or sales, th? basis for ascertaining the amount of the license shall be the amount of the income,' receipts, or sales for the preceding year ending De cember 31, 1962, except in the case of new businesses which are otherwise herein provided for. - SECTION 7. THAT EVERY PERSON, FIRM, COMPANY, OR CORPORATION, REQUIR ED BY THIS .ORDINANCE TO OBTAIN A JJCENSE TO EN GAGE IN ANY BUSINESS, TRADE OR OCCUPATION FOB WHICH A LICENSE IS RE QUIRED, SHALL AT THE TIME OF APPLYING FOR SUCH LI CENSE MAKE A STATEMENT UNDER OATH, BEFORE AN OFFICER QUALIFIED TO AD MINISTER OATHS, AND FILE SUCH STATEMENT WITH THE 11 CITY CLERK SETTING FORTH: . (1) HIS OR HER NAME, STYLE OF FIRM, NAME OF COMPANY, OR CORPORA TION; (2) THE TRADEi BUSINESS. PROFESSION, OR OCCUPA TION FOR WHICH A LICENSE IS REQUIRED; (3) , IN THOSE CASES IN WHICH SUCH INFORMATION IS REQUIRED, THE AMOUNT OF BUSINESS DONE DURING THE PREVIOUS YEAR IN THE SAME OCCUPATION, TRADE, BUSINESS, OR PROFESSION. THE CITY CLERK SHALL THEREUPON ASSESS AND COLLECT 1 THE PROPER LI CENSE TAX AS PROVIDED FOR IN THIS ORDINANCE, AND UPON SUCH TAX BEING PAID, SHALL ISSUE TO THE APPLICANT THE PROPER LI CENSE. * Section 8. For any business, trade, occupation, or profession not enumerated in Section I of this ordinance, the license shall be fixed by the Mayor and he is hereby given full power and au thority to fix the same and such license therefor as shall be fixed by the Mayor shall be as binding in every respect as though it were specifically enumerated or desig nated in this ordinance. Section 9. The license taxes herein imposed are levied for the purpose of raising funds to meet the ordinary annual expenses of the City of Clinton for the fiscal year commencing on the 1st day of January, 1963, and for the pur pose of paying in whole or in part legal indebtedness of the said City incurred for ordinairy expenses thereof falling due during the said fiscal year. Section 10. All annual licenses must be paid on or before March 1st, 1963, or penalty of an addi tional ten (10%) per centum of the amount herein stated be charged after March 1st, 1963. If said license tax is not paid on or before March 15th, the busi ness shall be closed by the Chief of Police and action brought in Recorder’s Court for the City un der Section 4 of this ordinance for the misdemeanor of doing business without a license. Section 11. If any word, clause, sentence or section of this ordinance be declared unconsti tutional or in contravention of any law or laws of the State of South Carolina, such shall not af fect any other word, clause, sen tence, or section hereof. Section 12. This ordinance shall be effective from the date of its passage.
